The NFIP regulatory floodway is the area that must remain unobstructed in order to prevent unacceptable increases in base flood elevations. Therefore, no construction may take place in an NFIP regulatory floodway that may cause an increase in the base flood elevation. While the elevations submitted with this request show the subject property is currently above the Base Flood Elevation (BFE),the property may"subside"with the passage of time to the extent that property elevations would be below the BFE and flood insurance may be required. GREAT LAKES-The Federal Emergency Management Agency (FEMA) has based this determination on elevation data,which is published in the current Flood Insurance Study for the community. However, the elevations established in the U.S.Army Corps of Engineers(USACE) reports on the Great Lakes are the best available data known to us. If in the future there are any subsequent map revisions to the national Flood Insurance Program map and the USACE reports remain the best available data known, FEMA will use those elevations for any such revisions. Further, be advised that the elevations on the Flood Insurance Rate Map (FIRM) may only reflect the Stillwater elevation for the lake and may not account for the effects of wind driven waves or wave run-up. On-site conditions such as wind speed,wind direction, fetch distance, water depth and the slope of the beach or bluff may result in significant increases to the base flood elevation. Therefore, it is strongly recommended that the requestor be aware of these circumstances and, if warranted, evaluate the effects of wind driven waves along the shoreline of the property. Requesters should be aware that flood conditions may change or new information may be generated that would supersede FEMA's determination. In such cases,the community will be informed by letter. Requesters also shoula be aware that removal of a property (parcel of land or structure) from the Special Flood Hazard Area (SFHA) means FEMA has determined the property is not subject to inundation by the flood having a 1-percent chance of being equaled or exceeded in any given year (base flood). This does not mean the property is not subject to other flood hazards. The property could be inundated by a flood with a magnitude greater than the base flood or by localized flooding not shown on the effective National Flood Insurance Program(NFIP)map. The effect of a LOMA is it removes the Federal requirement for the lender to require flood insurance coverage for the property described. The LOMA is not a waiver of the condition that the property owner maintain flood insurance coverage for the property. Only the lender can waive the flood insurance purchase requirement because the lender imposed the requirement. The property owner must request and receive a written waiver from the lender before canceling the policy. The lender may determine, on its own as a business decision that it wishes to continue the flood insurance requirement to protect its financial risk on the loan. The LOMA provides FEMA's comment on the mandatory flood insurance requirements of the NFIP as they apply to a particular property. A LOMA is not a building permit, nor should it be construed as such. Any development, new construction, or substantial improvement of a property impacted by a LOMA must comply with all applicable State and local criteria and other Federal criteria. If a lender releases a property owner from the flood insurance requirement, and the property owner decides to cancel the policy and seek a refund, the NFIP will refund the premium paid for the current policy year, provided that no claim is pending or has been paid on the policy during the current policy year. The property owner must provide a written waiver of the insurance requirement from the lender to the property insurance agent or company servicing his or her policy. The agent or company will then process the refund request. • Even though structures are not located in an SFHA, as mentioned above, they could be flooded by a flooding event with a greater magnitude than the base flood. In fact, more than 25 percent of all claims paid by the NFIP are for policies for structures located outside the SFHA in Zones B, C, X (shaded), or X (unshaded). More than one-fourth of all policies purchased under the NFIP protect structures located in these zones. The risk to structures located outside SFHAs is just not as great as the risk to structures located in SFHAs. Finally, approximately 90 percent of all federally declared disasters are caused by flooding, and homeowners insurance does not provide financial protection from this flooding. Therefore,FEMA encourages the widest possible coverage under the NFIP. The NFIP offers two types of flood insurance policies to property owners: the low-cost Preferred Risk Policy (PRP) and the Standard Flood Insurance Policy (SFIP). The PRP is available for 1- to 4-family residential structures located outside the SFHA with little or no loss history. The PRP is available for townhouse/rowhouse-type structures, but is not available for other types of condominium units. The SFIP is available for all other structures. Additional information on the PRP and how a property owner can quality for this type of policy may be obtained by calling the Flood Insurance Information Hotline, toll free, at 1-800-427-4661. Before making a final decision about flood insurance coverage, FEMA strongly encourages property owners to discuss their individual flood risk situations and insurance needs with an insurance agent or company. FEMA has established "Grandfather" rules to benefit flood insurance policyholders who have maintained continuous coverage. Property owners may wish to note also that, if they live outside but on the fringe of the SFHA shown on an effective NFIP map and the map is revised to expand the SFHA to include their structure(s), their flood insurance policy rates will not increase as long as the coverage for the affected structure(s) has been continuous. Property owners would continue to receive the lower insurance policy rates. LOMAs are based on minimum criteria established by the NFIP. State, county, and community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction in the SFHA. If a State, county, or community has adopted more restrictive and comprehensive floodplain management criteria, these criteria take precedence over the minimum Federal criteria. In accordance with regulations adopted by the community when it made application to join the NFIP, letters issued to amend an NFIP map must be attached to the community's official record copy of the map. That map is available for public inspection at the community's official map repository. Therefore,FEMA sends copies of all such letters to the affected community's official map repository. When a restudy is undertaken, or when a sufficient number of revisions or amendments occur on particular map panels, FEMA initiates the printing and distribution process for the affected panels. FEMA notifies community officials in writing when affected map panels are being physically revised and distributed. In such cases, FEMA attempts to reflect the results of the LOMA on the new map panel. If the results of particular LOMAs cannot be reflected on the new map panel because of scale limitations, FEMA notifies the community in writing and revalidates the LOMAs in that letter. Basil Edwards said that the zoning by-laws should be upheld.James Klttredge,a cottage owner at Sandy Neck,said that this Is nothing more than an excursion boat with loud speakers In operation as the boat leaves the harbor,and Is detrimental to the area. Mr.Kullberg should have been advised that this was not an allowed use and In violation of zoning.A letter was sent to the Selectmen and not answered for seven weeks on the whale watching operation which accounts for the delay In filing for enforcement action. Mr.Kullberg said that his attorney Is Gerry Garnlck and he felt that they had gone to all of the proper authorities for permission to operate the boat and they had been In operation long enough for someone to take enforcement action and he Is willing to make this use educational only. Jane Davis—Gavin presented her petition before the Board and explained that she Is the owner of property on the south side of South Street and one of her tenants feel asleep while smoking and this resulted In a fire on the second floor of their dwelling.The entire second story of their house was destroyed and they are now settling with the Insurance company and will rebuild the second story.There were six rooms on the second floor and this property has had long use as a lodging house. They would now like to reconstruct the second floor and change the rental room use to two apartments so that they would have year—round,responsible tenants.The plan showing the two upstairs apartments was explained to the Board.One of the apartments would have two bedrooms and the second apartment would be a one-bedroom efficiency apartment.They have a unique time to change this use since the upstairs must be rebuilt and the change from lodging rooms to apartment use would enhance the neighborhood and there would be less use of the property with less people,less noise etc.The only change would be adding a kitchen and a bathroom and there were plug In type appliances with the lodging house use.The petitioners are year-round residents and live on the first floor of the building.They are asking for permission to upgrade the building which will be an asset to the neighborhood.No one spoke In favor of or In objection to the petition and the Board took the matter under advisement. I have requested and received.several documents from Mr.Richard Kullberg,President .of the Whale Watching B^t operation.In Mr.Kullberg's letter he states that he.had discussed details of his operation with the residents of the Bamstable .Harbor area,the United States Coast Guard,.the Bamstable Selectmen,the Harbor Master ^d the then President of the Bam- stable Civic Association,Ms.Faith Cumnings. It is interesting to note the types of involvement in whale watching. The educational considerations have attracted people like Bapry E.Brocks, Marine Biologist;Susan Ereicson,a Bamstable High School Biology teacher \dio gives lectures with her film documentary on whales to public,.private and church organizations.The Bamstable High School Science Department has funded the making of the film.The list of organizations who annually participate in the vdiale watching tours include: American Cetacean Society,Audubon Society,Boston >kiseum of Science,.Boy Scouts and Girl Scouts of America,Cape Cod Museum of.Natural History,Harvard Museum of Ccmp.Zoology, Ifystic Aquarium,New Bedford Whaling Museum,Woods Hole. Oceanographic and many colleges,public/private schools. The question is,of course,does it conform to zoning.There is no question that the wl^le watching tours are educational^There are only four (4)areas in ^ich whales migrate and are accessible:Alaska,Hawaii, Califomia and Cape Cod Bay. The educational opportunities surrounding a whale watch are unlimited for both the general public and the Town of Barnstable.My intentions surrounding my job include: a.The implementation of a program where student interns from the high school would serve as research assistants helping record data,photo graph,videotape,document location and record sounds of the humpback whales.The Science Department will partially fund this program.I am in the process of writing several grants to fund the other portion. b.Share data with other research institutions including Cornell Univer sity,Bridgewater State College (where I am a graduate student),and the Provincetown Center for Coastal Studies. c.Enlighten public awareness surrounding the delicate relationship that exists between man and the whales.Many would like to suggest that whale watches are adversely affecting migration routes and are forms of harassment.There is no evidence to support this and from my per sonal experiences with the whales I feel quite the contrary.I see more whales each season I go out and we (man)can only improve on the relationship that we have had.Guidelines set up by the Marine Mammal Protection Act will be strictly adhered to.My reason for being out with the whales is to increase my understanding of whales and boost public concern. I feel strongly that the Barnstable Whale Watch will add a great deal to the town. We have a unique opportunity and challenge having such access to a rare and endangered species.I hope we can take advantage of it. Mr.Marchand's argumsnt that the wording of the Business Limited District B section of the Bylaw,specifically allowing "Operation of charter fishing and marine sightseeing and excursion facilities",would be significant if that language were adopted siimiLtaneously with the language for Marine Business District B. However,the iirpo2±ant language was added under an article in the warrant for the Nbveniber,1978 town meeting v^iich focused exclusively on developEtient of Hyannis Harbor.A review of the minutes of the ^bate on that article reveals no reference to the effect of this bylaw on activities in Barnstable Harbor.Therefore,there is little,if any,significance to the specific authorization of marine sightseeing and excursion facilities,as applied to the situation in Barnstable Harbor. Thus,we are left with the interpretation of the language of the Marine Business District B section,on its own merits.A review of the minutes of the special tcwn meeting of Septentoer 3,1965,^vbich this section was first adopted,provides no insight into v^t town meeting specifically intended to authorize.In such cases,where the discretion of the Building Inspector is involved,I am inclined to refer the matter to him in the first instance for his review.I have done this,and he is looiking into the matter. Specifically,you characterize the operation as a "commercial recreation use".It is ity qpinion that the use is not illegal under the Bamstable Zoning Bylaws. This area is zoned as ferine Business District B.The uses allowed in Marine Business District B include: a.Building,sale,rental,storage and repair of boats. b.Retail sale of marine fishing and boating supplies. c.Retail sale of fishing bait,fish and shellfish. d.Operation of a camercial fishing business excluding conrterical canning or processing of fish. Prior to 1965,it is rr^understanding that the area in question was zoned for general business.At a Special Town Meeting on September 3,1955,the zoning was amended to the form it is esser^^iily in at the present time,with the exception that restaurants once permitted by special permit are no longer allowed.reading of tefij minutes of that Town Meeting indicates to me that it was the intent of the Town Meeting to authorize the uses vhich were taking place at that time in Bamstable Harbor.One of those uses then,and in the recollection of others for a long time previously,was the operation of charter boats.The material iirpact of a charter boat operation,as I see it,is that patrons arrive in tlie area,park,pay a fee to go aboard a boat vhich then departs for a period of several hours,returns and discharges tlie patrons vho thereupon return to their veb-icles and leave the area.I can make no substantial logical distinction between the charter fishing boat operations and the \«iale ^^atching cruise|s to which you object.Indeed,your characterization of this use as "recr^tional"would apply no less to the charter fishing operation,for I believe that it is clear that most,if not all,of the fishing which takes place on the boats is primarily recreational in nature.I do not believe that the zoning bylaw should be read to prohibit a use which in its seaward aspects,involves ttie capture of the images of marine creatures by sight and on film and permit a use which involves the capture of fish vTith bait and hooks. Use Regulations -Non-Residence Districts,paragraph 3.Business Limited District B.subparagraph h.allows "Operation of charter fishing and marine sightseeing and excursion facilities".This district is in the Ocean Street area of Hyannis. Section K.Use Regulations -Non-Residence Districts paragraph 6.does not allow this type of use since it is not provided for in a Marine Business District B. which is the zoning area for Barnstable Harbor.Both the building inspector and the town counsel have disavowed this use as educational.The building inspector in his letter to Mr.Marchand,compared the marine sightseeing use to "fishing without a pole"and Mr.Marchand is not in agreement that fishing can be done without a pole and conform to the uses permitted in a Marine Business District B.The build ing inspector referred to the minutes of the special town meeting which voted the Marine Business District B and told Mr.Marchand that it was the intent of the town meeting to allow this type of whale watching use.Minutes of the special town meeting adopting the MBDB were left with the Board by Mr.Marchand.The petitioner stated that he is an aggrieved party within the meaning of Chapter 40A.,Mass.Gen. Laws and this illegal use has created parking problems,noise,confusion,diminution of property values,and interference with the quiet use and enj03nnent of his residential property.Mr.Marchand said that as a town meeting member he is concerned that a use not permitted under zoning is being conducted without enforcement action on the part of the building inspector.There is a grasping at straws to justify this use in the Marine Business District B zone and Mr.Marchand said that zoning changes should only be made by town meeting and he is aggrieved by this violation of the zoning by-laws and by the refusal of the zoning enforcing officer to take action by enforcing the provisions of the zoning by-laws. Distribution:— Property Owner Town Clerk Applicant Persons interested Building Inspector Public Information Board of Appeals day of 19 under the pains and Board of Appeals Town of Barnstable By™ ._^-^hairman ZONING BOARD OF APPEALS Appeal No.1982-60 Page 3 of A his partner in the operation of the whale watching boat.Before starting this use at Barnstable Harbor,they were told by the harbormaster that the use was permitted;they contacted the neighbors and Faith Cummings of the Barnstable Civic Association and all agreed that the whale watching from Barnstable would be a good thing.After they had operated the boat for some time,they again contacted the Selectmen to see if there were any complaints on this operation and were told that there had been no complaints made.The necessary permits were obtained from the Coast Guard and Mr.Kullberg said that he had made every effort possible to secure the matter before getting his investors involved in this project.Parking spaces were leased from Deane Lawrence and parking attendants are employed to see that there is no illegal parking.The boat has made some evening charter trips but those have now been discontinued.A list of the groups who have used the whale watching excursion boat was read aloud by Mr.Kullberg.The marketing agent is Richard Scudder of Hy-Line Boat Excursions.A different boat than the Atomic was used last summer,the Atomic was used this summer and has now been re placed by a smaller boat called the "Mystery".They are planning to have only one whale watching trip a day after September 18th and there is no fishing done from the boat.Liquor is served and a liquor license was obtained from the ABCC out of Boston.The food sold and served on the boat is snack type food.It is estimated that less than 5%of the boat passengers have alcoholic beverages. Susan Erickson,a biology teacher at Barnstable High School explained the studies she had done on the whales and the educational benefits of the whale watching operation.She is an employee of this operation and a research internship has been established for Barnstable High School students as a result of the whale watching operation.Mr.Richard Scudder,president of Hy-Line explained his long history in the town of Barnstable and said that he knew of no instance in which he or his family had caused detriment to the town.There are twenty jobs involved in the whale watching operation and if they hung poles off the rear of the boat they would be in compliance with the zoning in the harbor.About thirty cars arrive and depart for one whale watching trip.Mr.Scudder said that there would be no evening charters or inappropriate use of the whale watching boat as long as he is involved with this operation.This business has been in use for two years and they were told that it is an allowed use. Basil Edwards said that the zoning by-laws should be upheld.James Kittredge,a cottage owner at Sandy Neck said that this is nothing more than an excursion boat with loud speakers in operation as the boat leaves the harbor and the use is detrimental to the area. Mr.Marchand said that Faith Cummings was told this was a "fait accompli"situation. Mr.Kullberg should have been advised that this was not an allowed use under zoning. Mr.Marchand sent a letter to the Selectmen which was not answered for seven weeks and this accounts for his delay in filing for enforcement action. (continued) ZONING BOARD OF APPEALS Appeal No.1982-60 Page 4 of 4 Mr.Kullberg said that his attorney is Gerry Gamick and they had gone to all of the proper authorities for permission to operate the boat.They have been in operation long enough for someone to take enforcement action before now and he is willing to make this use educational only. The matter was taken under advisement and the hearing closed. The Board found that whale watching from an excursion boat with paying passengers and the serving of alcoholic beverages and food is not a permitted use in the Marine Business District B area of Barnstable Harbor.If at the time this area was zoned Marine Business District B by town meeting,and an excursion boat operation was intended as an allowed use;the wording used in Sec.K.,paragraph 3.,sub- paragraph h.(Operation of charter fishing and marine sightseeing and excursion facilities)or words of similar import would have been included in the description of allowed uses.In the absence of such wording for the Marine Business District B zone;the Board can only reasonably conclude that town meeting did not intend that Barnstable Harbor,which is accessible through a residentially zoned area, have as a permitted use,excursion boat facilities whether used for whale watching or any other type of marine sightseeing.The Board instructs the building inspector who is the zoning enforcing officer to take action so that the illegal use now existing by the whale watching excursion boat facility be terminated.The Board*s vote to take this action is unanimous as required under Sections 8 and 15 of Chapter 40A., Mass.Gen.Laws.
