I agree that §133 uses the term "mechanical" in the preamble. I was careful to quote that section of the ordinance in my response to Councilor Flores so that he could see the full statement of intent(please see below). Please understand that I empathize with you and your desire to enjoy the peace and tranquility of your home and property. However as I indicated previously the ordinance does not apply in this case as it is specific to music. As an enforcement officer I have to assume that every action I take will be reviewed by a judge in court. Therefore, in order to successfully enforce an ordinance that ordinance has to be read in context and any enforcement of it has to be applied according to the intent of the ordinance. In this case,the ordinance was designed to prevent loud parties and music. The mechanical devices mentioned are amplification and acoustic devices(percussion). I would love to help you but for me to apply that ordinance for the purposes of silencing the fans at the substations would be an overreach not to mention that I would be operating outside of my authority. It can be difficult to contact someone at Eversource but when you do they are pretty decent to deal with and are concerned with customer service... I would recommend trying to get a supervisor in customer relations on the telephone to come out and have a listen. I am sorry that I cannot be of more assistance to you. My copy of Chapter 133 states that it is unlawful for persons having charge of any structure, premises etc. to allow any unnecessary loud noises in the operation of a mechanical sound making device (cooling fans). The noise from them is plainly audible at a distance far greater than 150 feet- more like 400-500 and with the windows shut. It is certainly not music but it is loud. I was hoping it was in your jurisdiction and that query from you might lead to a permanent solution- of which there are many. Solutions are many to this problem as it is easy to research what other utilities have done to rectify the issue, but thus far 3 Eversource has refused to address the complaint. I am hoping you have some contact with them (Ann Canedy did have one) or maybe some way our town noise regulations can be inforced.
