The Executive Committee agreed that in view of the Asso- ciation ' s lack of legal "clout" and funds for legal ser- vices, the problem is not the Association ' s, but that of those who are offended and aggrieved with one another -- and should be resolved as such by filing -- in the final solution--an individual protest with proof of a Town law/ ordinance violation. Dear Friends and Neighbors, As some of us begin to contemplate and others even to prepare for the coming Holiday Season with its message of joy and love, your Executive Committee and I want to report to you the Association's activities since our last annual meeting. 1. We are in the process of updating lists of residents and property owners by street, (locally and absentee), and by name. It is sometimes difficult to identify and locate absentee owners. Our secretary, Edie Greene, has a complicated and difficult task in achieving this goal. If you know of a neighbor's new address or name, please assist by contacting Edie or Clive. 2. The joy and beauty of the entrance landscaping continues to be a visual pleasure as the seasons change. Gloria (our landscape chairperson) and Mike Di Stefano have designed, planted and diligently maintained the area. 3. The Association's ongoing concern for equitable assessment of property values for tax purposes in Barnstable was individually championed by Mr. & Mrs. Harry Ferullo, Mr. & Mrs. Michael Di Stefano and Mr. & Mrs. Joseph Kotomski before the Appellate Tax Board of the Commonwealth... and they won! They received a fair adjustment in their property evaluation and a refund of their over-paid taxes at 8% interest. Congratulations! 4. Treasurer "Trish" Jochnowitz reports that the return of the first mailing of annual dues notices has resulted in an increase in the number responding. Trish, in her usual thoroughness, has sent a second mailing to those still in.arrears. Good work, Trish! 5. The Executive Committee sincerely and firmly asks all members of the Cummaquid Heights Association, as well as non-member residents and property owners, to voluntarily -- in the interest of being good neighbors -- abide by the GUIDELINES of the Association, particularly the guidelines which also have a Town regulation (legal) with fine/punishment following violation of the respective regulation/guideline. Your attention is called to the following Association Guidelines with Town legal requirements: Guideline #4. Business Activity/Advertising Signs. "Cummaquid Heights is zoned'residential' and as such, business activity is • prohibited. Accordingly, signs are strictly limited; however, professional people may display a small name plate." Guideline #5. Animals. "Barnstable and Yarmouth each have leash laws, Barnstable also has a "Pooper-Scooper" law. Accordingly, domesticated animals and house pets should be sufficiently restrained so as not to be offensive in the neighborhood or become a nusiance to your neighbor. Guideline #6. Fences. "Any and all fencing must be acceptable to and approved by the Old King's Highway Historical Commission." All seven of the Associations guidelines have been disobeyed or ignored in the past and some still are, including the three above. Guidlines #4, #5, #6 contain prohibitory implications which, with failure to comply -- either through protest, formal complaint, just observation -- may constitute a violation of Town law. The Town must have proof of any violation which may result in a warning, fine and/or court determined action. Afterall, we are trying to live in community and harmony within a pleasant, attractive and quiet area of residence not an efficient, utilitarian and raucous area of commerce. We want to preserve the economic value of our property and homes through effective landscaping, care, upkeep and home maintainence as a mutually agreed upon goal for our benefit and quality of life. We respect one another's property, the contents thereon -- natural, architectural, artistic and organic. Our animals, if any, should be properly trained, restricted and controlled according to law for reciprocal understanding and tolerance. 6. Mrs. Robert Sprague (Betty) has formally submitted her resignation as a Director of the Association. The Executive Committee regretfullly accepts Betty's resignation and wish her well as she devotes her time to personal and family matters. 7. Mary Jane Holmes, Vice President, has visited and delivered to the following new residents, our Constitution, By Laws, Guidelines and a bottle of wine as a welcoming gesture from the Association: Paulette and Tom Moran Barbara and Paul Rand 208 CC Drive 112 Augusta National George and Alice Blackburn Dori and Guy Muto 50 CC Drive 121 Hampstead t Beryl and Felice Friese 2 Congressional ACTION ITEMS: Article II of the Constitution of the Cummaquid Heights Association, Inc. states that the purpose of the corporation "...shall be to act as instrument of public welfare for the advancement of the social and cultural amenities, the economic and civic stability, and the public health and safety of the Cummaquid Heights community situated in the towns of Barnstable and Yarmouth in the county of Barnstable, MA., through discussion and study of community problems and recommendation to appropriate Town, County and State or Federal agencies.", The language, however formal, stilted or legaleese, means that as an association and as individuals we should be and are interested in what is going on in our towns, county,state and federal governments, and the ballot box is one sure way of expressing our will and our choices. To this end and purpose, your Executive Committee urges you to seriously study the issues (particularly the economic ones) and the candidates, and then make up your mind and choose the side of the issue and the candidate you favor. VOTE on Tuesday, November 2, 1993! Cummaquid Heights residents who are citizens of the Town of Barnstable have two very important issues to decide and settle through a voting procedure: 1. The first is the public meeting of the Town of Barnstable Board of Health in the council chambers, Town Hall,-Hyannis on October 28, 1993 at 5:00pm to pass or defeat the Board's mandate to order the Town's three public. water districts and one private water company to add fluoride to their respective water supplies. The current standard of 4 milligrams of fluoride per liter of drinking water is "...appropriate as an interim standard..." but should be reviewed when results of new research are available. Aside from the arguable health benefits or deterants applicable to everyone-from children to 4 • senior citizens, the installation costs for equipment for at least 32 wells is extremely expensive. Some estimates (at this time) are well over $2,000,000, while yearly operating and maintenance costs could exceed $800,000. You decide and let your voice be heard at the meeting on October 28th. 2. The second is the vote on election day, Tuesday November 2, 1993, on the 2hdebt exclusion borrowing of $3,594,909, plus prior appropriation of $145,000 for a total $3,739,909 to finance a Barnstable Senior Citizen Center of two levels with a total,of 27,000 square feet. It is anticipated that any unfinished lower level areas wil be financed , through grants, fund-raisers and gifts. The Town has approved the site -- West Barnstable between the YMCA and the Cape Cod Conservatory -- and has furnished Town owned land at no cost. The proposed agenda and activities of the Center are well- known. With a 20 year bond at 6%, a home as ea at$100,000 will pay $8.79/year increase in tax for 19 years and $4.20 in the 20th year. You can work the arithmatic for the assessed evaluation of your Cummaquid Heights property for one year or 20 years of additional taxes. Several homes with higher evaluations will pay much more. Is the new Senior Citizen Center worth that much to you? Will you use it? Do the proposed benefits to a few outweigh the costs to all? You be the decision-maker. VOTE on November 2, 1993! One final comment. Some of you, perhaps quite a few of you-have negative feelings about the effectiveness of the Association. What do we get for our dues? Our dues pay for things and services. You get the light that brightens your way into the silence of the Heights at night. You experience the landscaped beauty and the messages of residents who "care where you live" upon entering the Heights. You get formal and responsible communication concerning you and your neighbors' well-being in our community. Believe me! I have been an active committee person on Cummaquid Heights Association's board (a residents' association), being Secretary for two years,President for one year and treasurer for five years, a position I currently hold. The objective of the association is the beautification and preservation of an excellent residential area within the Town of Barnstable. I say this just to assure you that I am dedicated to keeping this a nice residential area and not a business area. My husband and I have resided in our home for the past thirteen years and throughout that time we have been watched closely and minutely by our neighbor to our right. This neighbor,retired since 1975, has spent most of this time harrassing us and other neighbors with young children.
