Per our meeting with Chris Stavros and Doug Sanford, Excel proposes to purchase the Auburn Wire building, which consists of approximately 23,200 square foot of building foot print. The site as currently configured has 84 parking spaces and approximately 61% lot coverage. These are denoted on the Plan delivered to you by Doug on Friday. Excel intends to utilize the Auburn Wire building for laboratory, storage and production work consisting of approximately 10,100 square feet of floor area and office space (consisting primarily of research and development) of 25,800 square feet. Based on the applicable provisions of the parking portion of the Zoning Ordinance, it is estimated that 100 vehicle spaces will be needed. Taking into account the existing 84 spaces, the property requires an additional 16 spaces. At the same time, the adjacent existing building owned by Excel has 73 parking spaces, with a total current requirement of 57 spaces. As a result, pursuant to Section 4-2.4 of the Zoning Ordinances, Excel proposes to utilize the properties in such a fashion as to meet the requirements for parking while utilizing the total parking spaces on both properties. Based upon our review of the prior utilization of the Auburn Wire building, we do not believe that the proposed mixed commercial use for laboratory storage, production and research and development, fabrication, distribution and office space will constitute either a change or intensification of use. This will result in a reduction in the percentage of lot coverage. Finally, Excel proposes to construct 9,950 square feet of new internal floor area within the Auburn Wire building, which amount of floor area is below the 10,000 square foot "addition" described as a presumptive threshold under Section 12 of the Cape Cod Commission Act. Based upon our discussions, we will prepare an Application for Site Plan Review and provide your office with confirmation of the cross-easements necessary to provide the parking as described above. Per your request, we have conducted additional investigation into the history and use of the former Auburn Wire building, now owed by Excel. The building in question was constructed in 1980 and, according to Building Permit records, consisted of approximately 22,800 square feet of building footprint (190' x 120'). The building also contained a mezzanine area consisting of approximately 4,000 - 5,000 square feet. The building was built originally by Paul Lorusso and was leased to Auburn Wire by a lease dated September, 1981. The lease was a fifteen year lease running to . August, 1996. Auburn Wire relocated off Cape and vacated the premises on or about May 1, 1996. Auburn Wire was a designer and fabricator of wire components made from previously manufactured wire and..metal materials. The wire products were designed to specifications provided by outside purchasers and vendors. Engineering and design facilities were included i NUTTER. McCLENNEN & FISH. A primary activity of the company was to fabricate and assemble coaxial cable for main frame computers, particularly in the aerospace industry. A significant portion of that activity consisted of reviewing specifications, upgrading engineering components and reassembling and braiding the wire products to meet the specifications. In addition. to the foregoing, the entire Business operation of the company was located within the facility, including sales, accounting, general management, receivables and payables. Also product shipping and assembly areas were located within the facility. In approximately 1986 a 4,000 square foot addition was added, which was used for receiving and shipping. Accordingly, the total floor area of the building was approximately 30,800. We are informed that the company operated three 8 hour shifts, twenty four hours a day, Monday through Friday, with 1/2 day shifts on Saturday. In addition, at various times during the occupancy by Auburn Wire, seven day shifts were utilized. It has been estimated that the work force located within the building varied betwee 80 to 120, depending on the year in question. Based upon the foregoing, we believe that the prior utilization of the premises was a mixed commercial use, predominantly in the area of design, assembly and light manufacturing. In preparation for the filing of our DRI Exemption request with the Cape Cod Commission, extensive discussions were had with the Building Commissioner of Barnstable, Ralph Crossen. The Building Commissioner has agreed with our analysis that the proposed use by Excel as a research, development and assembly facility is not a change of use. We do not anticipate any increase in estimated water usage, and believe that there will be a net decrease in the presence of hazardous material. The property will be connected to Town sewer. Based upon the anticipated utilization of the premises as described in our DRI Exemption application and Site Plan Review materials presented to the Site Plan Review Committee in Barnstable, we do not believe that the proposed use constitutes a change of use under Section 12 of the Cape Cod Commission Act or Sections 3(e) and 3(f) of the DRI Regulations. Accordingly, we would request concurrently from Commission staff that this will not be considered a change of use, and that we may proceed to an expedited hearing on the DRI NUTTER. Building 75 Dear Mr. Crossin, As requested, this letter is to confirm the status of first floor Aisle 751-023 where it is adjacent to the Reception Area 751-005. This Aisle where it is adjacent to the Reception Area has been eliminated in order to allow the Reception Area to center on the entry doors. The dead end portion of this Aisle is less than 20 feet and it cross connects to the main aisle via Aisle 751-012. To the best of my knowledge, this change conforms to the State Building Code. As you are aware, Excel plans to connect an addition to this building in this area. This change has been made to accommodate the proposed addition and the functional layout of the spaces surrounding this Reception Area. Upon completion of this addition, the dead end portion of Aisle 751-023 will be eliminated. if you have any questions or concerns regarding this change, please call me to discuss them.
