In 1972 my parents bought a property at 4380 Route 6A Cummaquid fromSTABLE
John Drew Realty. This was to help start me out in life. At that time there
were two families living there. The Jerry Walton family upstairs and the
Harold Tobey family downstairs. Harold Tobey was a policeman and later
on became a Barnstable Town Councilor.
My father was a Congregational minister and in charge of 118
Congregational churches in Southeastern Massachusetts. They originally
were hired to run the Craigville Conference Center which they did from
1960-1972. My mother was a teacher and an author of twenty two books,
including The History of Yarmouth and the History of Barnstable. She
later became the first recipient of the Mercy Otis Warren award. Together,
realizing there was a shortage of living for elderly and low income people,
they spearheaded five housing projects, one in Falmouth, the Mashpee
United Church Village in Mashpee, Shawme Heights in Sandwich,
Mayflower Place in Yarmouth, and one in Harwich.
When we bought the property in 1972 I was given permission to build a
studio apartment in the main house and one in the barn from the building
inspector. It has now been rented succesfully providing below market rates
for now fifty years including clients from the Housing Assistance
Corporation.
I am now 74 and I had applied for a line of credit from Citizens Bank. To
my surprise the property is listed as a single family which raised a flag to
the building department. I then received a "Cease and Desist" letter. I hired

a lawyer to go before the board of appeals. In those fifty years the property has
been inspected by the board of health, numerous insurance companies, the
Housing Assistance Corporation and possibly the building department. I know
that inspections and licensing has been spasmodic in the past. I have gone to
the different agencies and have found very little evidence to support my claim
as a four unit apartment house. The earliest was 2007 from the Board of
Health. HAC had no information that far back and the building department
had no information at all. I do however fill out the annual form from the
assessors office for the past years showing the four apartments so they are
aware.
I find it rather incredulous that I have operated for fifty years now and am
being forced to prove my claims. If anything I think it is the mistake of the
building department and the then building inspector, whom I understand was
very lax in licensing.
I did however meet with Mr. Bowers and two firemen to inspect the property.
Mr.Bowers and the two firemen seemed amenable to okaying the property as
long as I met the suggestions of the fire department, which included hard
wiring five smoke detectors in the main house and the barn.
I am appealing to your good senses to allow me to continue the rentals,
knowing there is a housing shortage and the fact that it's been fifty years and
my rentals are below market and there have been no complaints in that time.
My parents were very aware of regulations and did everything according to the
book, considering their five earlier housing projects.
I am now 74 and it would make me comfortable knowing that I can continue
the rentals to help support me in my later years. I can only hope this does not
fall on deaf ears.

necessary site improvements.

Background:
This decision concerns the appeal of Marion and Louis Vuillemumier who are
seeking a Variance from the Zoning Board of Appeals to permit the location and
construction of a 1014 sq. ft. post office at the site listed above. The site
presently contains a residential structure, an accessory structure used as an
office, and a sign shop in the barn.
The site plan was conditionally approved by the Site Plan Review Committee May
28, 1992. The conditions are dated May 21, 1992.
Staff at the Massachusetts Historical Commission reviewed the proposal, visited
the site on April 7, 1992, and made the following comments:
The proposed location of the new facility is a. tightly constricted site
which closely abuts a contributing building in the historic district.
While the design of the new facility is sensitive to the character of the
historic district, its siting creates a more dense streetscape that is not
characteristic of this portion of this historic district.
The proposal was heard by the old Kings Highway Historic District Commission and
denied at the hearing on July 8, 1992. The Commission felt that "although the
proposed structure itself was not objectionable in terms of its style, the
addition of such a structure in the proposed location, the destruction or
relocation of the stone wall, the widening of the right-of-way, and the proposed
parking area, all taken together, would negatively impact the immediate setting
and surroundings and be deleterious to the purposes of the Act". The Commission
Decision and Notice '
Appeal No. 1992-48
felt that it would be "inappropriate to 'shoehorn in' another structure on this
historic setting, in such proximity to the nineteenth century house and barn on
the same lot, and to the other house just the other side of the right-of-way".
The petitioners have appealed to the regional old Kings Highway Historic District
Commission.
The lot is 1.36 acres and contains 1 residential dwelling of 2,252 sq.ft., 1
office dwelling of 1,536 sq.ft., and a barn, in which a sign shop is located, of
343 sq. ft. The applicant states the present use of the premises is residential
and commercial (the shop) . The applicants proposal is to construct the new
structure, to be leased to the Postal Service, with 1014 sq.ft of floor area and
a parking area in which the existing right-of-way off 6A will be the entrance to
the post office parking area.
Procedural Summary: ,
The application was filed in the office of the Town Clerk and at the Zoning Board
of Appeals office on July 13, 1992. The public hearing, duly noticed under MGL
Chapter 40-A was opened on June 23, 1992, at which time the applicants attorney,
Mr. Dupuis, asked to withdraw without prejudice in order to appeal the old Kings
Highway Historic District Commission ruling to the old Kings Highway Regional
Historic District Commission. The Board granted the request. The public hearing
on this petition was held in the School Administration Building, First Floor
Conference Room.
Order:
The Zoning Board of Appeals at its July 23, 1992, meeting agreed to allow the
applicants to withdraw without prejudice Appeal #1992-48.

Any person aggrieved by this decision may appeal to the Barnstable
Superior Court, as described in Section 17 of Chapter 40A of the
General Laws of the Commonwealth of Massachusetts by bringing.an
action within twenty days after the decision has been filed in the
office of the Town Clerk.
