Dear Mr. Daluz:
Please be advised that this office has undertaken a search of the record title to
LOT 3, Maushop Avenue, Barnstable, Massachusetts, said lot being shown on a plan
of land dated April, 1973 and recorded in Plan Book 290, Page 32.
My examination of title reveals that as of January 1, 1985 LOT 3 was held in
ownership separate from any other adjoining or abutting lots and therefore, LOT 3
qualifies for protection as a single building lot under the zoning by-laws for the
Town of Barnstable.

Dear Mr. Daluz :
This office represents Mr. James K. Smith, Trustee of
J.K.S. Trust. I am writing to you regarding the issuance of
an occupancy permit for a single family residence which has
been constructed on LOT 3, Maushop Avenue, Barnstable. I
have completed an examination of the records at the
Barnstable County Registry of Deeds and of the applicable
Barnstable Zoning By-Law. It is my opinion, that LOT 3
qualifies as a buildable lot, under the Zoning By-Law for
the Town of Barnstable .
LOT 3 which contains 21 ,495 square feet of land, was
created by an approved subdivision plan endorsed by the Town
of Barnstable Planning Board on December 26, 1973. Title at
that time was held by Allyn Jones-Smith, as Trustee of the
Samuel Jones Realty Trust. At that time, the zoning in the
area permitted 20,000 square feet. On June 11 , 1976, LOT 3
was conveyed to Winona E. Hubrecht, her deed is recorded at
the Barnstable County Registry of Deeds at Book 2352, Page
349. The abutting LOT 4 was conveyed to W. J. Middleton, on
June 21 , 1976 in Book 2357, Page 154 . The other abutting
lot, LOT 2, was conveyed on July 14 , 1976 to Thomas W.
Leonard, et ux. His deed is recorded in Book 2369, Page 61 .
The zoning in the area was changed from .20,000 square feet
to one ( 1 ) acre in 1977. Therefore, at the time of the
zoning change, LOT 3 was held as a single residential lot in
ownership separate from any other adjoining or abutting lot.
The Town of Barnstable Zoning By-Law Paragraph 'G ' ,
Subsection 'E ' provides that a lot lawfully laid out on a

complies with the minimum area, frontage, width and depth

requirements of the Town of Barnstable Zoning By-Law, may
thereafter be built upon for residential use, even if the
Zoning By-Law has been amended to greater area
requirements, if the lot was held in ownership separate from
that of adjoining land located in the same residential
district at the time of the zoning amendment. As this is
the case for LOT 3, it is my opinion, that said lot complies
with the Town of Barnstable Zoning By-Law for the issuance
of an occupancy permit.
