Many homeowners who use this exe ption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construct• n Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible. �+
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,

The property in Appeal 2002-03 is a 0.29-acre parcel developed with a 1 & 3/ story, 3-bedroom single-
family dwelling of 1,642 square feet of living area with an attached garage of 484 sq.ft. The structure was
built in 1985 and is connected to town sewer and public water. The existing structure has the benefit of
Variance 1985-19, issued to George &Helen Long for front yard setbacks, and setbacks from wetlands.
That variance was issued to two lots, one of which is the subject of this appeal.
The applicant is seeking to expand the existing dwelling by adding a new attached garage structure and
redevelop the existing garage into living area. The plans include expansion of the second floor area over
the existing and proposed garage. The second floor also overhangs the first floor by 5 feet along the rear
of the building.
According to the survey plan presented,the existing structure has a front yard setback of 10.9 feet at its
closest point. The proposed addition is setback 11.0 feet from the front property line. The district
requires a front yard setback of 20 feet. The backside of the second floor of the proposed addition is to be
located 15 feet from the edge of wetlands where 35 feet is required.
The applicant Linda Miller has applied for a Variance to Section 3.1.1(5) Bulk Regulation,Minimum
Front Yard Setback and Section 2.3.7 Setbacks from Wetlands,to allow the addition
The proposal was presented to the Old Kings Highway Historic District Committee on December 12,
2001. At the Committee's hearing the proposal was denied citing that "the size of the proposed addition
was inappropriate to the lot." The commission noted that the "mass of the house after the addition
would be too great related to the size of the lot with the uninterrupted frontage of the house posing a
special problem."

letter from the applicant's representative,Attorney Bruce P. Gilmore. The letter requested that the
appeal be withdrawn without prejudice.

Committee has denied your above-referenced application by a majority vote... According
to the District's Bulletin, we are responsible to put the specific reasons for a denial in
writing.
During the discussion a majority of the Committee Members felt that the size of the
proposed addition was inappropriate to the lot. The mass of the house after the addition
would be too great relative to the size of the lot with the uninterrupted frontage of the
house posing an especial problem. A motion was made and seconded to approve.the

Background& Review:
The property before the Board in Appeal 2002-03 is a 0.29-acre parcel developed with a 1 &3/4 story, 3-bedroom
single-family dwelling of 1,642 sq.ft. living area. The structure has an attached garage of 484 sq.ft. The structure
was built in 1985. The dwelling is connected to town sewer and public water.
The development of the lot has the benefit of an earlier 1985 variance. In Variance 1985-19,issued to George&
Helen Long, the board granted a variance to the front yard setback and setback from wetlands for two lots'.
One of those lots is the subject of today's appeal.
The applicant is seeking to expand the existing dwelling by adding a new attached garage structure and redevelop
the existing garage into living area. The plans include expansion of the second floor area over the exiting and
proposed garage. The second floor also overhangs the first floor by 5 feet along the rear of the building.
According to the survey plan presented,the existing structure has a front yard setback of 10.9 feet at its closest
point. The proposed addition is setback of 11.0 feet from the front property line. The district requires a front
yard setback of 20 feet.
The back second floor of the proposed addition is to be located 15 feet from the edge of wetlands where 35 feet
is required.
1 Note: In 1985,the RB district required a minimum lot area of 10,000 esq.the appear to have meet that minimum requirement and
the variance granted was for front yard setbacks only.

The applicant and Board should recognize that any vehicle parked within the driveway will be located partly
within the public right-of-way of Meridian Way.
Variance Findings:
In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify
the granting of the relief being sought. In granting of the Variance the Board must find that:
• unique conditions exist that affect the locus but not the zoning district in which it is located,
• a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship,
financial or otherwise to the petitioner,and
• the relief may be granted without substantial detriment to the public good and without nullifying or
substantially derogating from the intent or purpose of the Zoning Ordinance.
Suggested Conditions:
If the Board should find to grant a variance it may wish to consider the following.
The variance is granted to the front yard setback and setback to wetlands. To permit the dwelling to be
located as per plan submitted entitled Site Plan of 70 Meridian Way in the Town of Barnstable (Village)
prepared for Linda Miller". Dated September 07,2001 and drawn by Down Cape Engineering,Inc. and in
accordance with the following conditions:
1. Development shall comply with all requirements of the Conservation Commission Order of
Conditions,all requirements of the Old Kings Highway Historic District Commission and all
applicable building and health regulations.
2. Development on this parcel shall be considered full development.of the lot. No future addition to
the dwelling shall be permitted without permission for this Board.
