Good Afternoon Robin,
I spoke with you earlier today regarding my complaint towards the Berry's fence, additional pool
house and retaining wall. I wanted to write to you to make my complaint official and to provide
you with information and evidence supporting my issues.
I have included in this email an attachment which details my findings and begins to break down
the lack of okh policy being enforced against the Berrys.
The reason we chose to live in this area was because of the Historic District, and that there are
regulations in place to prevent unsightly and unauthorized changes.
We have tried to communicate with the Berrys and have received nothing but empty promises
from them.
I will be sending you several emails with attached photos supporting our claims.

Section I -Purpose
"The purpose of this Act is to promote ... the preservation and protection of buildings, settings and
places ... and through the development and maintenance of appropriate settings and the exterior
appearance of such buildings and places, so as to preserve ... historic, cultural, literary and aesthetic
tradition... "
Section 6—Limitations
No building, structure or part thereof, except as hereinafter provided, shall be erected within the
District unless and until an application for a certificate of appropriateness as to the exterior architectural

The Berry's— residing at 108 Stonehedge,Barnstable,MA—did apply and received a Certificate
of Exemption on or around 6/8/2011 for a 1Ox12 shed to be built; as noted in meeting summary of OKH
on 6/8/2011. However there was no building permit posted during their construction period; and it .
should be researched to see if one was actually pulled.
Section 3.00—Excluded and Exempt Features andActivites:
General-
There are a number of activities and features, which have been excluded or exempted under the Historic
District Act. Excluded features or activities do not require Certificate of Appropriateness from the Town
Committee Exempted features and activities require a`Certificate of Exemption, which may be obtained

The Commission has established the following list of features as eligible for a Certificate of Exemption:
(a.) Fences: Wooden fences, not higher Tian 4 feet, may be allowed, as an exempt item, if appropriate
for the site and associated structure,provided the finished side of the fence faces out from the fenced area, in
the following styles:
LSplit, half round or round post&rail in natural(unpainted)finish.
2.Square rail in white or natural(unpainted)finish.
3.Vertical picket in white finish or natural(unpainted)finish.
4.Vertical flat board with cap rail 4-6 inches wide in natural or white Finish.

The Berry's never applied for a certificate or permit to build their fence.When I called Old Kings
Highway to discuss this with MaryLou,she informed me that the Berry's informed her that their new
fence was replacing their existing one,"like for like,"and was to be placed in the exact same location as
their previous one.This was the reason that I was given from MaryLou that they did not need a certificate
from OKH to build their new fence.
In actuality,the Berry's new fence is much larger in perimeter than their previous existing fence.
1. They had to backfill their yard with numerous truck loads of dirt to level their new site to meet the.
needs of their new fence.
2. They changed the topography of their yard without OKH approval.
3. They did not get approval from any of their abutters for any of this work.
4. As it states above,a fence could be approved for a certificate of exemption if it was no more than 4
feet high,and the Berry's fence is 6 feet in height.
5. Since their new fence resided on higher ground that they made,it brought forth a much steeper
retaining slope/elevation that separated our property with theirs.Initially this area was only filled
with dirt.After many rainy days and a lot of wash outs onto our property,we approached the
Berry's and asked them if they were planning to put in a retaining wall.The Berrys stated they
were having"retaining mulch" brought in soon.
6. The"retaining mulch"was brought in and it did nothing to help with the wash out except just
provide the rain with something more to leave on our lawn.
7. After showing the Berrys that their mulch wasn't working we asked them to please put in some
type of retaining wall.
8. One Saturday afternoon Matthew Berry and his father installed the current retaining wall.The
current retaining wall is made of timber and is 4 timbers.As you can see from current photos it
was not buried in the ground,it was not installed high enough,and it is not adequate enough to
withstand the force of the fence and dirt hill/elevation.
9. We have many complaints about the fence work from the Berry's other abutters,as well as other
neighbors that do feel it is an "eye-sore"and does not fit in with the neighborhood.Everyone in
the surrounding area is not happy with this construction and lack of consideration and
communication.
g.)Sheds:A single wooden shed may be allowed, as an exempt item for residential use, if appropriate
for site and associated structures, and if meeting the following criteria:
a. SIZE-No more than 120 square feet in floor area and no more than 12 feet in height to ridge line.
b. ROOF PITCH-The roof must have at least a 7112 pitch. The roof must rise at least 7 inches for every 12
inches of run or match the roof pitch of the existing house.
c. ROOF MATERIAL Asphalt or wood shingles. If asphalt shingles are used, they should match the roof color of
the house.

This is what the Berrys actually received their Certificate of Exemption for; I do want to make
sure that you are aware their construction is not a shed but in fact a pool house/pool bar.In addition,their
pool house has been unfinished and under construction for almost a year.
Section 4:02:Enforcement:
(a.) The Town Building Inspector is responsible for enforcing the Historic District Act. The law
states that "no permit shall be issued by the local building inspector for any building or structure to be
erected, removed or demolished within the District unless the application for said permit shall be
accompanied by a Certificate of Appropriateness, Certificate for Removal or Demolition, or
Certificate of Exemption."(See Section 6 of the Act). The law further states that the building inspector
of the affected town shall have the 'power and duty"to enforce the provisions of this law. For these
reasons all violations should be promptly reported to the local building inspector's office for proper
enforcement action. While the local building inspectors are specifically charged with the responsibility
for enforcing the Act, any person who observes a violation may seek a criminal complaint against the
violator(s). Any person who violates any provision of the Historic District Act is guilty of a
misdemeanor and in 1974 the Massachusetts Supreme Judicial Court ruled that even though the
Legislature may have imposed the duty to prosecute violations on a particular public official--in that
case a health agent--anyone who is competent to give oath may seek a criminal complaint in the local
District Court. (See: Commonwealth v Haddad, 364 Mass. 795, 308 NE2d 899 (1974. Therefore, if a
citizen feels strongly about a violation, he may seek direct action against the violator(s) by going to the
Magistrate's office of the local District Court. The Commission recommends that all violations be
brought to the local building inspector's office for enforcement. If criminal action is to be initiated, the
complainant should obtain competent legal advice and discuss the matter with members of the local
District Attorney's office.
4:04:Proof of Trolations:
Any person suspecting a violation of the Historic District Act should take steps to properly document the
violation and be prepared to testes as a witness. The following information and material will be helpful in
supporting any enforcement action:
(a.) Statement of Facts.A brief written statement outlining the alleged violation should be submitted
to the local building inspector's office and a copy retained by the complainant. The statement should include the
following information:
0.)Location of the violation including street address and assessors'map number.
Oi.) Type of violation-describing the specific section of the Historic District Act that is being
violated and indicating whether the violation involves construction or demolition.
�(iii) The name(s) and addressees) of the violators. This should include the owner, builder,
machinery operators and other persons participating in the work.
(iv.) Name and address of the person reporting the violation.
(v) List of possible witnesses and names and addresses of any persons
observing the violation.
(b) Photographs: Photographs of the work in progress with sufficient detail so as to identify the
extent of the violation and the person doing the work. The date, time and location of the photograph should be
written on the back of each photograph along with the name(s) and address(es) of the photographers.
SECTION 12-Enforcement
Any person who violates any provision of this Act shall be guilty of a misdemeanor and upon
conviction thereof shall be fined not less than One Hundred Dollars ($100.00) nor more than Five Hundred
Dollars ($500.00). Each day of violation of this Act shall constitute a separate violation.
The building inspector in the affected town shall have the power and duty to enforce the
provisions of this Act.
A.AREAS OF GENERAL RESPONSIBILITY.
It shall be the duty and responsibility of the applicant to file a fully completed application (sec Paragraph 7
below) including an accurate list of all abutters with their permanent mailing addresses.Applications shall
include exterior plans and details as well as any related information and material that will assist the Committee
in determining, the appropriateness of the project. Incomplete filings may be a basis for denial of the
application.Any application approved without all'abutters berngnot fed may be legally void even work lia
started.
The Berrys did not notify any of their abutters nor did they get approval from them. Both of their
abutters, residing on White Moor Way and Stonehedge are not satisfied with the lack of communication
from the Berrys and the lack of discipline brought forth on the Berrys from the OKH.

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or less and
to allow homeowners to engage an individual for hire who does not possess a license,provided that the owner acts as
su ervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to
be, a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a homeowner. Such
"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be
responsible for all such work performed under the building permit. (Section 109.1.1)

Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the
State Building Code Section 127.0 Construction Control.
HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions
of this section(Section 109.1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such
work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,
Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly
when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed
Supervisor. The homeowner acting as Supervisor is ultimately responsible.
To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,
that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by
several towns. You may care t amend and adopt such a form/certification for use in your community.
