I received the report prepared by the Planning Department dated 2-21-02. Included with the report is a letter prepared by Stephen Seymour of the DPW. Following are comments regarding both missives. The Planning Department is mistaken on several points: U Flint Rock Road is an Ancient Way. This places it within the scope of Section 81-L definition of a way "a way in existence when the subdivision control law was created", etc. Please note the following documents that describe the way prior to the adoption of the Subdivision Control Law in 1960 and the Board of Survey in 1902: 1828 Deed from Sears Hallet to Mathew Cobb, Book 1, page 22 1834 Deed from Oris Bacon to Polly Tobey, Book 17, Page 17 U The way has always been adequate for the use of the property, and will continue to be adequate until the use is changed. No change of use is being applied for, therefore the way will continue to be adequate. When a change of use is applied for, the adequacy of the way may be reviewed. U The Town has recognized the way in a number of circumstances. Book 373, Paqe 30, the Fire Training School lot was subdivided from the remainder of the Cobb Lot using Flint Rock Road as vital frontage. This lot is adjacent to the Locus lot and is identical in standing. This plan was prepared by The Town of Barnstable DPW. Book 463, page 8, the Independence Park Master Plan. Lot 12 was subdivided from the remainder of the sub-divider's land using Flint Rock Road as vital frontage. This lot is adjacent to the locus lot and is identical in standing. The Planning Department's comment regarding Lot 12 may be said also of the Locus Lot, "assumptions should not be made as to it's potential development" The Town of Barnstable changed the name of 'Flint Rock Road' to 'South Flint Rock Road' in 1995, see Book 9583, Page 85. The Town of Barnstable paved a portion of Flint Rock Road from Mary Dunn Road to the Fire Training School around 1966, after appropriating money at Town Meeting. Aerial photographs from May, 1968 (on file in the DPW Department) show that the portion of road from the Fire Training School to the location of the present Breeds Hill Road was widened to it's present width at this time as well. The paved portion of the road was resurfaced around 1995. flint rock.doc • The letter from Mr. Seymour is not pertinent to this hearing in that no change of use is states, a s required, "No determination as to compliance with proposed. The plan clearly q , the Zoning Ordinance has been made or intended by the above endorsement" The Planning Board's requirement that this statement be on the plan is a strong indication that the zoning issues that Mr. Seymour alludes to are not under consideration. The Report by the Planning Department and the letter from Mr. Seymour are misleading- to the Planning Board. The Board deserves to have credible facts on which to form decisions.
