On —January _1 _ _ 19 ..80..w-, The Board of Appeals found The petitioner was represented by Atty. Michael O'Neil who explained the location of the property in question. This parcel is on route 6A in Cummaquid and comprises approximately 80,000 sq. ft. . The zoning district in which it is located allows single family dwellings and renting of rooms for six lodgers by the family in residence. The petitioner has completed 80% of the renovation in a 20-room house and would like to sell art objects, antiques and quality furniture from this location. There would be no outside advertising or display; sales would be by appointment only, and these would all be high ticket items. The petitioner would have one part-time employee. The petitioner has spent a great deal of time and money in renovating this property and purchased it because of its historical value. This house was for sale for a long period of time and due to its rundown condition, was eventually re- duced from $135,000 to $80,000. The petitioner hoped to sell off a portion of his land for a house lot which he counted on to help defray the expense of the house renovation, however, he found that he has a small deficiency in the amount of land needed to make up a legally buildable lot. This unforeseen problem along with the high cost of renovation has caused the petitioner financial hardship. Mr. O'Neil said that this,.house could be opened .up to six.-lodgers by right.,and this use would.. be more detrimental than the limited commercial use the petitioner is requesting: -. . A plan was presented to the Board showing the many commercial uses existing in the immediate area of the locus which includes "Anthony's", a large restaurant-inn. The petitioner's property is the most affected by Anthony's and the activity at this restaurant makes the petitioner's property undesirable for residential use only. and unique to the zoning district. The existing barn would not be used for commercial purposes and there would be no change in the outside appearance of the house. Mr. Quentin Munson spoke in objection to the petition and said that since zoning does not allow the proposed use, it would not be a good thing to encourage business use in a residential zone and the petitioner was aware of the financial problems at the time he purchased the property. Dr. Neil Ringler, president of the Barnstable Civic Association, spoke in objection to the petition along with Mrs: Mary. Ann Strayer who felt that the proposed use would be detrimental to the neighborhood. Mrs. Strayer said that Town Meeting had deleted the previously allowed home occupation in this district and variance conditions do not exist at this site. (cont.)
