Perhaps a little background on I.F.A.W. is in order. The United States entity was organized as an Animal Oriented Charitable Trust in Massachusetts in February 1975. We received exempt status of 501(c) (3) under the Internal Revenue Code. (Copy of our latest determination letter is enclosed). We have affiliates in Canada, England, Netherlands and Germany. These are jointly controlled but are separate entities organized under the laws of the countries in which they are located. We do have marine involvement because one of our principal objectives is to save seals worldwide. We are also involved with supporting the saving of the whales as well as other marine research. We are considering the purchase of the property for our exclusive use. This would mean that as leases expire in the buildings, we would not renew and would eventually occupy all the space for our offices. Future plans include a marine research vessel and Whale Watching. _ Therefore, before we commit ourselves to this major expenditure, we would like to be assured that non-conforming use of the building space grandfathered" and allowed to the former owners would also apply to US. Your request fora determination on the existing permit is the subject of this letter. I have requested support- ing (documents regarding this permit. A notice of intent under the Wetland Protection Act was filed on March 14, 1977 under file #SE3-216 . A letter from the Conservation Commission was received on January .5, 1979 re- questing a new filing be made concerning the above file. Permit #680 from the office of EnviromentAal Affairs dated September 29, 1980, was recorded with the Barnstable Registry of Deeds, Land Court #27.1461, on October 6, 1980 with accompanying plans. This permit was necessary in' order to complete the Marine Building for Marine use, i.e. boat slips and boat storage. I believe your office has also received a request by Mr. Lebel of Lebel Construction Co. for a determination of the status of this building permit , prior to his continuing construction under this permit . It has been more lengthy a process to obtain all the necessary permits for the Marine construction aspects of site improvement than earlier antis pated. The Marine building, boat slips and other related Marine improvements are planned to be completed and leased as one unit of the proposed site improvements on the waterfront property. It has been necessary to obtain the following permits prior to com- pletion of the Maine uses allow on site;- 1- Wetlands filing # SE-3-143, SE-3-3443 and SE-3-216 Barnstable Conservation Commission (Local) 2- Historic District Permits for building, signs (Local) 3- Mass. Waterways permit (State) 8- Corp. of Army Engineers permit (Federal) To date most of the permits have been issued. It must be noted however that the State has no time limit by which they must comply in reviewing or issuing applications and permits. License xo. 680 Page 2 A "U"-shaped steel bulkhead, consisting of three sections, each having a length of 20 feet and a top elevation 14.0 feet above the mean low water datum, may be constructed and maintained to the east of a building on piles previously authorized by D.P.W. License No. 2632 and D.E.Q.E. License No. 273. A wood bulkhead, having a length of approximately 65 feet and a top elevation 5.0 feet above the mean low water datum may be maintained as ' constructed along the southwesterly side of said previously authorized building. Two steel bulkhead returns having a length of 30 feet and a top elevation 5.0 feet above the mean low water datum may be constructed and maintained at either end of said bulkhead. A 20 by 50 foot gravel fill ramp may be constructed and maintained within the confines of said "U" shaped bulkhead at its southerly end. Riprap may be placed and maintained along said ramp's sides as indicated on the License Plan for the remainder of its length. Said ramp may vary in height from 14.0 feet at the bulkhead end to 17.0 feet above the mean low water datum at its upland end. A series of pile held main floats, reached by a 3 x 30 foot ramp from the uplands, having varying lengths and widths as indicated on the license plan, may be placed and maintained in said harbor to the southwest of said building on piles. Nine 24 by 4 foot pile held finger floats, angled at 60 degrees to the main floats, may be placed and maintained in said harbor. Six mooring piles may be placed and maintained between said finger floats as indicated on the license plan. An area having an average length of 140 feet and an average width of 100 feet may be dredged to a depth of 6 feet below the mean low water datum. Dredged material shall be disposed of at an approved disposal site in a manner so as to insure- against its return to the tidewaters. All work- authorized hereby shall be in the location shown and in accordance with the details indicated on License Plan No. 680. . Please see page 3 for additional conditions to this license. Duplicate of said plan, numbered,---41680'--"is on file in the office of said Department, and ofiginal of said plan accompanies this License, and is to be referred to as a part hereof.
