Page..- „_ Page „ of • On ____.._ _ July 31, -_._..._ 1J 86 The Board of Appeals found Mr. Kerr presented his petition for a Special Permit to alter an existing non- conforming building at 35 Mill Way, Barnstable in an RF-1 and RF-2 zoning district The petitioner desires to replace three garage doors with six -windows. The building currently contains four apartments, two above and two down. The petitioi has received permission from the Historic Commission to make these renovations. The Building Inspector has determined that this is an,expansion of a non-conformii use. The locus contains 1.7 acres and the structure contains 22 rooms with adeqw parking. There is no intent on the part of the petitioner to use the premises fol a lodging house, and this renovation does not extend the size of the units or the rentable rooms, etc., therefore, it does not present a substantial detriment to the area involved. Dexter Bliss made a motion toil ant the petitioner the relief sought, to remove three garage doors to replace/winnows to create additional livir. space, on the condition that he not create more than what is existing - four apart ments, and to be no rentable rooms created in the renovation - Luke Lally seconded the motion. The Board voted unanimously to grant the Special Permit; the Board found that to allow the relief requested would not substantially impact the area involved.
