Dear Sir:
I live at 193 Dromoland Lane in Barnstable. Dromoland Lane is in a subdivision
called "Cummaquid Acres", identified by that name on a plan recorded in the Registry of
Deeds in Barnstable.
In recent weeks representatives of the Cummaquid Heights Association, Inc., have

installed at the corner of Dromoland Lane and Mary Dunn Road a sign which bears the
name, "Cummaquid Heights".
After determining who had installed the sign I expressed objections to the sign in a
letter dated September 21, 2009, to the Association and some of its officers. A copy of
the same letter was sent to you.
On September 29, 2009, my wife and I met with Mr. Berlandi, the President of the
Association, and three members of the "Executive Committee"of the Association at Mr.
Berlandi's office in Barnstable Village to discuss my letter. The meeting was amicable but
unproductive. At the end of the meeting Mr. Berlandi said that he would respond to my
concerns within a week (which would have been by October 6). However, I have not
heard from him.
I have been told that the Association also has failed to respond to various requests
from your office regarding the same sign.
I believe that the sign is in violation of the provisions of section 240-63 of the sign
by-laws of the Town. At.the meeting of September 29 when I pointed out that the sign .
was not at a public entrance to the Cummaquid Heights subdivision (see enclosed picture
of the"back entrance"to the subdivision, located on Oakmont Road about a mile away from
the sign in question, showing a prior sign w# )d "Entering Cummaquid Heights",

identify the Cummaquid Heights subdivision (shown in the enclosed copy of a plan filed in
the Registry of Deeds), but instead is meant to identify a"community"or"general area".
As you know, such a sign is not permitted under section 240-63.
Accordingly I now respectfully request that if you agree with my reading of the sign
by-laws of the Town and particularly the provisions of section 240-63, you enforce the
provisions of that section, pursuant to section 240-89, by taking such steps as you may
deem appropriate to cause the removal of the sign.

• The Traffic and Roads Committee does periodic surveys of our roads and meets on an ongoing basis
with the Town Engineer of Barnstable, in which most of our roads are located.
• The Welcome Committee greets new residents with a welcome basket and a copy of our directory of
residents.
• The Membership Committee keeps track of who moves in where, and prepares the annual directory.

The purpose of this letter is to fulfill my promise to you at our September 29, 2009
meeting that I would report back to you on the issue you raised about the sign at 1308
Mary Dunn Road.
In this regard, we have revisited the site of the sign and have met with the Zoning
Enforcement Officer of the Town to obtain a clear understanding of what is required by
the Town for the erection of that sign.
Our understanding is that if the facing of the sign itself is located 10' back from the
edging of the pavement of the road then it is not within the town easement but within the
abutting property owners land. We believe that the sign is outside of the 10' easement
area and , therefore, falls within the abutter's property at 1308 Mary Dunn Road. In that
case, written approval from the abutting property owner is required. We in fact have
obtained that approval from a Mr. Jansson, Trustee of the Chauncey Street Realty Trust,
the owner of the property.
We will be filing an application for a sign permit with he Building Department with
the understanding that we have complied with the requirements of the Building
Department forthwith.

to ,the specific requirements, performances, and capacities required by this
agreement, and shall be free from imperfect quality of work. Contractor shall
repair at his own cost and expense for a period of five (5) years from date of
acceptance of the work by owner, all of the work under and pursuant to this
agreement and change orders that may prove defective. Contractor shall repair
at his own cost any work that may be disturbed in making good such defects.
Contractor understands and agrees that he is not an employee of owner and j
agrees that he shall not assert any claims alleging so. The contractor agrees
that during the existence of this contract he shall be deemed to be an
independent contractor, and as such responsible for his own injuries or property
damage occurring on the job site as well as conformance-to all applicable safety
rules and regulations including but not limited to OSHA regulations.
During and at the conclusion of the work to be performed hereunder, contractor
shall be responsible for clean up at the site of all trash and debris resulting from
the work to be performed. Owner.shall reimburse contractor his dump fees upon
satisfactory proof of same from contractor which amount shall not exceed Six
Hundred ($600.00) Dollars, and shall be based solely upon dump fees charged
for owners construction debris, it being understood that such fees are fixed by
the landfill facility based upon weight only.
Unless otherwise noted within this document,. the contractor shall not
imply that any lien or other security interest has been placed on the
residence.
