Attorney Charles McLaughlin, Jr.., presented his petition for a Special Permit to allow
a family apartment in an existing two-car garage located at 4259 Main St., Route 6A,
Cummaquid in an RF-2 zoning district - the property formerly owned by Dr- Strayer.
The existing residence was built around 1812 and contains approximately 3;281 -square
feet - the family apartment will contain about 930 square feet and will consist of
the entire first floor of the garage, and will be the primary residence of the
petitioner's elderly mother who is in fragile health. The petitioner will comply
with all of the requirements of the by-law as it relates to family aparbnents.
The existing garage encroaches into the setback area and thus, does not conform.to
existing zoning requirements. The proposed. fardly apartment contains a living roam,
bedroom, kitchen/dining area and a handicapped bathroom, per the Plan presented at
the filing - the interior stair to be eliminated and an existing dormer will also
be eliminated, as shown on the Plan. This is a defacto situation - the garage is
existing - we have to accept that even though it is not legal. There were several
abutters at the initial meeting who commented on lodging houses, specifically,
Appeal No. 1982-53, which is a different case entirely. Ron Jansson made a motion
to grant the relief sought, and as presented, on the basis of the fact that it meets
all of the criteria of Section V. in spite of the objections of a few participants
in Town who referred to a previous case that was denied, it was found by the Board
not to be correlative. ' In addition, there was no evidence presented at the hearing
to indicate that the granting of the Special Permit would be substantially detrimental
to the neighborhood involved. The Board voted unanimously to grant the Special Permit
to allow a family apartment in an existing garage at 4259 Main St., Route 6A,
Cu maquid.

Dear Mr. McLaughlin:
On July 1986, as applicant ( s ) you were granthd a Special
Permit for a family apartment. "The intent of this by—law shall.
be to allow one ( 1 ) additional living unit , complete with kitchen
and bath to supply a year"-round residence for a ' member or members
of the property owners family. . . . . . . . . . . . . In addition, the
by- law also states that "The property owner, and the person or
persons wrSo will reside in the family apartment shall sign
affidavits bt. for'e occupying said family apartment and further;
all shall sign said affidavits each year said family apartment' is
occupied. . . . . . " . Within sixty (60) days from the date the person
or persons residing in the family apartment vacate the premises,
the owner or his representative shall remove the kitchen
facilities and request the Building Inspector to inspect the
.Premises.
It is important that you understand that there are
restr•ictions . which relate to the applicant 's family living at the
same premises. The use cannot be transferred.
Conviction of a vi6lation of this by-'law is subject to a
fine of $100 per day fop each day from the established date of
offense and, also, subject to a criminal complaint to issue from
the First District Court of Barnstable.
Affidavits must be signed and filed at the Building
Commissioner's office between the hours of 9: �r`J�0 A.M. and 1 :30 a .
P. M. Monday through Friday.
This by—law shall be strictly enforced.

Dear Mr. McLaughlin:
On July 2, 1986, as applicant(s) you were granted a Special
