Since permit issuance several changes of a minor nature have been addressed; framing,envelope energy compliance,and interior support repairs. Currently a greater problem exists; replacement of the failed bulkhead adjacent to the kitchen/service entrance. This can be seen in photos 1 &2 (attached). During the construction of the kitchen roof over the walk-in cooler the framing support in this area became suspect. The kitchen/service entrance ramp and door were removed to address rot in the support beams to include the rear door and its support header. As the bulkhead provides partial support for this entrance,once the deck was removed the abysmal condition of this bulkhead became fully apparent. Working with Downcape Engineering a rock crib wall and bulkhead repair plan was prepared. This was submitted for approval to the Barnstable Conservation Commission in time for their 2nd meeting in March and herein lies the problem;due to scheduling conflicts a committee quorum was not present and may now not be present for a number of weeks in the future. The restaurant is scheduled to open the first week of May this year. The kitchen/service entrance serves as the direct means of egress from the kitchen as well as a 3rd means of egress from the building(front door and public access walkway are the other 2). Work needs to proceed now on the rock crib and bulkhead repair so that the kitchen/service entrance can be rebuilt in time to open. A hardship will exist if the opening is delayed yet the restaurant can not open without a direct kitchen egress(in accordance with Para. 1006.2.1). On behalf of the Mattakeese Wharf Restaurant I request that you intercede and allow the bulkhead repairs to proceed immediately. These holes were located on the northeast corner of the intersection of MillWay and Route 6A/Old King's Highway, a few feet east of the new brick apron at the bottom of the staircase leading up to the Old School House. Apparently someone from the Mattacheese.Wharf was in the process of moving the ladder sign to a more visiblelocation, despite the fact any sign placed in this position would obscure a memorial to Carleton Ryder, a casualty of World War II. When he saw neighbors observing his activities, the man quickly scurried away in a late model Audi with the license plate "ASPEN." (I doubt this kind of fly-by-night activity is permitted in Colorado.) After checking with the chairman of Barnstable's Old King's Highway Committee and determining that it had not approved moving the sign, I called several abuttors. We re-filled the holes anti left a note indicating that moving the sign: 1. Requires approval by the Old King's Highway Committee, and 2. Would obscure a memorial to Carleton Ryder, a World War II casualty. 3. Would destroy attractive plantings on the corner. The following morning, the same man returned with a younger man wearing an employee-shirt from the Mattacheese Wharf Restaurant on MillWay. This time they said they were only re-. positioning the sign so that it could be read more easily from the street. When a neighbor (Dr. Black) and I checked later, it appeared that the position of the sign had changed but the new position did not obscure the memorial. The younger man arrived in a car with plates "B37 373". When I told them that they needed to apply to the OKH Committee for authorization to move the sign, the older man (first) told me that he had permission from Joe DeLuce. When I objected that Joe DeLuce had not been the town's building inspector for years, he said that he also (?) obtained permission from Ralph Crossen. Mr. Crossen, is this true? If so, I would appreciate your informing the abuttors that you are granting such permission. And, as a courtesy, you should inform the descendants of a man who gave his life for this country in Normandy. They are alive and reside locally. I do not object to tilting the sign at a slightly different angle so that it can be more easily read from the street, i.e., moving one leg of the ladder sign. Nonetheless, moving this sign is not up to me as an abuttor. Nor is it up the building inspector, who is merely the enforcement officer for the Old King's Highway Committee and does not make decisions for this committee of elected officials. I think that the Old King's Highway Committee, the Civic Association's planting committee am the Barnstable Village Improvement Association should be consulted about re-positioning this sign. Care must be taken not to disturb the plantings and brick apron at the foot of the stairs. Moreover, I do not think that moving the sign should occur clandestinely in the early hours of a Sunday morning. �^1 Placement of this sign is not grandfathered to any specific location since it has not stood in one position for a continuous period of time. Mr. Bergmann, you obtained approval from the Old King's Highway Committee for an entirely new plan for curbs, sidewalks, lights, standards and signs for this intersection. It is my understanding that living in a well-regulated city and in a historic district would protect me and my neighbors from such furtive, surreptitious act like the one attempted by employees/ owners/managers of the Mattacheese Wharf late Saturday night. What assurances do I have that another attempt to move this ladder sign will not awaken me in the wee hours of another night? If this sly incident is ignored by the OKH Committee, why do the locals have to pay a fee and lose a Wednesday evening when they wish to make changes in the appearance of their residences? Now that this middle-of-the-night activity has become public knowledge, several members of the Unitarian Church (several of whom served on the Old King's Highway Committee) have questioned why five of the eight steps on this ladder sign are dedicated to this one business. AT THE REQUEST OF AN ABUTTOR (Robert Lavery) ON THE SOUTHEAST CORNER, I AM ADDING THE FOLLOWING PARAGRAPHS TO ADDRESS SAFETY ISSUES: For some careless reason, there is no pushbutton for pedestrians on the northeast corner of this intersection. This is true despite the fact that most of the foot traffic at the corner involves children walking from the dance studio to purchase candy at the Barnstable News Store and pedestrians visiting the Hospice thrift store, Unitarian church and Kit and Kaboodle shop, each of which is staffed primarily by senior citizens. Moreover, there are no crosswalks for any pedestrians entering the intersection by walking across MillWay or Route 6A from this corner. And, there are no pedestrian signals facing that corner. The overall plan gives one the impression it was devised by someone off Cape who had never bothered to visit Bamstable Village to take note of the diagonal brick staircase leading to people-intensive activities and organizations on that corner. Without observing traffic at the intersection, a novice might guess that, since there are no sidewalks leading to that corner, it is undeveloped land. Perhaps Mr. Bergmann can explain the rationale for spending $60,000 to $70,000 (his own estimate) of town money on the non-functional updating of this intersection while failing to service its busiest corner. In any case, as a result of this flawed design, placement of signs on that corner can be a serious safety issue. Placing a (tall and wide) ladder sign in front of the memorial is not only an insult to a slain soldier, it is a serious traffic-safety hazard. Children and other pedestrians standing on that corner and wishing to cross MillWay or Route 6A would not even be able to see the non- pedestrian (red/yellow/green) traffic signals. Worse yet, pedestrians would not be visible to drivers in their automobiles. For that reason, if no other, moving this sign should not be at the whim of the absentee landlord of a local commercial establishment. Sgt.
