The property includes a conventional 2-story dwelling constructed in 1980. The applicant proposes to utilize the first floor garage area of 832 sq. ft. for the seasonal sale of farm produce and related products grown on multiple sites. A defined parking area accommodating six parking stalls is also proposed to accommodate the use. The second story is intended to remain as a residential unit. The applicant is seeking relief in the form of a variance,which would specifically allow produce cultivated off site to be included with the retail sales of organic produce farmed on the subject lot. Relief is also sought to allow the applicant to employ two unrelated farm hands for assistance with the daily operation of a typical family-owned farm. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 24, 2003. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 23, 2003, at which time the Board found to deny the variance requested. Board Members deciding this appeal were, Ron S.Jansson,Richard L. Boy, Thomas A. DeRiemer, Jeremy Gilmore, and Chairman Daniel M. Creedon. J. Timothy Friary appeared on his own behalf. He stated that he recently purchased property and would now like to reopen the garden stand for the sale of produce. It has been a produce stand for several years. He noted that he would bring produce grown by him on other sites to be sold at this stand. Corn would be the only produce he would not be growing but would like to sell at the location. Mr. Friary noted that he intends to create parking for 6 cars. The Board discussed the issue. It was noted that this may not be what the intent of exempt use under MGL Chapter 40A section 3 was intended for. It is really an application for a variance for retail sales not an agricultural use. Public Comment was requested and several neighbors spoke in opposition.
