It is improved with 4 structures; a 2,000 sq. ft. single-family residence, a 1,000 sq. ft. detached garage, a 96 sq. ft. shed and a 144 sq. ft. shed, according to the application. The property is located in a RF-2 Residential F-2 Zoning District. The applicant operates a brush clearing/tree pruning business. The main office for the business is located in Hyannis but the applicant stores 3 commercial vehicles and related equipment for the business on the subject premises when not in use. During the day, the 3 commercial vehicles and related equipment leave the site and are replaced by 3 employee vehicles. Due to a complaint by a neighbor, the Building Division became aware of the activity taking place on this site. The applicant was informed by the Building Commissioner that he must cease operating his brush clearing/tree pruning business from this location or seek zoning relief. The applicant is appealing this decision of the Building Commissioner. In the alternative, the applicant is also applying for a Special Permit pursuant to Section 4-4.5(1) Change of a Nonconforming Use to Another Nonconforming Use to allow him to continue his present activities. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 28, 1998. A 90 day extension of,time for holding the hearing and for filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December 16, 1998 and continued to January 20, 1999, at which time the Board, per request of the applicant, granted a Withdrawal Without Prejudice. I purchased the one acre lot listed as#2 on the enclosed plan and he owned the .93 acre o listed as #1. The parcel of land is ID#: 23 7-03 2 and its locations is: 31 Old Neck Road #I I was just recently told by a neighbor that our lot could not be used to build on because it did not meet the towns building code and that one acre is the minimum land space requirement to build a home in that district. Of course the deed states one acre+/- as does the plan: I am gY re uestin our assistance in determining if my lot meets the town's legal criteria for a q buildable lot. I attempted to do the basic math with the measurements listed on the plan and did some interpolation with regard to the eastern bit that would become a triangle once the main part was squared off. I came up with a little over an acre, but without good data or references, it means nothing. I also assume that some other criteria must come into play in determining buildable.
