As you know there are currently five'individuals residing at the house. All of these individuals are receiving services from the Department of Developmental Services. It is our intention to create an apartment that would be for exclusive use of our clients. We see it as a wonderful way.to afford greater privacy and an opportunity for supported independent living. As indicated in my earlier correspondence with you, this proposed accessory apartment will be used similar to the group home, consistent with and integral to Latham's educational and vocational purposes set out in its Articles of Organization previously provided to the town departments and as further described below. The apartment is proposed to be lived.in by a couple, who,though developmentally disabled, are able to live with greater independence and autonomy than the residents of the group home. However, Latham's on-site staff will still have the ability to generally oversee the residents of the attached apartment. A goal of Latham's is to assist and educate its folks to live as independently and at the highest functioning levels as possible, given individual circumstances, and an apartment accessory to the group home furthers this educational goal. Mr. Idman indicated that you wanted to have`the name of the individual who will be residing in the apartment. As we have not been able to move forward with the apartment,we felt it unwise to go ahead and plan for a specific individual to reside there. If we are given permission to move forward with this project, we will select from individuals currently receiving services at Latham. As a licensed human service agency we are bound by codes of confidentiality and HIPPA, regulations which prohibit us from sharing client specific information. However, I would be happy to connect with the funding agency that has oversight for the individual so that you can have an independent assurance that the apartment is . being used in the manner we have indicated. Typically there will be three vehicles at the house, specifically the cars of between one and two staff and the house van. None of the individual residents drive. One is the articles of corporation and the other is a description of the educational courses that are being given. Preferably we would hope your client has some sort of brochure that explains what the educational curriculum is. As far as the affordable accessory apartment, these can only be created in "owner occupied" residences. The owner must reside in the property as their primary residence. This property, in my opinion, does not qualify for this because it is not any owner occupied single family. The school may be the owner, have an employee of that school occupy the house, but that does not mean the house is owner occupied. That was never the intent of the accessory affordable apartment ordinance to.a.11ow something like this. The building code, while it does recognize group homes as a single family, all this is addressing is how a building that is a group home is to be built. My purpose in writing to you is two- fold: 1) I would like to confirm with you that Latham's proposed use is allowable in the RF-2 zoning district as an exempt use under the so-called"Dover Amendment" appearing in the second paragraph of G.L. Chapter 40A, Section 3; and 2) I would like to determine whether Latham could, in addition to a group home if so allowed, have a separate, affordable accessory apartment in the dwelling pursuant to Section 9-15 of Barnstable's General Ordinances. 1) I would suggest that Latham proposes a use which is allowed in the RF-2 zoning district because it is exempt from zoning use regulation under the State Zoning Act. To this point, the second paragraph of G.L. Chapter 40A, Section 3 provides in relevant part: No zoning ordinance or by-law shall...prohibit, regulate or restrict the use of land or structures ... by a nonprofit educational corporation;provided, however, that such land or structures may be subject to reasonable regulations concerning the bulk and height of structures and determining yard sizes, lot area, setbacks, open space,parking and building coverage requirements. Latham is recognized as a non-profit organization in the Commonwealth granted IRC 501(c)(3) exemption for federal tax purposes. Further, Latham is approved as a private needs school by the Massachusetts Department of Elementary& Secondary Education, and accredited by the Department of Developmental Services and the Department of Early Education and Care. a . The school serves students ranging from ages 8 to 22 who have coped with troubled histories, have experienced trauma and failed placements, and those living with Prader-Willi Syndrome ("PWS"). PWS is a complex, genetic disorder that manifests with severe, idiosyncratic symptoms, including insatiable appetite, the health implications of which can be serious and inattention life-threatening. Among the other more serious.symptoms are mild to moderate mental retardation, emotional and behavioral problems, obsessive compulsive behaviors such as skin picking and slow body metabolism which can lead to obesity and related health problems. Another of Latham's programs is designed to help young adults make the transition from residential care at the school to more self-sufficient and independent living. Latham has a number of homes throughout the Cape, treated in each respective town as exempt from zoning use regulation under the State Zoning Act, that provide this transitional assistance, integral to Latham's mission. The Barnstable Village property is proposed to be used for such a purpose. Latham's proposed use at the property can best be characterized as a group home,where a group of people with disabilities, unrelated by blood or kinship,will be living together as a single, housekeeping unit under the care and supervision of a sponsoring organization. Though a "group home"is not specifically enumerated as permitted or specially permitted use in the RF-2. zoning district, it would appear to be exempt from zoning use restriction under the above-cited State-Zoning Act provision. Lastly, it appears material that the Y, pp current owner of the property, Hospice, is another non-profit corporation which I understand has used the property for purposes consistent with its institutional mission. . 2) I would suggest that Latham's proposed use of the property constitutes an owner- occupied single-family dwelling use such that a new affordable apartment unit accessory to the main dwelling use may be created at the property under Section 9-15 of the Barnstable General Ordinances. Section 9-15 of the Barnstable General Ordinances authorizes the creation of a new affordable accessory apartment unit accessory to an owner-occupied single-family dwelling, located within or attached to said existing dwelling or within an existing building located on the same lot as the dwelling. Given that Latham would meet other requirements (including a site approval letter, deed restriction and a comprehensive permit) Latham will own and its constituents will occupy the main dwelling as a single housekeeping unit. It also appears that a group home is treated as a single family dwelling use under the State Building Code.
