The permit was issued to the Drew family, who transferred the property to Mr. Harden in September 2015. The subject property is a 1.85 acre lot. It it improved with an 8,676 gross sq.ft(4,328 sq.ft living area) dwelling and accessory family apartnent. The family apartment appears to have been constructed as an addition to the dwelling in 2000. The property is served by public water and a five-bedroom on-site septic system. The apartment is approximately 1,100 square feet in area; it is a one-bedroom unit with a bathroom, kitchen, living room and office/playroom. No changes to the dwelling, apartment, or property were proposed. Procedural & Hearing Summary Special Permit application No. 20167009 for the transfer of a family apartment Special Permit was filed at the Town Clerk's office and office of the Zoning Board of Appeals on February 1, 2016. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on February 24, 2016 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were Brian Florence, Alex Rodolakis, David A. Hirsch, and Matthew Levesque. The Applicant, Charles Harden, represented himself before the Board. He presented the request to the Board, and confirmed he understood all of the requirements of the family apartment ordinance and the proposed permit conditions. The Board Chair requested public comment and no one spoke. Findings of Fact At the hearing on February 24, 2016, the Board unanimously made the following findings of fact in Special Permit Application No. 2016-009, a request to authorize an existing family apartment: 1. In Application No. 2016-009, Charles Harden sought a special permit to authorize an existing family apartment located within and attached to the principal dwelling at 276 Old Jail Lane in Barnstable. The family apartment was originally permitted by Special Permit No. 1999-130; Mr. Harden sought to transfer the permit into his name. 2. The property is located at 276 Old Jail Lane, Barnstable, MA as shown on Assessor's Map 278 as parcel 049-001. It is located in the Residence G Zoning District. Town of Bamstable Zoning Board of Appeals—Decision and Notice Special Permit NQ. 2016-009—Harden 3. Section 240-47.1(A)(1) of the Zoning Ordinance allows for a family apartment greater than 800 square feet, not to exceed 1,200 square feet, with a Special Permit from the Zoning Board. 4. Site Plan Review is not required for single-family residential structures or family apartments. 5. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. There will be no changes to the structure or the property and the apartment will continue to be used in the same manner since it was originally permitted in 1999. Special Permit No. 2016-009 is granted to Charles Harden to authorize an existing family apartment of approximately 1,100 square feet at 276 Old Jail Lane, Barnstable. 2. The family apartment shall be a one bedroom unit and shall not be expanded without further relief from this Board. 3. The family apartment shall be maintained in compliance with the requirements of§240-47.1. 4. There shall be no renting of rooms or lodging permitted on the property during the life of this permit. 5. When the family apartment is vacated or upon noncompliance with any condition or representation made, including but not limited to occupancy or ownership, the use of the family apartment.shall be terminated and this permit shall become null and void. The applicant or property owner shall be responsible for the removal of the kitchen, unless the unit is properly permitted under the Accessory Affordable Apartment Program. 6. The decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and.the Building Division prior to issuance of a Certificate of Occupancy for the family apartment. The rights authorized by this special permit must be exercised within two years, unless extended. The vote was: AYE: Brian Florence, Alex M. Rodolakis, David A. Hirsch, Matthew Levesque NAY: None Ordered Special Permit-No. 2016-009 to allow the use an existing family apartment at 276 Old Jail Lane, Barnstable has been granted to Charles Harden subject to conditions. This decision must be recorded at the Barnstable Registry of Deeds for it to be in effect and notice of that recording submitted to the Zoning Board of Appeals Office. The relief authorized by this decision must be exercised within two years unless extended. Public Commont: No one spoke in favor or in opposition to this appeal. The Board voted to continue this appeal to 01/05/00 at 7:45 PM to allow the applicant time to obtain a letter from the Board of Health regarding the existing Title V septic system and the additional fifth bedroom on site. Procedural & Hearing Summary Special Permit application No. 2016-009 for the transfer of a family apartment Special Permit was filed at the Town Clerk's office and office of the Zoning Board of Appeals on February 1, 2016. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on February 24, 2016 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this appeal were Brian Florence, Alex Rodolakis, David A. Hirsch, and Matthew Levesque. The Applicant, Charles Harden, represented himself before the Board. He presented the request to the Board, and confirmed he understood all of the requirements of the family apartment ordinance and the proposed permit conditions.
