Residential B Zoning District Relief Requested & Background This property is a 0.23-acre lot located on Millway,Road in a Residential B .Zoning District. The existing single-family dwelling is a 728..sq. ft. two-bedroom,.one=story ranch type structure built in 1954. It is connected to the town sewer system and public water. The existing,structure conforms to current building setback requirements for the.district;.however;the lot is an undersized, preexisting legal non-conforming lot with respect to area. The applicant proposes to raze the existing dwelling and reconstruct a 1.5-story, four-bedroom, single-family dwelling of approximately 2,688 sq.ft. No portion of the original structure is intended to be preserved. The applicant is seeking findings by the Board with respect to MGL Ch. 40A, Section 6 for reconstruction on undersized lot. .. . Procedural & Hearing Summary: This appeal was filed.at the Town Clerk's Office and.at the Office of the Zoning Board of Appeals. on June 7, 2002. An extension of time for holding the`hearing and for filing of the decision was executed between the applicant'and the Board.. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened July 10, 2002, at which time,the Board.found to grant the application. Board members deciding this appeal were, Gail Nightingale, Thomas A. DeRiemer, Ralph Copeland, Jeremy Gilmore and Chairman,Ron S.Jansson. Attorney Michael Ford represented the applicants who were also present during the.hearings. Mr. Ford noted that the dwelling has been:in family ownership dating back to the 1950's and that it was the intent of the applicants to retain ownership of the property. They intend to reconstruct a new modest single-family dwelling of 1.5 stories. The new building would occupy 16%of the lot. With the open-air patio and deck,.23%.of the lot is covered by structure. The footprint of the building is 1,600 sq.ft. and the total interior area of the w d ellin would be less than 2 688 s .ft. The patio with the deck above is to the re ar g � q p of the structure and covers approximately 700 sq.ft. The Board,questioned why no garage was included in the building and the applicant stated that it was to keep development on the lot to a minimum and to protect a neighbors view. The subject of on site parking was discussed and it was agreed upon that parking would be to the side of the structure. It was noted that the locus in within a flood plane and that all building requirements would be complied with. The Board and applicant discussed the size and height of neighboring buildings with respect to the proposed new dwelling. Findings of Fact: At the hearing of July 10, 2002, the Board unanimously made the following findings.of fact: 1. .The property at issue is addressed 306 Millway Road,Barnstable, MA in a Residential B Zoning District. The Residential B District requires a minimum lot size of 1-acre, a front yard setback of 20 feet and the side and rear setbacks are 10 feet. The subject lot is shown on Assessor's Map 301 as parcel 012. 2. The applicants, Lawrence and Margaret Smith own the property and are seeking a Special Permit in,accordance with Section 4-4.3(2) Nonconforming Buildings and MGL Chapter 40A, Section.6, to allow for the demolition of the existing single-family dwelling on an undersized nonconforming lot of 0.23-acres and construction of anew larger single-family dwelling. 3. The.existing single-family dwelling is a 728 sq. ft. two-bedroom one-story ranch type structure built in 1954. Town sewer and public water service the property. The existing structure conforms to current building setback requirements for the district. The lot however is an undersized non-conforming lot. 4. The undersized lot is located approximately 250 feet from Barnstable Harbor in a designated flood zone A3. 5. The applicant proposes to demolish the existing dwelling and reconstruct a new single family dwelling on the undersized lot. In the case of Dugas vs. the Zoning Board of Appeals (Land Court Miscellaneous Case No. 246863), required a finding by the board that the building is a "reconstruction" and that the proposed building will not be substantially more detrimental to the neighborhood. The proposed building is a reconstruction of the existing single-family residence. 6. The applicant has adequately provided for off-street parking and has agreed that no vehicles will be parked on the public way, Millway Road. 7. The location of the new dwelling conforms to the required setbacks for the district and the new size of the proposed dwelling does not represent substantial detriment to the neighborhood . 2 8. The proposed new dwelling does not intensify the nonconformity and it would not be substantially more detrimental to the neighborhood than the former dwelling. Decision: Based on the findings of fact, a motion was duly made.and seconded to grant the appeal with the following conditions: 1. Location of the dwelling shall be as shown on a plan entitled "Site Plan" prepared for.Lawrence &Margaret Smith showing the existing and proposed dwellings, 306 Millway Road, Barnstable (Village),MA dated September 17, 2001, and drawn by Arne H. Ojala, Down Cape Engineering. 2. The dwelling shall be connected to public water as well as Town sewer. 3. The dwelling footprint, not including patio and deck shall not exceed 1,600 sq.ft. The-total square footage of the proposed dwelling shall not exceed 2,688 sq.ft. The development shall also include an outdoor patio with an open-air deck above as per plan. 4. Construction shall comply with Health, Building Divisions and Conservation Commission requirements and regulations. 5. All parking shall be accommodated on-site and arranged so as to preclude back out onto Millway Road. 6. The property shall not be leased or otherwise rented.out for a term of less than 6 months.
