Hooker, both of 141 Taylor Street, Granby, MA 01033 Dear Mr. Daluz: Please be advised that I represent Mr. and Mrs. Hooker in connection with their application for a building permit on Lot 106. It seems that their representative was informed that it was necessary to obtain a release of the Planning Board covenant. Midpine Road was taken by the Town of Barnstable on June 2, 1982 and is a public way. Since it has been accepted as a public way by the Town, it is clear that the construction and installation of municipal services on Midpine Road were done in accordance with the rules and regulations of the Planning Board. Since Midpine Road is a public way, it is my opinion that Massachusetts General Laws Chapter 41 , Section 81 U gives authority to the building inspector of a town to issue a building permit on a lot with adequate frontage on a public way without the requirement of a release of the Planning Board covenant. I have been informed that the foundation has been installed but all work will cease, if no building permit is forthcoming. I expect to have the Certified Plot Plan next week.
