Mr. Wirtanen,
Thank you for your email. I agree that §133 uses the term "mechanical" in the preamble. I was careful to quote that
section of the ordinance in my response to Councilor Flores so that he could see the full statement of intent(please see
below). Please understand that I empathize with you and your desire to enjoy the peace and tranquility of your home
and property. However as I indicated previously the ordinance does not apply in this case as it is specific to music.
As an enforcement officer I have to assume that every action I take will be reviewed by a judge in court. Therefore, in
order to successfully enforce an ordinance that ordinance has to be read in context and any enforcement of it has to be
applied according to the intent of the ordinance. In this case, the ordinance was designed to prevent loud parties and
music. The mechanical devices mentioned are amplification and acoustic devices(percussion). I would love to help you
but for me to apply that ordinance for the purposes of silencing the fans at the substations would be an overreach not to
mention that I would be operating outside of my authority.
It can be difficult to contact someone at Eversource but when you do they are pretty decent to deal with and are
concerned with customer service... I would recommend trying to get a supervisor in customer relations on the telephone
to come out and have a listen.
I am sorry that I cannot be of more assistance to you. Please feel free to call me if you wish to discuss this further.

Good afternoon, Brian.
My copy of Chapter 133 states that it is unlawful for persons having charge of any structure, premises etc. to
allow any unnecessary loud noises in the operation of a mechanical sound making device (cooling fans). The
noise from them is plainly audible at a distance far greater than 150 feet- more like 400-500 and with the
windows shut. It is certainly not music but it is loud. I was hoping it was in your jurisdiction and that query
from you might lead to a permanent solution- of which there are many.
Thanks for your response, Allan Wirtanen

Good Morning Councilor Flores,
Thank you for including me in your response. Mr. Wirtanen has identified Town ordinance §133 — 1, as
a zoning ordinance and suggests that the offending noise is a zoning violation. Please be advised
that §133 is a general ordinance not the zoning ordinance which can be found at §240.
§133 is specific to loud music and not the type of noise that is outlined in Mr. Wirtanen's email. The
ordinance reads:
It shall be unlawful... to allow any unnecessary, loud, excessive or unusual noises in the
operation of any radio, phonograph or other mechanical or electronic sound making device or
instrument, or reproducing device or instrument, or in the playing of any band, orchestra,
musician or group of musicians, or in the use of any device to amplify the aforesaid, or the
making of loud outcries, exclamations or other loud or boisterous noises or loud and boisterous
singing by any person or group of persons or in the use of any device to ampl the aforesaid
noise, where the noise is plainly audible at a distance of 150 feet
There is no zoning violation nor prohibition in the Town's ordinance with respect to the substations
cooling fans.
I hope that this information has been helpful, please feel free to contact me if you have any questions.

Good Morning, John
I am sending this on behalf of myself and neighbors
re the noise generated by the substation cooling
fans. They were turned on this Sunday for the first
time this year in response to the hot weather and the
welfare of the Eversource equipment. In past years
they were not turned on at all or shut off when we
complained. This year We have gotten no response
at all from Eversource. Ten years ago I filed a
complaint with our building commissioner re the
zoning violation-chapter 133-1 as the noise is
plainly audible at a distance far greater than the 150
feet allowed. I got no response. They are also in
violation of state regulations. Solutions are many to
this problem as it is easy to research what other
utilities have done to rectify the issue, but thus far
3
Eversource has refused to address the complaint. I
am hoping you have some contact with them (Ann
Canedy did have one) or maybe some way our town
noise regulations can be inforced.
Thanks for everything you do, Allan Wirtanen
