ANDERSON Regional Environmental Engineer March 17, 1981 Barbara Anderlot RE: BARNSTABLE--Wetlands -- File No. SE 3-671 84 Stonehedge Drive Barnstable, Massachusetts 02630 Dear Ms. Anderlot: Following an in-depth review of the above--referenced file and in accordance with Massachusetts General Laws, Chapter .131, Section 40, the Department of Environmental Quality Engineering has approved the proposed project and has issued the enclosed Superseding Order of Conditions. The Department has determined that the project is significant to the prevention of pollution, flood control and storm damage prevention. The Department has determined that the wetland boundary, 13 feet MSL, is correctly delineated in the submitted plans, A significant percentage (greater than 50 per cent) of the existing vegetation above the .13 feet EL consists of upland plants. Some wooded swamp species (i.e. red maple and high bush. blueberry) are present;however, they do not account for the majority of ground cover in the area, The proposed project is limited to the uplands and shall have a:negligible impact on the bordering wetland. The leaching pit shall be placed in pervious material, below the clay layer, and is consistant with: Title 5. Compliance with. Title 5 assures the prevention of breakout and subsequent drainage of effluent_overland, Through.Title. 5._requi.rements � and the enclosed conditions the interest of prevention of pollution is protected. Although the property borders .a wetland the area of construction is above the 100 year flood zone and thus will not increase flooding to adjacent property. Since no contour changes are proposed or permitted the property's potential capacity for flood storage will not be deminished. It is thus the Department's opinion that the flood storage capacity and drainage characteristics of the area will not be significantly altered by the proposed project. - The enclosed Superseding Order of Conditions adequately protects the interests of flood control and storm damage prevention by limiting the work area, prohibiting the use of fill and reduction of flood storage capacity, requiring revegetation of disturbed areas, and by minimizing adverse effects from road and roof runoff. 4 � r w -2, In the opinion of the Department, p p t, the reasons given here are sufficient to justify this Superseding Order of Conditions. However, the Department reserves the right, should there be further proceedings in this case, to raise additional issues and present further evidence as may be appropriate.
