Cummaquid in an RF-2 zoning district. The petitioner pur- chased the lots about 14 years ago, and residing in New Jersey he only recently learned that he now had only one buildable lot. The petitioner desires to vary Section J, Appendix A of the Zoning By-law to create two buildable lots each containing in excess of 39,400 square feet. The lots merged would contain about 79,000 square feet and be the largest in the entire subdivision; however, if the variance is granted for two lots, they would be about 10% less than the required acre, and the impact would be deminimous. Most of the lots in the area contain .55 to .7 of an acre and were built upon during the early 1970s. These lots run by the tenth green and eleventh tee of the golf course and are heavily treed. - Mr. Bally who lives across from the parcel spoke in opposition to the petition saying that he is opposed to dividing the parcel. Elizabeth Horton made the following findings: that it would be a financial hardship based on the size of the lots in the surrounding area - these are environmentally sound lots. By granting a variance we are allowing the petitioner to create two lots that are larger or equal to what exists in the neighborhood - only 10% less than the requirements, also, the topography and location of the lots bordering the rear of the golf course makes this unique, as the petitioner is unable to purchase additional land area creating further hardship.
