There have been several occasions over the last couple years where eithefnoise/music and/or traffic onto the property has been noted and commented upon. These activities were confirmed by one of the abutting neighbors on June 12,2008. A man came to the door of Diane Gooch, 211-Scudder Lane, looking for the Thompson houses; she directed him, and he invited her and a visiting friend to join him at a party there. Their accounts are attached, evidently of a cocktail party and dinner for some 200 people attending an oil industry conference. We think that this type of commercial rental is not allowed without a zoning variance, and ask that it cease. _ Sincerely. She's a bit more dramatic, but the idea is there: I would state my concerns as the following: 1. The property is advertised for rental with'2 houses and 2 guest houses. There.a-re more buildings there and it is not clear how they are being utilized. All of them look as if they have the capacity for sleeping- I don't know whether with plumbing or not. It would be interesting to find out exactly how many buildings are on the property, how are they coded for use and whether that is.how they are being used. The garage is the perfect example. 2.To rent out the property for family is completely legal. and in this case, there were 6 people actually staying at the houses. When the property is used also as a venue for a dinner- what , are the regulations and what are the numbers that may be there and meet safety regulations. In this case, approximately 200 people were attending the cocktail/dinner as a closure .to a conference. Buses or vans were being used to transport the people from the hotel to the house. What defines commercial versus a .family rental and use? This is not the only time these numbers have been there, what `does that imply for rental use. 3: The concerns for meeting safety regulations with those large numbers whether for sewage or fire not just for the Thompson property,. but also for the neighboring houses. These are my main three comments/concerns. I am in New Hampshire until this coming Wed., but let me know what else I might be able to do to help with this. Thank you for doing all of this. The above referenced parcels are the subject of Variance 1995-52 issued to the Thompsons on May 31, . 1995. The variance was to minimum lot frontage and allowed for the division of the land into two parcels. The variance was conditioned as per plan entitled, "Plan of Land in Barnstable Mass. prepared for Jane Thompson dated January 2, 1995 as revised on May 11, 1995", and contained the standard notation that the decision must be recorded at the Registry Deeds. The referenced plan for the division was recorded in plan book 516 page 33,however I was not able to find a copy of the recorded Zoning Board of Appeals decision granting the variance for the division of a lot. In November of 2003 an Approval Not Required(ANR)plan was presented and signed by the Planning Board. That plan proposed reconfiguration of the two subject lots different from that conditioned by the 1995 variance. Although signed by the Planning Board,I did not find that ANR plan recorded at the Registry of Deeds. In April of 2004,the Conservation Commission issued an order of conditions with regards to expansion of an accessory building, apparently initially built sometime between 1995 and 2004. The accessory building may or may not have had a building permit, and the plan before the Commission was to further expand that building. The location of the accessory structure is on the existing lot line as per the 1995 plan. The 2003 ANR plan would correct that infringement. With regards to the above situation,my concerns are that without proper documentation concerning the creation of a lot, issues could arise in the future that may create a serious zoning problem with respect to both lots. Five years ago she built a new house, replacing one that had burned down. The Certificate was granted, excluding the sheds. 1 was directed to file a separate Notice of Intent. The Conservation Commission passed the NOI with the conditions that permits are filed with the Building Department and Board of Health. I have requested that Down Cape Engineers add two"bedrooms"to a second septic system that they are designing for the new garage. Down Cape is currently proceeding with those plans. The location of the building is at the 15' offset to my property and is on fill and higher ground that gives it a 10' higher elevation. This will result in roofline that is 27' above my property. A Public Hearing before the Zoning Board of Appeals was duly advertised and notices sent To all abutters In accordance with MGL Chapter 40A. The hearing was opened on May 03, 1994 and continued to May 17,1995.at which time the Board found to grant the appeal with conditions. Board members hearing the appeal were;Ron Janson,Richard Boy,Emmett Glynn,Gene Burman and Chairman Gall Nightingale, Attorney Daniel Fern represented the petitioners. He noted that the Thompson's have owned the parcel for about 50 years and later purchased a neighboring lots upon whloh a home once stood. That dwelling was destroyed and not rebuilt. Over time,the lot became merged with the original lot for the purposes of zoning given that it did not most The requirements of frontage. At that time there was only one access to both parcels and that access remains the only frontage for the entire lot. There is no way to enlarge the access to Scudder's Lane,it was 12.12 feet and remains that width today. The Board questioned the access and it was noted that In the past emergency vehicles were able to conveniently access the buildings and structures located on the lot with the existing dirt pathway. Finding of Facts: Based upon the testimony given during the public hearing on this appeal,the Board unanimously found the following findings of fads: 1. The property at Issue Is boated a"8ouddeft Lane In Barnstable Village In an RF-1 Zoning District requiring one acre of buildable upland and 150 feet of frontage. 2. The current configuration of the lot has only 12.12 feet of frontage along 8arddees Lane as shown on the plan thled"Plan of Land In Barnstable,MA prepared for Jane Thompson' dated January 2,1095,and last revised dated May 11,1995. 3. The overall area of this lot Is approximately 7 awn and Is bounded on the north by Barnstable Harbor with significant frontage on to the harbor. 4. The primary dwelling on the lot has been there prior to the adoption of zoning, 1950. At one time a second neighboring lot was purchased. The second lot was added to the primary lot when,In the 1980's,the dwelling on the second lot was destroyed by fire and not rebuilt. For the purposes of zoning the second lot was merged into the primary lot for lack of compliance with the requirements of the ordinance. Those two Icts had merged as a result of common ownership. . 5. Owing to the topography of this particular lot,being sloped as well as Its overall shape and configuration,these conditions are unique to this area which lends to the hardship for which relief Is being sought. 0.
