The current exemption for"homeowners"war extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is, or is intended to
be, a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under the building permit: (Section 109.1.1)

HOMEOWNER'S EXEMPTION •
The Code states that "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109.1.1-Licensing of construction;Supervisors);provided that if the homeowner engages a person(s)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption'are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may care t amend and adopt such a form/certification for use in your community.

Background&Review:
The appeal involves the division of a lot with two dwellings into two lots each with its own dwelling upon
it. The division of the parcel is permitted under MGL Chapter 41,Section 81 L and P where two pre-
existing legal dwellings exist that predates the adoption of subdivision control in the Town.
In this particular instance,the existing lot is 1.31-acres located at the intersection of Main Street (Route 6A)
and Scudder Lane in Barnstable. The parcel is addressed as 9 Scudder Lane,and is owned by Edith Squibb,
Natalie Prior and Mark Vonnegut. The first dwelling is a three-bedroom one and one-half-story dwelling of
1,838 sq.ft. of living area. The second dwelling is a two-story,four-bedroom dwelling of 3,120 sq.ft. Both
structures date to the 1800's and are in the Old Kings HighwayHistoric District.
The applicant is seeking to create two lots each with a dwelling upon it. An Approval Not Required (ANR)
Plan prepared under MGL Chapter 41 Section 81 L&P was presented to the Planning Board and signed
on May 19,2003. That plan shows the proposed two new lots. Lot# 1 is a 22,490 sq.ft.lot containing the
3,120 sq.ft.four-bedroom dwelling fronting on both Main Street and Scudder Lane. Lot#2 is 34,000 sq.ft.
containing a 1,838 sq.ft.three-bedroom dwelling and fronts on Scudder Lane only.
Procedural&Hearing Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
August 01,2003. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent
to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 03,2003 and
continued to October 08,2003,at which time the Board found to grant the variance to legalize the two new
lots under zoning. Board Members deciding this appeal were;Richard L.Boy,Randolph Childs,Thomas A.
DeRiemer,Sheila Geiler,and Vice Chairman,Gail Nightingale who was also Acting Chairman.
Attorney Michael D.Ford represented the applicants John and Edith Vonnegut Squibb who were also
present. Mr.Ford cited that Edith Vonnegut Squibb,Natalie Prior and Mark Vonnegut are siblings who
have inherited the property and have determined to divide the lot so that each home is located on its own
separate lot. There is no other outward changes being proposed and the property will remain as it is today
only the lot lines will be imposed.
The Board questioned standing and Mr.Ford stated that he is authorized to represent all of the owners and
will be submitting letters from Natalie Prior and Mark Vonnegut to the file to substantiate that.
Mr.Ford noted that this is not a subdivision,he also noted that years ago,the subject property was two lots
but had been combined and now the owners wish to re-divide the lot. An Approval Not Required Plan had
been signed by the Planning Board and the owners wish to assure there is no outstanding issue with regards
to the lot as being legal under zoning so they are seeking the variances for each of the lots.
Mr.Ford noted that the Board has treated this type of division as a variance issue and he cited the existing
dwellings having been used as individual living residences has existed for years. The location of the
structures and rights authorized for the division justify the granting of the variances. He again noted that
no change of the existing setting is planned and that only the one curb cut on Scudder Lane is to be
maintained. That curb cut shall service both lots.
Public comment was requested and no one spoke in favor or in opposition to the request.
Findings of Fact:
At the hearing of October 08,2003,the Board unanimously made the following findings of fact:
1. Appeal 2003-120 is that of John and Edith Vonnegut Squibb seeking a Variance to Sections 2-3.2 and
3-1.1 (5) Bulk Regulations,Minimum Lot Size,Minimum Lot Width and Minimum Front and Side Yard
Setbacks. The property("Locus") located at 9 Scudder Lane,Barnstable,in the village of Barnstable
and is owned by Edith Squibb,Natalie Prior and Mark Vonnegut,the Applicants.
2. Locus is shown on Town of Barnstable Assessor's Map 258 as Parcel 9 and is located in an RF2 Zoning
District.
3. Locus currently contains 1.31 acres fronting on both Main Street (Route 6A) and Scudder Lane in
Barnstable.
4. Locus currently contains two principal structures on site,both of which date to the 1800's and are
located in the Old King's Highway Historic District.
5. The first building is a 3 bedroom, 1 1/2 story dwelling of 1838sq.ft. of living area,the second is a 2
story,4 bedroom dwelling containing approximately 3,120 sq.ft. of living area.
6. Both structures predated the adoption of subdivision control in the Town of Barnstable and the
Applicant has caused the lot to be divided pursuant to an ANR plan submitted to the Planning Board
under M.G.L.c.41,S81 L and P. The Planning Board endorsed the Plan as Approval Not Required on
May 19,2003.
7. The Division plan shows the property being divided into 2 lots,Lot 1 containing 22,490 sq.ft.,
containing the 4 bedroom dwelling with frontage on both Main Street and Scudder Lane and Lot 2
containing 34,000 sq.ft. on which the 1,838 sq.ft.,3 bedroom dwelling is located. Lot 2 fronts only on
Scudder Lane.
8. The property has been in the Vonnegut Family for over 40 years and the Vonnegut children have
inherited the property from their parents.
9. There will be no changes in the physical appearance of the property,nor any expansion of any of the
structures located on the site as a result of this petition.
10. The only change that will occur with respect to Locus is the ability to divide the ownership of Lots 1
and 2 as shown on the May 19,2003 ANR Plan.
11. The structures on the property are unique in that they both pre-date the subdivision control law in the

Town and have been used for residential purposes.
12. If the relief is not granted the Applicants will suffer a hardship by not being able to benefit from the
provisions of the subdivision control law which allow a division of this parcel as proposed.
13. The relief maybe granted without substantial detriment to the public good or without nullifying or
substantially derogating from the intent or purpose of the zoning ordinance in that no new structures or
development will occur on this property,the only relief being to divide the ownership of the two lots
shown on the plan.
Decision:
Based on the findings of fact,a motion was duly made and seconded to grant the appeal with the following
conditions:
1. Division of the lots shall be as proposed in an Approval Not Required Plan entitled"Plan of Land in
Barnstable ,MA prepared for John&Edith V.Squibb" dated September 30,2002 and drawn by Down
Cape Engineering.Inc.,and signed by the Clerk of the Planning Board,Marlene Weir on May 19,2003.
2. This variance shall be recorded at the Registry of Deeds along with the ANR plan. A reference to this
Zoning Board of Appeals decision shall be added to the ANR Plan.
3. A copy of both the recorded variance and the plan shall be submitted to the Zoning Board of Appeals
file.
4. A letter(s) from Natalie Prior and Mark Vonnegut authorizing this variance relief and the division of the
lot shall be submitted to the file for standing.
5. Access to the lots shall be as it now exists,that is one curb cut off of Scudder Lane as shown on the
plan. There shall be no second curb cut permitted.
The vote was as follows:
