In accordance with our last meeting, I ain writing to request your confirmation that the subject property is located within the Medical Services Overlay District ("MSOD") as shown on the Town's official zoning map. The property is located at the intersection of Phinney's Lane and Attucks Lane in Hyannis and is shown on Barnstable Assessor's Map 274, as Parcel 16-X02. It is developed with an approximately 5,600 square foot commercial building that is presently occupied by Realty Executives. According to the Town's zoning map, the property is located within the RF-1 zoning district, the MSOD, and the Groundwater Protection Overlay District. For your reference, I have attached a color GIS map obtained from the Town's website showing the subject property and the applicable zoning districts as Exhibit A to this memorandum. The purple grid lines represent the MSOD. The property also has the benefit of a use variance (Appeal NO. 1995-109) that was issued by the Zoning Board of Appeals on August 6, 1999. The variance is recorded at the Registry of Deeds in Book 12526, Page 210. At the time the use variance was granted, the MSOD had not been adopted by the Town. The article proposing the MSOD was the subject of a joint hearing with the Planning Board and the Town Council on July 19, 2001. It was thereafter approved by the Town Council on August 16, 2001. A copy of the MSOD article and map from 2001, as filed with the Town Clerk's Office, is attached as Exhibit B. As you can see, the subject property is shown on the map as being included within the MSOD. With the re-codification of the Town's ordinances, the MSOD is currently contained in Section 240-38 of the Zoning Ordinance. The map referred to in this paragraph is the same map attached hereto as Exhibit B. As depicted on the map, the boundaries of the MSOD clearly encapsulate the subject property. Massachusetts General Laws Chapter 40A, §4 states that "districts shall be shown on a zoning map in a manner sufficient for identification. Such maps shall be part of the zoning ordinance." Thus, §240-6 of the Barnstable Zoning Ordinance states that the Town "is hereby divided into districts as shown on the Official Zoning Map which...is hereby adopted by reference and declared to be a part of this chapter." It is settled law in Massachusetts that, under these circumstances, the boundaries of the map control. Jenkins v. Town of Perpperell, 18 Mass. App. Ct. 265, 269 (1984). In this instance, the Official Zoning Map for the Town of Barnstable clearly shows the subject property as being included within the MSOD. It has been suggested that the language of the MSOD should be interpreted to exclude certain areas from the district, including the subject property, based on the underlying zoning for those areas. To the contrary, we believe that the language contained in §240-38(A)(1) of the MSOD that identifies one of the underlying zoning districts within the boundaries of the MSOD is descriptive and is not exclusive. Rather, the definitive description of the boundaries of the district is contained in the third sentence of §240-38(A)(1) which is quoted above and provides "the boundaries of the Medical Services Overlay District are shown on a map...". An interpretation that the property is not within the MSOD would involve disregarding the plain language of the third sentence of §240-38(A)(1) and the boundaries of the MSOD depicted on the Town's Official Zoning Map. Furthermore, such a finding would exclude approximately one-quarter to one-third of the property shown on the Official Zoning Map from the MSOD - a result that would be absurd given the fact that if Town Council had intended to exclude these areas, they would have made the boundaries of the MSOD reflect that intent. For your reference, I have attached as Exhibit C to this correspondence a color copy of a GIS map showing the full boundaries of the MSOD as well as the underlying zoning districts and the groundwater protection overlay districts. We, therefore, respectfully request that you confirm our analysis that the subject property is located within the MSOD, as depicted on the Town's Official Zoning Map, by countersigning this correspondence as indicated below and returning a copy of the countersigned letter to me. Thus, §240-6 of the Barnstable Zoning Ordinance states that the Town "is hereby divided into districts as shown on the Official Zoning Map which...is hereby adopted by reference and declared to be a part of this chapter." It is settled law in Massachusetts that, under these circumstances, the boundaries of the map control. Jenkins v. Town of Perpperell, 18 Mass. App. Ct. 265, 269 (1984). In this instance, the Official Zoning Map for the Town of Barnstable clearly shows the subject property as being included within the MSOD. It has been suggested that the language of the MSOD should be interpreted to exclude certain areas from the district, including the subject property, based on the underlying zoning for those areas. To the contrary, we believe that the language contained in §240-38(A)(1) of the MSOD that identifies one of the underlying zoning districts within the boundaries of the MSOD is descriptive and is not exclusive. Rather, the definitive description of the boundaries of the district is contained in the third sentence of §240-38(A)(1) which is quoted above and provides "the boundaries of the Medical Services Overlay District are shown on a map...". An interpretation that the property is not within the MSOD would involve disregarding the plain language of the third sentence of §240-38(A)(1) and the boundaries of the MSOD depicted on the Town's Official Zoning Map. Furthermore, such a finding would exclude approximately one-quarter to one-third of the property shown on the Official Zoning Map from the MSOD - a result that would be absurd given the fact that if Town Council had intended to exclude these areas, they would have made the boundaries of the MSOD reflect that intent. For your reference, I have attached as Exhibit C to this correspondence a color copy of a GIS map showing the full boundaries of the MSOD as well as the underlying zoning districts and the groundwater protection overlay districts. Giangregorio Re: SPR 070-95, 1330 Phinney's Lane, Hyannis I walked this site with Brian Adams on Oct. 11th. I found the following to be deficient or not in accordance with the approved plan on file. The dumpster is screened on three sides. A gate shall be installed when the construction dumpster is removed. The parking lot is not paved. The entrance is not finished. The applicant just received the road opening permit from pp J the State. It is expected that the entrance shall be completely during the week of 10/16/00. The raised planter bed designated on the approved plan has not been provided. The twin stone pillar entrance lights are not in place. The applicant had installed a single pole light on one side of the entrance. This is claimed to be adequate enough to illuminate the parking lot. The tree & shrub ratio (and placement) appeared to be in accordance with the plan and in fact may have exceeded the required number. The applicant was advised to create the missing bed, install the free-standing sign in the designated area, ensure that the gate is installed for the dumpster enclosure, and install twin stone facades and additional pole light for the entrance as approved. If the proceeds are not expended after years, the monies will revert to the Commonwealth. The Cape Cod Chapte of Disabled Veterans hope to purchase a hall for meetings, functions and to give day care for disabled veterans.
