Respectfully, alph�Crossen Building Commissioner f f DECISION 1986 - Noori Hakim Attorney Bruce Gilmore appeared before the Board on behalf of the petitioner and requested the Board to amend its decision granting a variance to the petitioner following a public hearing on September 4, 1986, which allowed him two buildable lots at Map 356, Parcels 9, 10,. 11 Midpine Road, Cummaquid in an RF-2 zoning district. Attorney Gilmore requested the amendment to clarify and correct the square foot area of the two new lots from 39,436 to 37,437 and 37,438 and to amend the 10% below required area in this zoning district to 15% below square footage required. The reason for the amendment is to correct an error in transposition made by the engineer in preparing the plan presented to the Board when it was filed. On September 4, ......___. y19 86 , The Board of Appeals round Attorney Bruce Gilmore represented the petitioner, Noori Hakim, who is requesting relief from density regulations for the property located at Map 356, Lots 9, 10 and 11, Midpine Road. Cummaquid in an RF-2 zoning district. The petitioner pur- chased the lots about 14 years ago, and residing in New .Jersey he only recently learned that he now had only one buildable lot. The petitioner desires to vary Section: J, Appendix A of the Zoning By-law to create two buildable lots each containing in excess of 39,400 square feet. The lots merged would contain about 79,000 square feet and be the largest in the entire subdivision; however, if the variance is granted for two lots, they would be about 10% less than the required acre, and the impact would be deminimous. Most of the lots in the area contain .55 to .7 of an acre and were built upon during the early 1970s. These lots run by the tenth green and eleventh tee of the golf course and are heavily treed. Mr. Baily who lives across from the parcel spoke in opposition to the petition saying that he is opposed to dividing the parcel. Elizabeth Horton made the following findings: that it would be a financial hardship based on the size of the lots in the surrounding area - these are environmentally sound lots. By granting a variance we are allowing the petitioner to create two lots that are larger or equal to what exists in the neighborhood - only 10% less than the requirements, also, the topography and location of the lots bordering the rear of the golf course makes this unique, as the petitioner is unable to purchase additional land area creating further hardship. The motion was seconded by Ronald Jansson. The Board voted unanimously to grant the variance to allow the creation of two lots based on the findings indicated above. Cummaquid in an RF-2 zoning district. The petitioner par-s; chased the lots .about 14 years ago, and residing in New Jersey he only recently . i _ learned that he now had only one buildable lot. The petitioner desires to vary Section J, Appendix A of the Zoning By-law to create two buildable lots each � = containing in excess of 39,400 square feet. The lots merged would contain about f 79,000 square feet and be the largest in the entire subdivision; however, if the variance is granted for two lots, they would be about 10% less than the. required acre, and the impact would be deminimous. Most of the lots in the area contain ti .55 to .7 of an acre and were built upon during the early 1970s. These lots run by the tenth green and eleventh tee of the golf course and are heavily treed. Mr. Baily who lives across from the parcel spoke in opposition to the petition saying that he is opposed to dividing the parcel.. 1 Elizabeth Horton made the following findings: that it would be a financial t' hardship based on the size of the lots in the surrounding area - these area �{ environmentally sound lots. By granting a variance we are allowing the petitioner s to create two lots that are larger or equal to what exists in the neighborhood - �� only 10% less than the requirements, also, the topography and location of the lots II bordering the rear of the golf course makes this unique; as the petitioner is unable to purchase additional land area creating further hardship.
