The northern portion of the Premises containing the site of the original Barnstable County Courthouse no longer extant, is historically and archaeologically significant and worthy of preservation. Owner and SPNEA recognize the historic, archaeological , cultural , scenic, natural, and aesthetic value and significance of the Premises, and. have the common purpose of conserving and preserving the aforesaid value and significance of the Premises. To that end, Owner desires to grant to SPNEA, and SPNEA desires to accept, the following Preservation Restrictions pursuant to Mass . Gen. Laws . In delineation and furtherance of this Agreement, SPNEA and Owner agree to extinguish in their entirety by deletion Preservation restrictions 1-12 as contained in the Deed, and to replace such restrictions by insertion with the following preservation restrictions which SPNEA hereby imposes and Owner hereby accepts : 1. STRUCTURES. No dwelling, garage or. other ancillary itr "cture shall be constructed, moved onto, or erected on the Premises without the prior written permission with respect. to design, massing, and siting approval from SPNEA. 2. LANDSCAPING/TOPOGRAPHICAL CHANGES. (a) Owner shall maintain the landscape of the Premises in a manner not inconsistent with the preservation of the Premises ' rural appearance as exists on the date of this Agreement, and to ensure that dangerous conditions which may 4 arise on the Premises are eliminated or minimized; ' it being understood that the Owner may undertake in the future a relandscaping of the Premises subject to the prior written approval of. SPNEA as to the landscape plan and design; (b) No soil, loam, rock or mineral resource or natural deposit shall be excavated, dredged or removed from the Premises and no soil, refuse, trash, debris, waste 'or other unsightly or offensive substance or material whatsoever shall be placed, filled, stored or dumped thereon. (c) Pursuant to Massachusetts General Laws Chapter 131 section 40, as well as Article XXVII of the Town of Barnstable By- Laws, the Premises are 'subject to a conservation easement imposed by the Town of Barnstable Conservation Commission by an Order issued on .August 7, 1986 (DEQE file # SE 3-1467) . The restricted area is depicted as lot 2 of the Pl;n .(Exhibit A) and is further subject to an order of conditionit recorded with Barnstable County Registry of Deeds of even date herewith. 3. SIGNS/UTILITIES. No signs, billboards, advertising displays, . above ground utility poles, antennas exceeding six feet in height, satellite dishes, or towers shall be placed on, painted onto, or affixed to or on the Premises, without prior written permission and design approval from SPNEA. 4. SUBDIVISION. The Premises, comprising one lot of approximately 1. 1 acres, shall not be further subdivided for resale or lease, provided that this paragraph shall not be deemed to prohibit the leasing of the Premises for uses permitted by applicable local zoning regulations and By-Laws. 5. INSERTION IN SUBSEQUENT INSTRUMENTS. Owner shall insert or cause to be inserted verbatim all restrictions, stipulations and covenants contained in this Preservation Restriction, in any subsequent deed and probate decree and shall insert an express reference hereto in any other legal instrument by which it divests itself of either the fee simple title to or any lesser estate in the Premises. Concurrently, with its entering into any such deed or other legal instrument, Owner shall give written notice to SPNEA of, same. 6. WRITTEN PERMISSION. SPNEA may grant permission for any constttirction, alteration, addition, removal or any other use or activity by Owner which is restricted by any provision of this Preservation Restriction. Written permission from SPNEA for any construction, alteration, addition, or removal shall not be unreasonably witheld or delayed and shall be in recordable form executed and acknowledged. by any one or more of the President, Treasurer, Director, or such officer or officers who may succeed to their responsibilities under other titles. The failure by SPNEA to act within sixty (60) days of its receipt of any completely documented written request for SPNEA permission required under this Preservation Restriction shall be deemed to be approval of the entire request. In such event, SPNEA shall issue a certificate of approval in recordable form as described i 3 nox5AO P AGE M above upon Owner ' s request. Permission as to one alteration or addition, or group of alterations or additions, shall under no circumstances be construed to waive the requirement for permission for subsequent alterations or additions . 7. NOTICES. Any notice, request, demand, consent, waiver, or other communication which either party hereto -maybe required to give to the other party pursuant to this Preservation Restriction, shall be in writing and shall be deemed duly delivered if mailed postage prepaid by registered or- certified mail with return receipt requested , or hand-delivered -- if to Owner, then to "The Crocker Tavern Preservation Trust (Gunner P. Gustafson, Trustee, and Robert J. Norton, Trustee), 3095 'Mai,n Street, Route 6A, Barnstable, MA 02630" and if to SPNEA, 'the'n to "Director of Stewardship, . The burden of the preservation restrictions shall constitute a binding servitude, shall run with the land in.'perpetuity, 'and shall be binding upon all future Owners, successors and assigns of any interest therein. 9. ASSIGNMENT. All of the rights and restrictions enforceable by SPNEA pursuant to this Preservation Restriction shall be assignable by SPNEA for preservation purposes only and without consideration to any governmental body or any entity described in Section 170 (b) (1) (A) of the Internal Revenue Code of 1954 as amended whose purposes include preservation of structures or sites of historic or archaeological significance in perpetuity. 10. MISCELLANEOUS. The following provisions in this paragraph 27 shall govern the effectiveness, interpretation, and duration of this Preservation Restriction: (a) This Preservation Restriction Agreement is executed in three ( 3) originals, each page of which (including exhibits) has been initialed by Owner and SPNEA for purposes of identification. In the evert of any disparity between counterparts produced, the recorded counterpart shall in all cases govern. One original shall be retained each by the Owner, and SPNEA, and the other original shall be recorded and may be returned to SPNEA. (b) With respect to matters not covered by this Preservation Restriction, Owner shall have the right to operate and use the Premises in such manner as he/she determines provided that such operation and use is not inconsistent with the intent of this Preservation Restriction, and allowed by zoning regulations and Town of Barnstable By-Laws. This Preservation Restriction may be re- recorded at any time by any person if the effect of such re- recording is to make more certain the enforceability of this Preservation Restriction or any part thereof. The invalidity or unenforceability of any provision of this Preservation Restriction shall not affect the validity or enforceability of any other provision of this Preservation Restriction or any ancillary or supplementary agreement relating to the subject matter herein. (f) Nothing contained herein shall be interpreted to authorize or permit the Owner to violate any ordinance or regulation- relating to building materials, construction methods, or use. We wish to purchase this property from French Street Construction, its current owner, and build a cape on the site for our own use. But we would like to add a deck to the property in order to enable us to enjoy the outside as there is very little usable land. The addition of a deck is a contingency in the purchase of said property. As you know, the Pine Lane property is a non-conforming parcel, and the commission approved building a home at the site in 1986. In the same spirit, we hope the commission would also allow the addition of an outdoor deck, which will have as few posts touching the ground as possible. We can also assure the commission that we would never convert the deck into an enclosed structure (i.e., a porch with a roof). Mr. Ernie Serena of French Street Construction has attempted to sell this property since 1992 without success. Based on my experience as a real estate broker in the village of Barnstable for ten years, I believe the house isn't saleable without a deck. And Mr. Serena has indicated he is in a position of hardship: He is paying in the vicinity of$1,000 annually for taxes, and may have an unsaleable lot. Perhaps more importantly, neighbors in the area have expressed the desire to have construction completed on this lot: The open foundation left behind by previous owners is an eyesore and a proven safety hazard. We have enclosed a picture of how the lot currently appears. We also seek the commission's permission to add wood fencing along the existing retaining wall to the right of the driveway. The chasm below the wall poses a significant danger to children and x, f specifically to our grandchildren, who visit frequently. We have every intention to make this property beautiful and adhere to conservation restrictions.
