As of February 28, 1985, the minimum lot size requirement changed to one acre. It is now an RF-1 District, with the following minimums: lot size: one acre; lot frontage; 20 ft; lot width: 125 ft; front setback: 30 ft; side setback: 15 ft; and rear setback: 15 ft. As to the question of common ownership at the time of the . zoning change on February 28, 1985, the Certificates of Title show that there was none related to the locus. Lots 97, 100, and 101 (locus) were owned by O'Dea; Lots 96 and 97 (north of locus) were owned by the Bassetts; Lots 93 and 95 were owned by the Bassetts (these lots do not actually touch locus in any event) ; and Lots 98 and 99 were owned by the Verrills. The Variance was granted to Margaret. 0. Verrill. The Variance, however, implies that both Lots 5 and 6 were owned by the Petitioner, because she applied for relief on both lots. In any event, the Variance was approved, and seems to imply . that the intent was that the lot line could be changed to cure the building encroachment, and that Lot 5 .(locus) was to. remain a buildable lot. It appears that use of the Variance was exercised within one year of the Decision, because the plan changing the lot line (Land Court Plan 17933L) was filed with the Land Court on January 5; 1989, and Lot 222 (locus) was conveyed to the Turners on Lipman, Drummond & Freeman Mr. Ralph M. Based on this, you told me verbally that Town Attorney Robert Smith rendered the opinion that the lot in question, by virtue of the Variance and the exercise of the Variance within one year, is a buildable lot under zoning.
