In accordance with all applicable current codes, a wet pipe sprinkler system will be provided for all floors of the building. The system is supplied with a connection to the town water supply. The sprinkler system in mechanical rooms, electrical rooms, tel/data rooms, file storage rooms,janitors closets, library book stack areas, storage areas, attic space and similar spaces will be hydraulically designed for Ordinary Hazard Group I occupancy requirements with a design criteria of 0.15gpm/sf over 1,500sf with 250gpm hose allowance. Maximum sprinkler spacing will be 225 sq. ft. Water is supplied by a town water main. The fire service for the building is a single 6" fire service with no post indicator valve and a 6" double check valve type backflow. A 4" Storz Fire Department Connection will be provided. A 6" Wet Riser Manifold will be installed for areas served by the wet sprinkler system. The fire alarm system will be a microprocessor-based multiplex, analog/addressable system with complete audio and visual occupant notification, and municipal reporting via a central station monitoring service. Each initiating point (waterflow switch, smoke detector, heat detector or manual pull station) will be individually addressable. Upon activation, the specific device address, type, status and location will be presented at an LCD annunciator integral to the FACP and remote LCD annunciator located in the Main Entry Vestibule. Occupant notification will consist of audio/visual signaling. Audible signaling will be a general temporal-3 pulse evacuation tone throughout the building. Visual signaling will be by xenon strobes in accordance with NFPA 72 and the Americans with Disabilities Act. All manualpull stations in the buildingwill be equipped with vandal stopper pp covers which will sound a local alarm if the cover is lifted. All area and duct-mounted smoke detectors, and heat detectors rated for 135- degree operation, will be analog/addressable devices. Each analog/addressable device will be subject to alarm verification and will be subject to environmental compensation in order to minimize false alarms. Microprocessor-based detectors will retain operating characteristics in non-volatile memory and conduct algorithms to. distinguish real fire conditions from unwanted nuisance alarms. System wide response to a verified alarm is designed to take place within 3 seconds. The fire alarm system will interface with the HVAC System in order to conduct the required fan shut down control functions via programmable control module outputs. HVAC System Description: • The HVAC system is designed in accordance with the Massachusetts Building Code, 8th Edition, International Mechanical Code, and NFPA 90A. The scope of this project included installation of split system AC units with gas heat for the basement and first floor areas. Furnaces serving the basement shall be high efficiency, units serving the first floor (located in the attic) shall be standard efficiency. The Kitchen area will be designed with a gas fired Make up air unit, a dishwasher exhaust fan and associated ductwork, Supply air smoke detection will be provided by a duct smoke detector at the supply discharge of the Make up air unit. Upon detection of smoke by the smoke detector, the Make up air unit will shut down automatically and transmit a supervisory signal to the fire alarm control panel. There will be also an Energy Recovery unit for the shower/locker area and console heat pumps for the sitting areas in the basement. Design also includes Cabinet unit heaters and/or unit heaters for the entry vestibule, kitchen, electric room and mechanical room as well as exhaust fans for toilets; Air conditioning and ventilation for elevator machine room and hoist way venting and Dryer exhaust venting for basement laundry area. A fire damper will be installed in ductwork where it penetrates fire-rated walls and where ductwork penetrates the floors in accordance with the Massachusetts Code 717.0 and NFPA 90A; damper rating will match the fire rating of the assembly penetrated. (1.b) SEQUENCE OF OPERATION FIRE SPRINKLER SYSTEMS Wet Pipe Sprinkler System: Heat produced from a fire melts the fusible link or glass bulb on a single sprinkler head or group of sprinkler heads causing the sprinkler(s) to open. Water from the water filled pipe is discharged immediately from the sprinkler head(s) to control'the fire. Fire pump starts automatically on pressure drop and continues to run until manually shut off. The fire department may pump either of the two fire department connections to supplement the system. Sprinkler system water flow alarms, activate upon system flow and indicate to the FACP an alarm condition. The sprinkler(s) continue to flow water until manually shut off. FIRE ALARM SYSTEM Sequence of Operation: ' In accordance with the Town of Barnstable and the Massachusetts State Building Code, the operation of a manual station or activation of any automatic alarm initiating device (system smoke detectors (except duct smokes) valve tamper switches, and waterflow switches)will cause the following to occur: • Transmit a signal to the UL Listed Central Station monitoring service via telephone dialer. • Sound a code 3 temporal evacuation signal throughout the building. • Flash all visual signals throughout the building in a synchronized manner. • Flash an alarm LED and sound an audible signal at the FACP. • Upon Acknowledgment, the alarm LED will light steadily and the audible shall silence. Subsequent alarms will re-initiate this sequence. Page 6 Cummaquid Golf Club May 30,2014 Yarmouth Port, MA • Upon alarm initiation by an elevator lobby smoke detector or other designated recall device, recall elevator that serves the floor of initialization to the main egress level. If the alarm initiates on the main egress level, return the elevator to the alternate floor as directed by the authority having jurisdiction. • Visually indicate the alarm initiating device type and location via the LCD display located at the FACP and the remote LCD annunciator located in the Main Lobby. • Automatically shut down HVAC functions, as required. • Activate the outside weatherproof beacon. • Activate outside 24 VDC electric alarm bell upon waterflow alarm only. Activation of duct smoke detectors will cause a supervisory signal only at the fire alarm control panel and send a supervisory signal to the UL Listed Central Station. HVAC Sequence of Operation: Make Up Rooftop Unit Smoke Detection: Smoke detector at the Make up air unit will be hard-wired to the fan starter and shall stop the supply fan and close the outside air damper whenever smoke is detected. Activation of duct smoke detector will cause a supervisory signal only at the fire alarm control panel and send a supervisory signal to the UL Listed Central Station monitoring service. (1.c) TESTING CRITERIA Section 1 —General Testing Criteria The general contractor has overall responsibility for setting up and coordinating all acceptances testing with authorities having jurisdiction. All testing will be in accordance with NFPA requirements, the Massachusetts State Building Code, 8th Edition, the International Mechanical Code, the NFPA National Electrical Code, local authorities having jurisdiction and the contract specifications. FIRE SPRINKLER SYSTEMS • The sprinkler contractor is responsible for setting up and coordinating all sprinkler system acceptance testing. All testing will be in accordance with NFPA 13, 14, 24, the Massachusetts State Building Code, and contract specification 15300. Each and every device will be functionally tested. • Upon function test of each device, the corresponding programmed event sequences will be verified. Subsequent events will include system annunciation, elevator recall, HVAC control sequences, and municipal reporting. • Proper visual notification will be verified. • Audible sound pressure levels will be measured and recorded. • Fault conditions will be simulated and verified as to their proper reporting and system response. These will include loss of AC power, battery standby operation, and wiring faults of each and every circuit. • A complete report demonstrating the activation and subsequent acknowledgement of each activation will be generated. An annual test and inspection contract will be in evidence at the time of final testing. The final system acceptance test will be conducted by the holder of the test contract, and witnessed by the local authority having jurisdiction. Upon successful test and acceptance, a UL certificate and final report of compliance will be issued by the testing company. Testing and inspection will be conducted by the testing company of record as described and in accordance with NFPA 72. In addition to device testing, maintenance (sensitivity) reports will be generated directly from the system during each quarterly test. These reports will include a complete listing of each analog device in the system, their corresponding programmed sensitivity setting, and their current sensitivity level, and the number of times each device has entered alarm verification mode. HVAC Upon completion and prior to acceptance of the installation, smoke detection systems and operations will be thoroughly tested in accordance with the Massachusetts State Building Code, 8th edition, the International Mechanical • Code and NFPA. A certificate of approval and acceptance will be submitted to the architect by the HVAC Contractor. All tests are to be witnessed by the Authority Having Jurisdiction and the Architect. The Petitioner sought to tear down the existing 11,238 square foot golf course clubhouse and rebuild a new 15,905 square foot clubhouse. The number of members belonging to the Cummaquid Golf Club was not proposed to increase; however,the larger structure will allow for expanded occupancy and use of the clubhouse. The Cummaquid Golf Club facility consists of 110.62 acres located in the Cummaquid area of Barnstable Village, south of Route 6A. The use of the property for a golf course dates back to 1895. The clubhouse, originally constructed in 1950,is situated on the northeast corner of the property. Two other structures, a golf- cart storage facility and a maintenance building,are also located on this portion of the lot;those structures are not impacted by this application. The remainder of the property contains an 18-hole golf course and associated facilities. The Board previously issued the following permits for expansion of the use: 1968-140: Expansion of golf course from 9 to 18 holes. 1972-016: Expansion of clubhouse and increase the number of memberships. 1975-027: Construction of an underground golf cart facility. This permit was never implemented. 1975-059: Construction of a free-standing golf cart storage building. 2003-015: Construction of new maintenance building. In 2012,the Club applied to the Board to demolish the existing clubhouse and rebuild a new 21,089 square foot clubhouse. That application was withdrawn without prejudice. The Applicant proposed to construct a 15,905 sq.ft clubhouse in the same general location as the existing facility. The proposed clubhouse is a two story structure oriented to the golf course to the south. The east facade of the structure,adjacent to the parking lot is a full two stories. The topography rises to the west;on the western facade of the building, the upper-story is at grade. There is an 860 square foot wrap-around covered porch on the southwest corner of the building, but no outdoor patio areas are proposed. The clubhouse features a dining area,"grill room"and bar and pro shop on the upper level and locker rooms, office space, and miscellaneous storage space on the lower level. There are 176 restaurant and bar seats proposed. Site improvements include realignment of the 69-space paved parking area. Approximately 62 spaces will continue to be provided in the crushed stone parking area. The clubhouse will continue to be accessed from the existing drive on Marstons Lane, in the northeast corner of the property. Procedural &Hearing Summary Special Permit No. 2014-019 to expand a preexisting nonconforming golf course clubhouse use and modify Special Permit No. 1972-16 was filed at the Town Clerk's office and office of the Zoning Board of Appeals on April 1, 2014. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on April 23, 2014 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were Craig G. Larson, Brian Florence,Alex M. Rodolakis and David A. Hirsch. Attorney John Kenney represented the Petitioners before the Board. Attorney Kenney provided an overview of the relief requested and a history of the golf club. He confirmed that there would be no change in the membership of the club. Matthew Eddy from Baxter&Nye Engineering provided a summary of the proposed site plan and improvements. Steve Cook from Cotuit Bay Design provided an overview of the elevations and floor plans of the proposed clubhouse. Attorney Kenney discussed the enhanced landscaping along Marstons Lane to improve the appearance of the property and screening from residential property. He confirmed the club had an operations plan that would not allow private events and tournaments simultaneously. Attorney Kenney confirmed the club was in negotiations with MassDOT for a 99 year lease and eventual acquisition of fee interest in the railroad property. The Board Chair requested public comment. Joseph Berland'spoke in favor of the application. Stan and Jenny Baukus discussed negotiations they had with the club to provide screening on the Baukus'property to help mitigate any visual or noise impacts. Findings of Fact At the hearing on April 23, 2014, the Board unanimously made the following findings of fact for Appeal No. 2014-019, a request by The Cummaquid Golf Club of Yarmouth and Barnstable, Inc for a Special Permit pursuant to§240-94 Expansion of a preexisting nonconforming use and modification of Special Permit No. 1972-16: 1. The Cummaquid Golf Club of Yarmouth and Barnstable, Inc has petitioned for a Special Permit pursuant to§240-94 Expansion of a preexisting nonconforming use and for modification of Special Permit No. 1972-16. The Petitioner seeks to tear down the existing 11,238 square foot golf course clubhouse and rebuild a new 15,905 square foot clubhouse. 2. The property is located at 35 Marstons Lane, Cummaquid, MA as shown on Assessor's Map 350 as Parcel 001. It is in the Residence F-1 and Residence F-2 Zoning Districts. 3. Section 240-94(B)allows for expansion of a lawfully established preexisting nonconforming use with a Special Permit from the Board. The use of the property for a golf course dates back to 1895. 4. The Site Plan Review Committee reviewed the proposal and issued a letter dated April 4,2014 approving the project subject to conditions and issuance of a Special Permit by the Board. 5. A letter dated April 7, 2014 from the Cape Cod Commission confirms that this project does not trigger mandatory Development of Regional Impact thresholds because the proposed increase in gross floor area for the replacement building is less than 10,000 square feet. 6. On March 12, 2014,the Bamstable Committee of the Old Kings Highway Regional Historic District Commission approved a Certificate of Appropriateness for the proposed reconstruction. A Certificate of Demolition to allow the removal of the existing clubhouse was approved on October 24, 2012 and extended by the Committee on September 25, 2013. 7. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. There will not be an increase in club membership associated with the expansion of the building. 8. The proposed expansion and intensification will not be more detrimental to the neighborhood. Landscaping improvements along Marstons Lane will further screen the proposed redevelopment from residential property. 2 B:k 2817E Pst212 �2316O Town of Bamstable Zoning Board of Appeals—Decision and Notice Special Permit No.2014-019—Cummaquid Golf Club of Yarmouth&Barnstable,Inc 9. The proposed building is in compliance with all setback requirements of the RF-2 District. The clubhouse is proposed to be located 277 feet from Marstons Lane. 10. The proposed use and expansion is on the same lot as occupied by the nonconforming use on the date it became nonconforming. 11. The proposed new use is not expanded beyond the zoning district in existence on the date it became nonconforming. The expanded use remains within the RF-2 Zoning District. Minor amendments to this landscape plan may be approved administratively. The existing facility is 11,238 square feet and the proposed facility is 15,905 square feet; the increase is 4,800 gross square feet. The Applicant is seeking a Special Permit to expand the preexisting nonconforming use of the property for a golf course clubhouse. The application also seeks to modify Special Permit 1972-16, which authorized construction of the existing clubhouse. The number of members belonging to the Cummaquid Golf Club is not proposed to increase; however, the larger structure will allow for expanded occupancy and use of the clubhouse. 1-Standing The Cummaquid Golf Club of Yarmouth and Barnstable, Inc. is the Applicant and property owner in this appeal. • A letter dated March 28, 2014 from the Massachusetts Department of Transportation confirms that they intend to enter into a long-term lease with Cummaquid Golf Club for the use of 5,089 square feet of land for parking and landscape purposes. This report includes a proposed condition that a copy of the lease must be submitted to the file prior to issuance of a building permit for the demo/rebuild. • The Applicant has not yet provided authorization of this appeal by the club's members for the record. The applicant should be prepared to demonstrate that authorization to file this appeal has been provided in a manner consistent with the Club's bylaws. Town of Barnstable Growth Management Department Staff Report Appeal 2014-019—Cummaquid Golf Club—Special Permit to Expand Use !Background The Cummaquid Golf Club facility consists of 110.62 acres located in the Cummaquid area of Barnstable Village, south of Route 6A near the Barnstable/Yarmouth town line. The surrounding area is developed primarily with single-family residential homes. The lot on which the clubhouse is located is bounded by Marstons Lane on the east and Massachusetts Commonwealth railroad right-of-way on the north. The use of the property for a golf course dates back to 1895. The clubhouse, originally constructed in 1950, is situated on the northeast corner of the property. Two other structures, a golf-cart storage facility and a maintenance building, are also located on this portion of the lot; those structures are not impacted by this application. The remainder of the property contains an 18-hole golf course and associated facilities. The clubhouse is served by a 68 paved parking spaces; additional parking is accommodated in a crushed stone parking area along Marstons Lane. The clubhouse is accessed by a main entrance drive on the north-eastern most corner; a second drive to the south provides access to the maintenance building. The Board previously issued the following permits for expansion of the use: 1968-140: Expansion of golf course from 9 to 18 holes. 1972-016: Expansion of clubhouse and increase the number of memberships. 1975-027: Construction of an underground golf cart facility. This permit was never implemented. 1975-059: Construction of a free-standing golf cart storage building. 2003-015: Construction of new maintenance building. In 2012, the Club applied to the Board to demolish the existing clubhouse and rebuild a new 21,089 square foot clubhouse. That application was withdrawn without prejudice. Proposal The Applicant is proposing to construct a new 15,905 sq.ft clubhouse in the same general location as the existing facility. The proposed clubhouse is a two story structure oriented to the golf course to the south. The east façade of the structure, adjacent to the parking lot is a full two stories. The topography rises to the west; on the western façade of the building, the upper-story is at grade. There is an 860 square foot wrap-around covered porch on the southwest corner of the building, but no outdoor patio areas are proposed. The clubhouse features a dining area, "grill room" and bar and pro shop on the upper level and locker rooms, office space, and miscellaneous storage space on the lower level. There are 176 restaurant and bar seats proposed. Site improvements include realignment of the 69-space paved parking area. Approximately 62 spaces will continue to be provided in the crushed stone parking area. The clubhouse will continue to be accessed from the existing drive on Marston Lane, in the northeast corner of the property. Other proposed site improvements include: • Extensive landscaping around the new clubhouse, the addition of trees to a.landscaped area within the crushed stone parking area, and new trees along Marston Lane adjacent to the parking area. • A 15 foot wide drive around the building provides both emergency access and facilitates golf course circulation. • Deliveries and dumpsters are accommodated at the north side of the building. • Mechanical equipment is proposed to be screened on the rooftop on the north side of the building, facing the railroad right-of-way; electrical equipment will be located in a screened area at the rear of the building, adjacent to the loading dock. • A new expanded, IA septic system and stormwater infrastructure are proposed. ;Other Approvals 2 J t Town of Barnstable Growth Management Department Staff Report Appeal 2014-019—Cummaquid Golf Club—Special Permit to Expand Use • A letter dated April 7, 2014 from the Cape Cod Commission confirms that this project does not trigger mandatory Development of Regional Impact thresholds because the proposed increase in gross floor area for the replacement building is less than 10,000 square feet. • On March 12, 2014, the Barnstable Committee of the Old Kings Highway Regional Historic District Commission approved a Certificate of Appropriateness for the proposed reconstruction. A Certificate of Demolition to allow the removal of the existing clubhouse was approved on October 24, 2012 and extended by the Committee on September 25, 2013. • The Site Plan Review Committee reviewed the proposal and issued a letter dated April 4, 2014 approving the project subject to conditions and issuance of a Special Permit by the Board. • Additional approvals from the Board of Health and Licensing Division will be required. 'Staff Comments • Number of parking spaces: The plans propose 131 parking spaces to serve the new facility. The Applicant should be able to demonstrate that the capacity of the clubhouse will not exceed the number of the parking spaces provided, given reasonable assumptions of carpooling. The Board may wish the Applicant to address the probability of concurrent use of the property for multiple purposes (e.g. members golfing, dining, meetings, employees, etc.) and if/how the space will be programmed to avoid capacity exceed availability of parking. • Expansion of Nonconforming Use: Section 240-94(B)(4) states that"at the discretion of the [Board], improvements may be required in order to reduce the impact on the neighborhood and surrounding properties including but not limited to the following: (a) greater conformance of signage [to the Sign Code]; (b) The addition of off-street parking and loading facilities; (c) Improved pedestrian safety, traffic circulation and reduction in the number and/or width of curb cuts; (d) Increase of open space or vegetated buffers and screening along adjoining lots and roadways...; (e) Accessory uses or structures to the principal nonconforming use may be required to be brought into substantial compliance with the present zoning. iRequiredYSpecial PeFrmittFindingsH`' For all Special Permits, the Board is required to make general findings pursuant to §240-125(C). Additional findings for Expansion of a preexisting nonconforming use are provided by§240-94(B). The Board should review the evidence presented by the Applicant, staff, and members of the public and, after weighing such evidence, is encouraged to articulate if and how the evidence contributes to each of the required findings. • The application falls within a category specifically excepted in the ordinance for a grant of a special permit: Section 240-94(B) allows for expansion of a lawfully established preexisting nonconforming use with a Special Permit from the Board. • The Site Plan Review Committee reviewed the proposal and issued a letter dated April 4, 2014 approving the project subject to conditions and issuance of a Special Permit by the Board. • After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 3 Town of Barnstable Growth Management Department Staff Report Appeal 2014-019—Cummaquid Golf Club—Special Permit to Expand Use • The proposed expansion and intensification will not be more detrimental to the neighborhood. • Any proposed expansion of the use shall conform to the established setbacks for the zoning district in which it is located, or such greater setbacks as the Zoning Board of Appeals may required due to the nature of the use and its impact on the neighborhood and surrounding properties: The proposed building is in compliance with all setback requirements of the RF-2 District. The clubhouse is proposed to be located 277 feet from Marstons Lane. • The proposed use and expansion is on the same lot as occupied by the nonconforming use on the date it became nonconforming. • The proposed new use is not expanded beyond the zoning district in existence on the date it became nonconforming. _Suggested Conditions ii ' . Should the Board choose to grant Special Permit Application No. 2014-019, it may wish to consider the following conditions: 1. Special Permit No. 2014-019 is granted to Cummaquid Golf Club of Yarmouth and Barnstable for expansion of the use of the property for a private golf course and members' clubhouse and customary accessory uses. This permit shall modify Special Permit No. 1972-16. 2. This permit shall authorize the demolition of the existing 11,238 sq.ft golf course clubhouse and reconstruction of a new 15,905 sq.ft clubhouse. 3. The new clubhouse and associated site improvements shall be completed in substantial conformance with the plans entitled "Cummaquid Golf Club— Proposed Club House", dated February 24, 2014, drawn and stamped by Baxter Nye Engineering and Surveying and elevations entitled "New Clubhouse for Cummaquid Golf Club" dated March 21, 2014, drawn by Cotuit Bay Design, LLC. 4. Landscaping shall be installed in substantial conformance with the plans entitled "Landscape Site Plan — Golf Clubhouse Area — Prepared for Cummaquid Golf Club", dated February 19, 2014, drawn by Barnstable Landscape Design. Landscape materials along g Marston Lane and within parking areas shall be maintained in healthy condition and the Applicant shall replace any dead or dying plant materials with healthy stock. 5. All outdoor lighting shall consist of full-cutoff fixtures and light shall be directed downward so as to not glare or shine onto adjacent properties. A photometric plan showing light levels zero at the property line shall be submitted for review and approval by the Growth Management Department prior to issuance of a building permit. 6. A fully executed long-term lease with Massachusetts Department of Transportation authorizing the improvements shown on the above-stated plans shall be recorded and a copy submitted to the Zoning Board of Appeals and Building Division offices prior to the issuance of any building permits for the property. 7. Vegetation shall be cleared as necessary so that adequate sight distances at the entrance to the site on Marstons Lane are maintained. 8. On-street parking on Marstons Lane is prohibited. 9. Use of facility shall be compliant with noise ordinance. 10.
