Ms. Gail Nightingale also stated that we could add a second story if we did this as others had in our area. I tried to confirm this by telephone to Ms Nightingale, but your office did not return my calls, and an alternate telephone number was not available. My builder and l went to see the Barnstable Building Commissioner last year and proposed a two-story building that was 20' by 36' that would use the footprint area of the current building. He told us that we would have to go to you for final approval. I have had, and still have, some serious physical problems and so,have had to delay my activity in this area, but before we go any further I sincerely need some direction by your Board. I have already spent over $20,000 with the builder, my lawyer, and necessary fees and have nothing. I do not want to spend any more unless I have a reasonable chance for success. The property is located in the Residential F-1 zoning district that permits only one single-family detached dwelling on 1-acre lots. The undersized parcel is developed with two single-family dwellings. The existing structures on the lot I re one-story. The dwelling closest to the roadway is a one-bedroom with 452 sq.ft. of living area. The • back structure to the harbor is a 584 sq.ft. two-bedroom unit. The locations of the buildings do not conform to the required 15-foot side yard setbacks. The lot is only 50 feet wide and:does not have the required 125-foot lot width. The site,is non-conforming in terms of lot size and configuration, and structure setbacks and location with respect to lot width. The proposal of two structures on the lot and its use as a seasonal residence was questioned. The property has the benefit of public water and is connected to the Town's Wastewater Treatment Facility. The applicant is seeking to reconstruct and expand the front one-bedroom dwelling. That structure is located 14.8 feet from the west property line. The initial proposal was to reconstruct the existing structure into a two-bedroom plus a den/bedroom dwelling of 1,534 sq.ft., that would be located 10-feet from the west property line. An elevated 12 by 19 foot outdoor deck area is also being proposed to the north side of the dwelling. The applicant has requested a Special Permit to allow for the intensification of the following non-conformities. • Use, in terms of increase bedrooms from 1 to 3 and in square footage from 452 to 1,534 sq.ft. • The setback intrusion is being increased by 4.8 feet and includes a second story intrusion into that setback where only a one-story intrusion now exists. . The proposal was before the Conservation Commission on October 25, 2001, at which time the Commission expressed concern for the dirt parking area and access area closest to the harbor. An Order of Conditions was issued. The proposal was before Old Kings Highway Historic District Committee (OKH) on July 11, 2001. A Certificate of Appropriateness was issued. • Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 05, 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 7, 2001, and continued to January 09, 2002, February 06, 2002, February 20, 2002, and to March 13, 2002 at which time a motion to grant the special permit did not receive the required votes and the appeal was not granted. Board members deciding this appeal were Daniel M. Creedon, Thomas A. DeRiemer,Jeremy Gilmore, Gail Nightingale and Ron S.Jansson. Attorney David Reid represented the Bates. At the opening of the hearing,Mr. Bates.gave a description of the parcel. He noted that the Bates family purchased the property in 1942. The house to be razed.was built in 1945. The lot is shown on a plan dated October 1947. Members of the board discussed with Attorney Reid the need to establish the pre-existing non- conformity of the house. Mr. Reid noted that the information is contained in the packet he distributed to the Board. He stated that the house to be built would be compatible with the neighborhood, enhance the neighborhood and has the support of abutters. Mr. Reid and the board discussed the setbacks and the two sheds located on the property. Board members expressed concern that there are two detached dwellings on an undersized lot and expressed concern for over intensification of the lot. They also noted that an adjacent lot, similar in size to the lot in issue contains three dwellings in close proximity to each other, and that both such lots are serviced by one private drive. Public comment was requested and no one spoke for or against the proposal. Chairman Jansson noted that there were letters of support from James &.Marjorie Calvin,Joseph&Barbara Snow, William&E. Patricia Gulliver and Charles Grainger submitted to the file. Members of the board discussed with Mr. Reid building the house on the existing footprint and the increase in non-conformity as well as the increase in non-conforming use of the lot. Questions were asked concerning the abandonment of the use of the house nearest to the water as a residential property. Mr. Reid stated that the Bates did not want to abandon the second residential use but would agree to never divide the property or expand the second structure. The hearing was continued to allow the applicant time to devise an alternate plan. At the continuance, Mr. Reid stated that the cottage closest to the street, #93, was the subject of the petition. Mr. Reid gave a history of use of the cottage since 1945 and presented to the board a statement from Nancy and Dave Bates to answer questions raised at an earlier hearing on November 7, 2001. An informational packet was submitted that included a copy of a photo showing the construction of the house by Mrs. Bates uncle. Mr. Reid also submitted figures to illustrate a comparison to abutting lots and an occupancy capacity comparison, and stated that the Bates home will have an occupancy and use less than the surrounding homes. Mr. Reid stated that the access issue raised by the board was not a cause for concern since there had been a small fire this fall and the fire department had no problem with access to the property. The Board asked about the sheds on the property and Mr. Reid stated that it was the Bates intentions to remove the sheds. • Mr. Reid noted that the applicant has received approval from both the Conservation Commission.and the Old Kings Highway Committee. Board members again expressed concern over having two residences on 2 r one lot and that of the access/service driveway. It was noted that this was an intensification of the use of this lot. Findings of Fact: At the hearing of March 13, 2002,the Board proposed the following findings of fact in Appeal 2001-128: 1. In Appeal 2001-128, the applicants are Nancy Allen Bates and Davis R: Bates, Trustees of NAB Nominee Trust. The property is commonly addressed as 93 Salten Point Road, Barnstable MA, and is shown on Assessor's Map 280 as Parcel 018. It is in a Residential F-1 Zoning District and the Aquifer Protection Overlay�District. 2. The applicants have applied for a Special Permit in accordance with Section 4-4, Non- conformities and MGL Chapter 40 A, Section 6, Pre-existing Non-conforming. The applicant proposes to reconstruct and expand a non-conforming single-family dwelling on a non- conforming parcel. The parcel has two dwellings on it and is 0.50-acres in size. 3. The existing structures on the lot are one-story. The front dwelling to the roadway is a one- bedroom of 452 sq.ft. living area. The structure to the harbor is a 584 sq.ft,two-bedroom unit. The locations of the buildings do not conform to the required 15-foot side yard setbacks. The lot. is only 50 feet wide.and is non-conforming with respect to the required 125-foot lot width. 4. The property has the benefits of public water and is connected to the Town's Wastewater Treatment Facility. 5. The proposal is to reconstruct the existing dwelling closest to Sahen Point Rd., into a two- bedroom, plus a den/bedroom dwelling of 1,534 sq.ft. having a footprint of 36 feet by 25 feet. 6. The Conservation Commission issued an Order of Conditions and the Old Kings Highway Historic District Committee has issued a Certificate of Appropriateness. 7. Four letters of support have been entered into the file and there were no objections to the proposal voice at the public hearing. 8. The application falls within a category specifically accepted in the ordinance for a grant of a Special Permit, and that after evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The vote was as follows: AYE: Daniel M. Creedon, Thomas A. DeRiemer and Jeremy Gilmore NAY: Gail Nightingale and Ron S.Jansson Members voting in the negative restated their concerns regarding what they felt was over development on the subject lot given the non-conformity in use of the two dwellings existing on an undersized lot. It was also noted that the dwellings, as well as, neighboring dwellings took their access over the narrow drive located.on the lot. It was felt that to increase building on this lot would represent a substantial detriment to the surrounding neighborhood, due to the over- intensification of use of the existing lot, and that to grant the relief sought would be in derogation of the spirit and intent of the Zoning Ordinance. • 3 i Ya • Decision: A motion was duly made and seconded to grant the appeal with the following conditions: 1. Development of the site shall be substantially as proposed in a plans presented to the Board entitled; • "Site and Sewage Plan- 93 Salten Point Road, Barnstable MA." prepared for Davis Bates, dated 5- Ml, last'revised date of 9-14-01, and • Architectural plans titled"93 Salten Point Road, Barnstable Reef Realty LTD." Drawn by George Russas, and consisting of 5 sheets, Elevation Views, Elevations &Section, Floor Plan &Section, Second Floor Plan,Foundation Plan. The building footprint shall not exceed 25 feet by 36 feet and the deck not more than 12 feet by 19 feet. 2. The site plan is to be modified by removing and the re-vegetation of the "Dirt Parking Area" close to the harbor. The parking and access area is to be relocated between the two buildings located on the property. 3. All sheds located on the property are to be moved to conform to the required setbacks for the district. 4. The lot shall not be divided nor the buildings further expanded hereafter. The front cottage dwelling structure shall be considered accessory to the new primary dwelling. 5. The new structure is limited to no more than three bedrooms and no part of the basement area is to be used for sleeping purposes. The accessory dwelling closest to the harbor is limited to no more than 2 bedrooms. 6. Both,buildings shall be connected to public water supply and the Town's Wastewater Treatment Facility. 7. Development of the site shall comply with the Conservation Commission's Order of Conditions, • OKH Certificate of Appropriateness, and all applicable Building and Health regulations.
