Map 259 Parcel 010 was subdivided into :Map 259 Parcel 010, 010.001 & 010.002. Parcel 010 (dev lot 1) is
assigned #144. Parcel 010.001 (dev.lots 2&3) is assigned #180 (NOTE: I had it in as 182 but that appears to be a
typo so I just fixed it as#180. It will show up in your database tomorrow morning as#180). Parcel 010.002 is a
beach parcel and has no road frontage so I haven't assigned a new house number since it is a vacant parcel. Let
me know if you need more on this.

Dear Tom:
Thank you very much for taking the time to meet with us this afternoon. As we
discussed, this correspondence is sent on behalf of our client, Joanne Lyman, Trustee, owner
of the property shown as Lot 1 (hereinafter "Lot 1") on the approval not required plan (the
"ANR Plan") recorded with the Barnstable County Registry of Deeds in Plan Book 618, Page
26, a copy of which is attached as Exhibit A. The purpose of this correspondence is to
confirm that Lot 1 may be considered a legally, pre-existing, non-conforming property to the
requirements of the recently effective R-2C zoning district.
Background — DCPC / 2 Acre Zoning
We were retained by Ms. Lyman this spring in the context of the R-2C zoning proposed
as a part of the Pond Village District of Critical Planning Concern (the "DCPC"). During the
DCPC process, we attended several Town Council hearings on behalf of Ms. Lyman and met
(on several occasions) with Tom Broadrick, Ann Canedy, and the DCPC Neighborhood
Steering Committee Group. At this time, Ms. Lyman owned Lot 1, Lot 2, Lot 3 and Lot 4 as
shown on the ANR Plan as a single lot consisting of over 4 acres, but only approximately 3.8
acres of upland.
On May 3, 2007, when the Charter Objection was made at the Town Council hearing,
the DCPC expired by its statutory terms. As such, on May 4, 2007, Ms. Lyman filed the -'
ANR Plan with the Barnstable Planning Board for a hearing on May 14, 2007. lathe -

the Planning Board endorsed the ANR Plan creating Lot 1, Lot 2, Lot 3 and Lot 4 (which is a
wetland lot). At the Planning Board hearing, we indicated, for the record, Ms. Lyman's
agreement to merge Lots 2 and 3 as shown on the ANR Plan resulting in a vacant lot in excess
of 2 acres of upland. Ms. Lyman's willingness to create a separate lot for her existing house
(i.e., Lot 1) and one, vacant lot of 2 acres (i.e., Lots 2 & 3 combined) was publicly supported
at the Planning Board hearing by Ms. Canedy, as Town Councillor for this district, and by
representatives of the DCPC Steering Committee.
Effective Date of R-2C Zoning District / Creation of Lot 1
Subsequent to the May 14, 2007 Planning Board hearing, we met with Town Attorney
Bob Smith to confirm the effective date of the R-2C zoning. Attorney Smith confirmed that
pursuant to section 2-8 of the Town of Barnstable Charter, that zoning amendments become
effective at the expiration of thirty (30) days after adoption. In this case, the Town Council
voted to impose the R-2C zoning district at its May 10, 2007 workshop meeting. As such, the
effective date .of the R-2C zoning district was June 9, 2007.
On June 7, 2007, prior to the effective date of the R-2C zoning district (and therefore,
prior to the implementation of 2 acre zoning), Ms. Lyman recorded the ANR Plan with the
Barnstable County Registry of Deeds. At the same time, Lots 2 and 3 as shown on the ANR
Plan were conveyed to C. Frederick Rogge, III, Trustee of the Scudder Lane 2007 Realty
Trust (by deed recorded in Book 22089, Page 323). As such, as of June 7, 2007, Lot 1 (which
at that time was a conforming lot with the required 20 feet of frontage and 1 acre of upland)
was held in separate record title from Lots 2 and 3 on the ANR Plan.
Therefore, when the R-2C zoning went into effect on June 9, 2007, Lot 1 became a
legally, pre-existing, non-conforming lot and was held in separate record title ownership from
adjoining land. At the same time, lots 2 and 3, which are held in common ownership, merged
for the purposes of zoning into a single, conforming lot in excess of 2 acres of upland.
Conclusion
Because Lot 1 conformed to the minimum area, frontage and width requirements of the
zoning district at the time of its creation on June 7, 2007, and because it was held in separate
record title ownership from any contiguous land at that time, it is our belief that, as of June 9,
2007 when the R-2C zoning district became effective, Lot 1 became a legally, pre-existing,
non-conforming lot. We would request that you kindly confirm your agreement with this
analysis by countersigning this correspondence as indicated below and returning a counter-
signed copy to us for our files.
