In---1982 to 1984 my brother, Sandy Blair, and I rented a small office (-120sq ft.) and boat slip from Harbor Lands Trust(see Appeal No. 1983-41 attached). Then again " i"n-1987,T rented a larger space of—400sq ft. Since that time, I have continuously occupied various different spaces in the building.Throughout this period, from the early 80s to present,the building has been occupied by one apartment tenant and up to 12 professional practices. In 1989 I purchased the complex and have continuously rented an apartment and office space to numerous individuals including psychologists, doctors, lawyers, accountants as well as busir essinen and businesswomen. Appeal No.____ 1983-41 M Page _2____ of 2 __ • On June 16 19 _._.___._, The Board of Appeals found Attorney Jonathan Klein represented the petitioner who seeks a change of use by special permit to allow one apartment and twelve small offices at Millway, Barnstable Village harbor, in the-building owned by Dean Lawrence. Presently existing is one apartment and five offices. A history of previous uses at the site was explained and originally the building was used for fish storage and has been upgraded by the present owner, Dean Lawrence. If the special permit is allowed, there. would be no change in the exterior of the building and the inside space would remain the same except for the addition of interior walls for the smaller offices. No additional parking would be required since the change from five offices to twelve offices would involve fewer clerical employees. Large offices have more support staff than smaller offices and each of the twelve . offices would contain approximately 600 sq. ft. of space. A detailed parking plan will be submitted. Dean Lawrence spoke and said that.in his experience an office containing 1200 sq. ft. of space has a clerical staff of eight to nine persons along with the principals. An office of 600 sq. ft. usually has the principal and a secretary only for a total of two persons. Mr. Lawrence said the building would be connected to town sewer and this would be an acceptable restriction if the special permit is allowed. The use would not be detrimental to the neighborhood nor in derogation of the spirit and intent of the zoning by-laws. No one spoke in favor of or in objection to the petition and the Board took the matter under advisement. The Board found that a change rom five offices to twelve offices with the one apartment remaining at Dean Lawrence's building, Millway, Barnstable Harbor, with no increase in the size of the building but a re-arrangement of the interior, would not be detrimental to the neighborhood nor in derogation of the spirit and intent of the zoning by-laws and voted unanimously to grant the petitioner a special permit. (2) Not more than one apartment for occupancy by the marina owner or by staff employed at the marina. C. Conditional uses. The following uses are permitted as conditional uses in the MB-Al and MB-A2 and MB-B Districts, provided that a special permit is first obtained from the Zoning Board of Appeals subject to the provisions of § 240-125C herein and subject to the specific{standards for such conditional uses as required in this section: 240:40 05-15-2008 § 240-23 ZONING § 240-23 (1) Restaurant, such use being provided for in the MB-B District only. Drive-up windows and/or drive-through facilities are prohibited. (2) Corporate branding prohibition: Buildings, colors, signage, architectural features, le c text, symbols, graphics, other attention-getting devices and landscape elements that _ ( are trademarked, branded or designed to identify with a particular formula business "'V� chain or corporation are prohibited. Lawrence presented his petition before the Board and rntrr,duced :.iel Hostetter who would operate the petitioner's proposed restaurant at 215 Mil';ray, Barnstable. The property in question is located in a Marine Business B z„r.ed district which allows a restaurant use by special permit and office space in Mr. Lawrence's building would be converted into a restaurant. This spa':e would approximate half the size of the Mattakeese Wharf restaurant, The menu w!•t;ld be similar to Wimpy's in Osterville which is run by Mr. Hostetter and more than adequate parking would be provided in the front and side of this property. The only exterior change -would be the installation of smaller paned windows, awnings, and a balcony on the second floor. The restaurant would have a seating ca.,.ar:itI of 96 patrons and would be operated on a year-round basis. A large plan and exhibit showing the proposed use was explained by Deane Lawrence and those in att- dance at tha hearing were invited by the Chairman to ask questions. The petitioner will seek a liquor license and the entrance to the restaurant will be opposite an undeveloped area and that particular location was chosen salt-hat the access Co the restaurant would not be opposite anyone's residence. Mr. McKiel, an abutter, asked about the entrance and -exit to the rear of the property and Mr. Lawrence said that he would close off this area if the Board felt it necessary. The parking guidelines are those used by tee Towr, of Yarmouth since Barnstable does noc provide parking regula- t ions for restaurant use, and the petitioner would provide 33 spaces initially and could provide up to-200 spaces. Quenton Munson asked wh))*`xa filing had not been wade with the Old King's Highway Historical Commission and Mr. Lawrence said that he would file with them subsequent to approval of his petition by the Zoning-Appeals Board. Mr. Jerry Adler sa!d that overflow parking for the Mattakeese restaurant is on the petitioner's property, Those speaking in objection to the petition were: Quenton Munson who presented a letter from the Barnstable Civic Association objecting to the proposed use; Jerry Adler who is a tenant in the office building where the restaurant would be located; • Virginia Dickson, Jane Gallagher and Richard Marchan, all of whom were concerned with traffic congestion in the area of the restaurant. This restaurant would provide a water view for the public toand this area should be accessible to all of the people of the town and not just the residents of this area. If the Board required ft, Gere would be no music or entertainment. Permission for the apartment use in this building was granted by the Board of Appeals under petition 1976-57. Hr. Lawrence said that allowing this use would not be detrimental to the neighborhood nor in derogation of the spirit and intent of the zoning by-laws and this is the basis for the Board's decision in granting or denying a special permit. The Chairman said that the Board would view the property and the hearing was closed. The Board voted unanimously to grant the petitioner a special permit for the establishment of a restaurant in his existing building and found that this use would provide an amenity to the town and would therefore be in keeping with the spirit and intent of the zoning by-laws. The petitioner's land comprises • 49,570 sq. ft. az,J he has the capability of accomodar.ing parking for a much large- restaurant than the proposed 96 seating capacity. The Board found that, the restaurant use which will be in an established building would not be detrimental to the neighbor- hood in any way which could be considered substantial,and the petitioner's plans will upgrade his property due to the landscaping which will occur as a result of this use. This special permit is subject to the following restrictions: 1. All construction shall be in accordance with the plans submitted re: parking and landscaping and cited as follows: "Plan prepared for Harbor Lands Trust, Millway Road Barnstable, MA 02630 - Prepared by: Coastal Resource Planning, 275 Millway Road, Barnstable, HA 02630 April 10, 1980 Scale: 1" = 20'-0" 2. There shall be no amplification of music or noise emanating from the restaurant which,is clearly audible at a distance of 50 ft. away. 3. This restaurant is limited to a 96 patron seating capacity. . 4. There shall be a minimum of 50 on-site parking spaces to accomodate the restaurant use only. 5.
