The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and to allow
homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside;on which there is,or is intended to be, a one or two-
family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one
home in a two-year period shall not be considered a homeowner. Such"homeowner" shall submit to the Building Official on a form
acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section
109.1.1)

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt
from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner
engages a person(s)for'hire to do such work,that such Homeowner shall act as supervisor."

Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor
(see Appendix Q,Rules &Regulations fortLicensing Construction Supervisors,Section2.15) This lack of awareness often
results in serious problems, particularly when the homeowner hires unlicensed persons. In this case,our Board cannot
proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is
ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the
permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page
of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in
"your community.

Asbestos Containing Building Materials Survey 14-69&14-69.01
1 Summary
Banner Environmental Services, Inc. was retained by Neal Renaud to conduct
an asbestos containing building material survey of the commercial building
located at 35 Marstons Lane, Barnstable MA. The purpose of the survey was to
determine the presence and location of asbestos containing building materials
(ACBM) prior to planned demolition.
This report should be reviewed in conjunction with the lab data and chain of
custody. Please be aware, if areas of the building were inaccessible or unsafe
during the time of the inspection, addenda to this survey may be produced at a
later date once areas become accessible or restrictions are lifted from unsafe
areas.
Rudolph Nelson, MA licensed asbestos inspector#AI61475, conducted an on-
site survey of the above-referenced property. A total of seventeen suspect
asbestos containing building materials were sampled which represent all
accessible suspect asbestos containing building materials.
Three of the seventeen samples tested positive for asbestos. Materials
containing greater than or equal to one percent asbestos are categorized as
asbestos-containing materials. Specifically, all residential, commercial and
institutional buildings are subject to Massachusetts Department of Environmental
Protection (MassDEP) asbestos regulation 310 CMR 7.15. Asbestos removal is
also regulated by the MA Division of Occupational Safety as well as OSHA, DOT,
and the EPA. Additionally, some local authorities may have standards regarding
the handling of asbestos.
This property is a wood framed, two level building which functions as a
clubhouse, pro-shop and dining area. According to public records, it was built in
approximately 1950. The exterior is wooden clapboard/shingles. The windows
have been updated to thermal pane. The roof has recently been replaced. The
attic is insulated with fiberglass. The heating system is forced hot air and absent
suspect asbestos containing materials. The flooring materials include carpet and
floor tile. None of the floor tile, associated mastic or residual cement was
positive for asbestos. The basement walls are homasote®fiber board, panel and
drywall. The inspector noted there are two types of drywall compound, identified
on the chain of custody as beige and white. The beige drywall compound
sampled from the women's bath and locker area tested positive for asbestos.
Therefore it must be assumed that any areas where beige drywall compound is
present is asbestos containing and should be handled accordingly.
All areas of the building were accessible at the time of inspection.

2 Sampling Methodologies
Banner Environmental Services, Inc. employs systematic inspection and bulk
sampling to include all representative suspect asbestos containing materials.
Typical suspect asbestos containing building materials include the following:
insulation on steam pipes, boilers, furnace ducts, and wood stoves, resilient
flooring materials backing and adhesives, door gaskets in furnaces, wood and
coal stoves, soundproofing or decorative material sprayed on walls and ceilings,
patching and joint compounds, attic insulation, roofing materials, shingles and
siding.
Care is taken to avoid duplicate sampling as well as unnecessary sampling.
However, the number of samples the inspector collects is governed by
regulations. Regulatory guidelines mandate that adequate sampling be collected
based on the category of the material as well as the size of the area.
The inspector also assesses for friability and the condition of the material during
the sampling phase of the survey. Friable materials are those that when dry,
crumble by applying hand pressure. Examples of friable materials include but are
not limited to, pipe insulation, drywall compound, wall plaster, and acoustical
ceiling tiles. Common examples of non-friable material (material which does not
crumble with hand pressure) include floor tile, mastic, roofing shingles, and
transite shingles.
When collecting bulk samples, every effort is made to choose areas with the
least visual impact while minimizing disruption of ongoing activities in an
occupied space. Representative samples are sent to an EPA accredited
laboratory in labeled, individually sealed bags with a log sheet also known as a
chain of custody. The chain of custody identifies the location where the sample
was collected and a description of the sample. Laboratory analysis is performed
using polarized light microscopy (PLM) which is the EPA's recommended
procedure for bulk sample analysis. Typical requested turnaround time is twenty-
four to forty-eight hours.
3 Recommendations -.
Prior to a major renovation or demolition where asbestos fibers may be released,
with few exceptions, all asbestos containing materials must be abated by an
asbestos abatement contractor licensed in the Commonwealth of Massachusetts.
The DEP requires notification of all asbestos abatement activity. Unless an
emergency waiver is granted, asbestos abatement cannot commence prior to ten
business days after the notification is made by the asbestos abatement
contractor.
Additionally, current regulations of the Commonwealth of Massachusetts DEP,
require notification and permits for any interior or exterior demolition or facility

The EPA recommends 5 responses for handling asbestos hazards — removal,
encapsulation, encasement, enclosure and when the asbestos is in good
condition an operations & maintenance (O&M) plan. Asbestos is regulated by
federal, state and local authorities. Before commencing activities which may
disturb asbestos containing materials, it is advisable to consult with individuals
familiar with the proper handling of asbestos.
4 Limitations
The conclusions and recommendations of this survey are based on the
conditions and accessibility of the property at the time the survey was conducted.
Every reasonable effort was made to locate and sample all suspect asbestos
containing building materials. Unless otherwise instructed, this included selective,
minor destructive sampling in order to reveal possible asbestos containing
materials not readily visible. However, no inspection can provide unequivocal
guarantee that all asbestos containing materials have been identified. Demolition
or renovation may uncover spaces previously inaccessible to the inspector or an
application of asbestos not typically used in the construction industry. Therefore,
should demolition or excavation reveal substances suspect for asbestos, further
sampling and analysis is required. Until definitive characterization of the material
is established, these materials should be considered positive for asbestos and
handled accordingly.
