We reviewed the Town of Barnstable Zoning Bylaws, specifically the definition of setback within the Town's Zoning Bylaws. A setback is defined as the distance between a street line and the front building line of a principal building or structure. Based upon this definition of setback, the proposed detached garage structure is set back more than 316 feet from the street line, which far exceeds the minimum setback of 30 feet described within the dimensional regulation for a zoning district RF-1. In addition, the proposed detached garage is set back 16 feet from a side line, which exceeds the minimum setback of 15 feet within the Town of Barnstable Zoning Bylaws. It is our opinion that the proposed structure meets all dimensional setbacks as defined within the Town of Barnstable Zoning Bylaws. If you have any questions, don't hesitate to contact me. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. • To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor.
