DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be:;a one or two- family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes, bylaws,rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection procedures and requirements and that he/she will comply with said procedures and requirements. Signature of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that.he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care to amend and adopt such a form/certification for use in your community. Background&.Review: According to the application,the desire of these two appeals is to alter a common property line shared by two pre-existing non-conforming lots. The lots are both owned by the applicant Robert G. Livingston. Although in common ownership they are each developed with a principal residential structure and accessory buildings. According to Assessor's records: • Lot 001 is a 0.78-acre lot developed with a 4 bedroom, 111 -story single-family dwelling of 2,371 sq.ft. The lot also has a 1-story barn structure of 455 sq.ft. and an accessory shed of 112 sq.ft. The principal structure does not conform to the required front yard setback and it appears the 11.5-foot setback is a pre-existing legal non-conformity in structure. f Planning Division-Staff Report • Lot 002 is a 0.18-acre lot developed with a 1-story, two-bedroom cottage of 709 sq.ft. It also has a detached garage of 600 sq.ft. In this instance the garage structure is non-conforming with respect to side yard setback. The structure is 13.3 feet off the property line'. According to information submitted, a Gertrude L. Eaton formerly owned the land. In 1982 the land in question was transferred to the applicant Robert G. Livingston by a deed recorded at the Registry of Deeds,Book 3467 page 183. That deed references a 1974 Approval Not Required (ANR) plan of the landZ that shows the division of the land into two lots. However,those two lots differ from those shown on today's Assessor's Maps. In 1978, Ms Eaton had another ANR plan prepared for the alteration of the common lot line. This plan was signed and endorsed by the Planning Board on December 20`'', 1978. It is recorded'at the Registry of Deeds in Plan Book 329 as page 35. Relevant Zoning History: In 1974,the area was zoned RD-3 requiring a minimum lot area of 20,000 square feet, frontage of 125 and setbacks of 30 feet front, and 15 feet side and rear. The area was rezoned in 1977 to RF-2 requiring 43,560 sq.ft. lot area and 150 feet of frontage. In 1979 the area was rezoned to its present RG zoning. It appears no zoning relief was recorded with either of the ANR plans endorsed by the Planning Board and recorded. With reference to ANR plans,the endorsement does not constitute a conformance to zoning. To legal create those two lots variance relief should have been sought and recorded.' Staff questions if two pre-existing legal non-conforming lots exist in this particular case of if under zoning there is only one pre-existing legal non-conforming lot. Discrepancies: Discrepancy also exists in the records as it relates to these two properties. The Assessor's records state that the 600 sq.ft. garage is attributed to Lot 2 when on plan that structure is located on Lot 1. In discussion with Frank Schlegel,Engineering Division, it was speculated that the later 1978 ANR plan was not followed through with a recorded deed. The plan was transferred to the maps. However, missed in the Assessor's records and Lot 001 and 002 remains on those records as per the earlier 1974 plan. The situation needs to be clarified for the records. Also in discussions with Mr. Schlegel, he suggested and recommends that in cases were land is being transferred between two lots—if this is the case in this appeal-that the plan be drafted to show the existing lots with the area to be transferred as a third lot. Notes on the plan should document the area of the lot to be transferred, and from which lot it is being subtracted and which lot it is to be added. The applicant has submitted a proposed new plan for the division of the lots that alters that existing boundary line. From that plan it appears Lot 001 is being reduced in size from 33,884 sq.ft. to 30,052 'Note: The required setbacks for this RG District are 30 feet front yard and 15 side and rear yards. 'Note—The 1974 plan of land was recorded in Plan Book 290,page 59. It is entitled"A Plan of Land in Barnstable, Mass as Surveyed for Gertrude L.Eaton". 'Note—Smalley vs.Planning Board of Harwich— 10 Mass.App.Ct. 599(1980) -A copy is submitted to the file. 2 , Planning Division-Staff Report sq.ft. and Lot 002 is being increased from 7,687 to 13,705 sq.ft.4 The discrepancy in the area appears to be caused by the discrepancy in the plans between 1974 and 1978. The applicant has requested relief in two forms, a Special Permit in accordance with Section 4-4.2(5) Non- Conforming Lots and a Variance to Section 3-1.3(5) Bulk Regulations to accomplish the altering of a common boundary lines between "existing non-conforming lots". Special Permit Findings: The granting of a Special Permit requires the following finding of facts to be made by the Board: • That the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, • That after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Variance Findings: In consideration for the Variance,the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • Unique conditions exist that affect the locus but not the zoning district in which it is located, • A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant relief, it may wish to consider the following conditions: 1. An Approval Not Required (ANR) plan is to be prepared substantially in accordance with the draft plan for the division presented to the Board entitled"Plan of Land in Barnstable MA,prepared for Robert Gerald Livingston", dated August 13, 2001 except that the ANR plan shall show the existing lots and the area to be transferred. Livingston ,ql 0 Appeal No. 2001-116 and 2001-117 V" Petitioner seeks permission to alter the boundary lines of two existing non- conforming lots under the provisions of Section 4-4.2(5). In the alternative, petitioner seeks a variance in Section 3-1.3(5) bulk regulations to allow the altering of common boundary lines where there are deficiencies in area and set backs. History The property has been in the Kittredge family for many many years and was originally conveyed to Henry Crocker Kittredge by his father, George Lyman Kittredge, the larger parcel having been conveyed on January 5, 1.920 by deed recorded in Book 369 Page 271 and the smaller in 1924 by deed �in Book 406 Page 378. Henry Kittredge conveyed it to himself and his wife, being two parcels, by deed dated March 18, 1963 recorded in Book 1195 Page 163. These two parcels were as shown on a plan later prepared by Gertrude Eaton and recorded in Book 290 Page 59, a copy of which is attached to the petition. In 1978 Gertrude Eaton, the former Gertrude Kittredge, caused the property to be resubdivided by Edward Kelley and approved under the subdivision control law and recorded in Book 329 page 35. This latter configuration is how the property is currently assessed. Thereafter, Gertrude Eaton, on April 16, 1982 conveyed the property to your petitioner by deed in Book 3467 Page 183 describing the land as a single parcel but referring to the plan in Plan Book 290 Page 59 with no reference to the plan i.n Book 329 page 35. A copy is attached to your petitioner. Discussion The petitioner seeks to resubdivide the two lots so that there is a dwelling, barn and shed on lot 1 and a dwelling and garage on lot 2. This results in two parcels that are more nearly like the original parcels in Plan Book 290 page 59 with the exception that the stone wall and driveway are kept wholly within lot 2. The dwelling on lot 1 would remain non-conforming but not more so than before and there would a slight decrease in the setback of the shed. On lot 2 the garage would remain non-conforming other than that there would be no increase in the non-conformity of the parcels. 5 > �J As to the special permit, the zoning ordinance section 4-4.2(5) provides: "Except as otherwise provided herein, lawfully nonconforming lots that are adjoining and held in common ownership, or under the control of the same owner, shall be treated so as to conform so far as possible with the minimum area requirement of the zoning district in which they are located. No lot so merged, or portion thereof, may be changed or transferred in any manner that will increase the degree of nonconformity unless a special permit has first been obtained from the Zoning Board of Appeals. No such special permit may create any additional buildable lot (s)." Therefore, if these lots are merged, there is a specific provision which would allow you to grant a special permit to modify the boundary lines. It is to be argued that by increasing the size of lot 2 it is making it more capable of holding a Title 5 septic system than the small lot and to allow this internal line change between non-conforming lots would fulfill the spirit and intent of the zoning ordinance in that it would promote health and safety and would not represent a substantial detriment to the public good or the neighborhood affected. As to the variance, if it is found necessary, Section 3-1.3(5) Bulk Regulations- The residence currently on the northerly lot does not comply with the building setback line and the shed on the northerly lot does not comply with the building sideline requirements. If you look at the later subdivision plan in Book 329 Page 35 there is also a garage on that lot which does not comply with either the sideline or rear line requirements. Under the proposed plan the residence on the northerly lot would remain in the same location. The shed on the northerly lot would be somewhat closer in its southwesterly corner and the garage on the.southerly side would remain in violation of the sideline set back. Of course, neither lot would comply with the area requirements. Because these properties have existed since long prior to zoning, a unique situation exists which makes it impossible to comply with the zoning. To insist on the location of the property lines in accordance with either of the earlier plans would ignore the traffic patterns and long-standing use patterns of the two properties and would jeopardize the ability of the southerly lot to comply with the current septic requirements. Therefore, to grant the relief requested would improve the ability to comply with Board of Health regulations and more nearly reflect the usage of the property without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance. v .
