DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions • of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly • when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption.are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. This Purchase and Sale Agreement is contingent upon the Seller providing the Buyer on or before September 15, 1996, a copy of an inspection. report, including a Certification Statement signed by an approved system inspector of the on-site subsurface sewage disposal system serving the main house and the family apartment cottage building in accordance with the requirements of Title 5 of the Massachusetts Environmental Code and municipal board of health regulations, if applicable. If the Certification Statement states the on-site subsurface sewage disposal system fails as described in Massachusetts Environmental Code, 310 CMR 15, or municipal certification is denied, then the Seller shall repair, upgrade, or replace said subsurface sewage disposal system on or before the date set for closing. If after a good faith effort to obtain all necessary permits for the repair, upgrade, or replacement of said system the Seller is unable to obtain said permits, or the Seller fails to provide said inspection report, on or before August 1, 1996, then, at the Buyer's option, this agreement shall be null and void and all deposits made by the Buyer to the Seller shall be refunded forthwith and the rights of any and all parties pursuant to this Purchase and Sale Agreement shall terminate without further recourse. • 30J. We propose to 1) add approximately 1 8' to rear of existing house for two story living/family room (16'x18') off converted dining room, and single story 12'x12-18' breakfast area off kitchen; 2) relocate deck to rear of new breakfast area and, after removing rotted shed entry and relocating bulkhead to less visible area, add walkway along East side to connect with deck and serve new side door; 4) replace single garage door with split doors and add cupola; and 5) generally, restore traditional appearance by replacing sliding glass doors, old side door and single pane casement windows with true divided light units per plans (mostlly double hung windows) and adding shutters where appropriate. We will reshingle where necessary and repaint trim. The foundation will be of pored concrete extending above grade only as far as necessary to meet code. Construction will be standard frame construction with natural shingle siding and trim widths to match existing structure (4 1/2 " & 5 7/8") except possibly for the breakfast area which may have tight board exterior where not covered by wiindows or doors. The roof over the two story addition will have 12/12 pitch with roofing of asphalt matched as closely as possible to the original gray green and the roof over the breakfast area will be flat of rolled asphalt, surrounded by a small railing. The gable end of the addition will have a salvaged 1920's 7' x 12' multi paned, fan light window. There will be one or two skylights in each side of the pitched roof and in the flat roof and possibly in the front shed roof over the sun room if not too intrusive. None of these are visible from any public way. The chimney will be red brick orange red if possible, chosen to look as traditional as possible. The only change in landscaping will be to relocate a number of bushes (primarily lilac and Rose of Sharon around new addition. There will be extensive retarding of the lawn area in the rear to provide better runoff away from the basement and to provide for a smoother lawn in the direction of Hallet Mill Pond. No restoration _of the barn further to the North is proposed at this time. There is no mention of a living unit. The zoning by-laws of the Town of Barnstable only allow for one single family residence on a .lot.
