Many homeowners who ':e this exemption are unaware that they are assuming the responsibilities.of a supervisor . (see Appendix Q,Rules&R•1' • :ons for Licensing Construction Supervisors,Section 2.15) This lack of awareness.often . results in serious problems,.pa acularly when the homeowner hires unlicensed persons. In thi `case, our Board cannot proceed against the unlicens-.7 person as it would with a licensed Supervisor. The homeowner alcting as Supervisor is ultimately responsible. To ensure that se homeowner is fully aware of his/her responsibilities, many communiti require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a S ervisor. On the last page of this issue is a form currently used by several towns. DEFINITION OF HOMEOWNER: Person(s) who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is intended to be, a one to six family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. " Many Home Owners who se this exemption are unaw, re that they are assuming the responsibilities o . supervisor (see Appe ix Q, Rules and Regulations for Licensing Constructio Supervisors, Sect'on 2.15) . This lack of awarenes\ often results in s= ious problem , particularly when the Home Owner hirè unlicensed persons. In th. = case our Board cannot proceed against the unlicensed person as 't .uld with licensed supervisor. The Home Owner acing as supervisor is . timately responsible. To ensure that the,,Home Owner 's fully ,ware of his/her responsibilities, many communities require, as part of the .ermit application, that the Home Owner certify that heY he derstands the -sponsibilities of a supervisOr. Brush Box 551 Barnstable, Mass. Dear Mr. Brush: The Barnstable Old Ding's Highway Committee has received your letter, has reviewed the property and the original application. We feel that we have bent over backwards originally in allowing a house whose plans were in no way connected with the structure being built to be finished. However, since we do not like to create.hardships, we tried to make the best of a bad job by suggesting changes. Our suggestion now is that you make out a new application for the house which you have, appear before a committee hearing to present your case, and follow the normal procedure from there. (Abide by the decis- ion, or appeal. ) The alternative is to go to court. This would be a long and costly procedure. Yours very truly, Elliott B. MacSwan, chairman ' I. - , ' • . ilt • May 12, 1977 Mr. David Brush Box 551 Barnstable, Ma. --wear Mr. Brush: ,; ,,, ,,, For some time now we have been trying to resolve the issue concerning ,.w the construction of your dwelling on Pine Lane in Barnstable. The • series of correspondence concluded with the letter from the Historical Commission dated November 4, 1976 asking that you make out a new appli- cation for a hearing. To date there has been no response. Chapter 470, The Old King's Highway Regional Historic Act, Section 11, affords you the right to appeal from a decision of the Historical Commiisia . It is apparent that since you have not acknowledged the letter of November 4, 1976, of which the appeal period has lapsed, that it is not your intent to pursue this very important matter. The letter also indicates the Commission's willingness to settle this issue without litigation. Section 12, Enforcement; states that any person who violates any provisions of the Act shall be guilty of a mis- demeanor and upon conviction thereof shall be fined not less than one hundred dollars nor more than five hundred dollars. Mr. Brush, a Building Permit was issued March 3, 1976 and we are now in May of 1977. It had been my hope that an agreement could be reached amicably. However, since it has not, and we do have a law which must be administered, I must request a reply within seven (7) days of receipt of this letter. Failure to comply will cause a complaint to be filed in the Superior Court as set forth in Section 12 of Chapter 470 of the Old Kitig's Highway Regional Historic District. Peace, Joseph D.
