Filed August 25. 1995; Public Hearing October 18, 1995, Decision Due November 23, 1995 Background: The locus of this appeal is a landlocked lot just north of Route 6A near Stoney Point Road in Cummaquid. The area is generally residential in nature and it is a mixture of 1/2 acre to 7 acre lots. This locus is in an RF-2 zoning District where the principal permitted use is single family dwelling. According to the Topographic Plan submitted by Schofield Brothers of N.E., Inc.,dated August 22, 1995,there is already an existing outhouse and remains of an old barn on lot#4(parcel#92)but there is no dwelling located on the plan. The Applicant is seeking a Variance from Section 4-1.1 to relocate a 20+/-year old portable 8'x 16'wood frame garden shed from Developers Lot#3(parcel#91)to adjacent Developers Lot#4(parcel #92). Staff has been informed that this structure has already been moved and that the relocation and associated land clearing activities has prompted the Building Commissioner's Office to take action. The activity was undertaken by the applicant without proper permits, including Old Kings Highway Historic District approval, Conservation Commission,Zoning Board of Appeals and Building permit. The Building Commissioner's order has instructed the applicant to seek the necessary permits(see letter of August 08, 1995). Department Concerns: The Zoning Board of Appeals is being requested in this appeal to grant a Variance fro Section 4-1.1 -Accessory Uses/Where Permitted -to permit accessory structures and uses to occur on the lot ,'t a no principal use has been established. What is the principal use of the Lot? The lot is land locked and it appears that no access is provided. If an easement exists that provides access to the lot in question (parcel#92), the applicant should be prepared to supply the Board and file with a copy of that easement and to address the issue of access for emergency vehicles. The Board may wish to request a letter from the owners of parcel#91 (owned by the McMahon's according to the Assessors records) stating permission to move the shed. The Applicant has been before Old Kings Highway Regional Historic District Committee and was denied a certificate of Appropriateness on October 04, 1995. The application is still pending before the Conservation Commission. Variance: In consideration for the variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. For your information, a Town of Bamstable Conservation Commission hearing scheduled for September 26, 1995 was cancelled on that date for lack of a quorum and rescheduled for October 31, 1995. If your board desired to wait until the Conservation Commission hearing of October 31, 1995 and continue the October 18, 1995 hearing until perhaps November 1, 1995, then we would try to personally attend both hearings. We are assisting with Mr. Libby's obligation for compliance with the Conservation Commission • requirement for a Notice of Intent with site plans delineating the existing conditions, wetland boundaries, topography, altered areas and proposed shed location. Libby 1940 N.Y.S. Rt.. 80 New Woodstock,NY 13122 Tel. (315) 662-7961 John was born on 1/15/31 at Cape Cod Hospital in Hyannis, MA. In 1941 at 10 years of age his family moved from Harvey Avenue in Common Fields (Barnstable) to Route 6A in Cummaquid. John was the oldest of four children of Charles & Grace Libby. John and his family named their five acres Hoj-Poj Farm and had chickens, goats, sheep, ducks, geese and a pony and horse, as well as a family cow and pigs, over the years. They also grew strawberries, raspberries, asparagus, blueberries, grapes, potatoes and corn, the excess of which was sold at a drive-in stand on Route 6A. John's mother, Grace, was well known for her jams,jellies, pickles and relishes, canned clams and fish, which was sold at the stand and also at exclusive shops in Boston as well as by mail order. Being a farm and fishing family, John's Dad, Charlie, loved the sea and was well known for his fish fries and clam boils, and John was active in 4-H having poultry projects, sheep, and goats, and in 1948 was named state winner in the 4-H Tractor Maintenance project, the award for which was a week-long rewarding experience of attending the National 4-H Club Congress in Chicago. John graduated from Barnstable High School in 1948, enrolled in Stockbridge School of Agriculture at the University of Massachusetts at Amherst and, after one year, switched to the four-year program, graduating in 1953 from the University of Massachusetts at Amherst with a B.S. degree in Agriculture. John and Irene were married in 1951. Irene was also born at Cape Cod Hospital, on 6/30/32, and grew up on Mt. Pleasant Farm in Sandwich, which was a Guernsey dairy farm owned by her family, Henry and Annie Govone being her parents. Her Uncle Jim and Aunt Gladys later became Eastern States Farmers Exchange Agents for Cape Cod and lived in Forestdale, where Gladys was the Postmaster for many years. After graduating from the University of Massachusetts in 1953 John spent two years in the U.S. Army, spending one year in Germany with the 6th Armored Cavalry patrolling the border between the Allied occupied area and the Russian occupied area. After discharge from the U.S. Army in 1955, John and Irene moved to Pine Plains, NY, about 30 miles northeast of Poughkeepsie, where John was the Assistant Manager of a 1000 acre Dairy and Crop farm known as "The Hedge". In 1959, John applied for a position with the Doane Agricultural Service of St. Louis, MO, and was assigned to their Eastern office in Doylestown, PA, where he was trained as a Real Property appraiser. John was assigned to a two year county-wide revaluation project in Orleans County,NY, where, as one of the appraisers, he appraised farms, homes, seasonal residences, commercial and industrial properties. After completing the revaluation John applied to and was hired by Orleans County as their first County Director of Property Assessments. After spending three years and three months in rural Orleans County, John was hired in 1965 by Agway, Inc. in Syracuse, NY, to be their Director of Real Estate and over the next 27 John E. & Irene R. Libby Page 2 years supervised a staff of five who purchased, sold, leased, assessed and kept track of deeds, title reports, surveys, and leases involved with approximately 1000 properties that Agway owned or leased in 12 states of the Northeast, as well as plants in Florida, Texas, California, Oregon, Washington, Ohio, North Dakota and Indiana. John retired in 1992, but continues to work as a consultant for Agway, Inc. For approximately 15 years (1947-1962) John's father and mother were agents for the Massachusetts Farm Bureau Association, a local Farm Cooperative, and sold feed, seed, fertilizer, lime and farm supplies from the barn located behind the house on Route 6A. They were also very active in the Massachusetts Farm Bureau for many years, serving as officers during that time. In 1962, John's Dad passed away and in 1972 John's mother sold the Homestead consisting of the house, a large barn, a two-car garage and .87 acres of land fronting on Route 6A and moved to a new home built on the north end of the Hoj-Poj Farm's five acres. The property was accepted as a subdivision by the Town of Barnstable on 8/2/76 and the plan is recorded at the Barnstable Registry of Deeds in Plan Book 258, Page 17. Over the years, 1953 to present, John, Irene and their three children and six grandchildren have come to the Cape several times a year to visit friends and relatives, and to enjoy the Cape, which is "Home". After Grace's passing in 1985, her "new house" on Lot#1 was sold in 1989. In 1995 (February) Lot #3 was sold and, despite efforts to sell Lot #4 along with Lot #3 which failed, it was decided that John and Irene would acquire Lot #4 from his two sisters and brother. This deed was passed in April, 1995. A portable 8' x 16' garden shed located on Lot #3 was not sold and it was decided to move it to Lot #4 as it provided storage for tools, chairs and benches, etc., for keeping brush, weeds and grass cleared from a small portion of Lots #2 & #3 over the past 30+years. Lot #4 had never been kept open for the past 35 years and was so overgrown that it was impenetrable. Attempts over the past several years to cut a path from Lot #3 to Lot #4 were not successful. A five-foot "Bush Hog" mower on a 40 H.P. tractor could not even handle the job. Facing a deadline of August 31, 1995 to have this shed moved off Lot #3, a bulldozer was rented from a local machinery dealer. The matter of having a permit to remove overgrown vegetation from former farm land did not come to John's mind. This area in John's boyhood was a site for a 30' x 40', 1 1/2 story barn with two attached shed structures that he and his Dad built, as well as a site for blueberry bushes, raspberries and fruit trees long since eliminated by the wild grape vines, bullbriars, poison ivy, choke cherry trees and multiflora rose. Using this rented dozer, John cleared the old farm road (vehicle tracks on subdivision plan) on Lot #3 and an approximate 100' x 100' area on Lot #4, being careful to leave the dozen or so mature, healthy trees - maple, ash, wild cherry and nut - standing within this area. He was also careful not to enter the Cape Cod Mosquito Control ditch that traverses the property. Subsequent inspection by CCMC officials confirmed they had not touched this ditch in over 15 years and now they could at least get to a portion of it that was heretofore inaccessible. Being very aware that Lot #4 is shown as "not a buildable lot" on the subdivision plan of 8/2/76, our past and present plans have not been to build any structures on the property, but } John E. & Irene R. Libby Page 3 rather to have a place to "come home to" each summer using our fully self-contained motor home, a 9 1/2' Coachman slide-in Pick-up camper. Thanks to some very wonderful neighbors, vandalism to the garden shed has only occurred once during the approximately 20 years it has been located on Lot #3. It is also interesting to note that this "portable" garden shed is assessed for $400.00 by the Town Assessor. Our plans to date have been to plant blueberry bushes and raspberries where they did so well approximately 40 years ago and mow the small cleared area (100' x 100' - the total Lot #4 is approximately 120' x 200') at least once a year to keep the wild vegetation from taking over in the relatively near future. A 7.5 H.P. Gravelly tractor mower will be kept in the shed to help with this task. After being unsuccessful in contacting engineer Ed Kelly, who did the percolation tests on Lots #2 & #3 in 1981, I contacted Schofield Brothers, who did the surveying and subdivision plan accepted by the Town in 1976. Engineer Bob Perry responded immediately and on Friday, August 4, 1995, visited the site for approximately two hours preparatory to giving me a proposal for site plan engineering verbally requested by Barnstable Conservation Commission Administrator Gatewood when he visited the site on 8/2/95. Mr. Perry advised me that he would be in contact with Mr. Gatewood A.S.A.P. to advise him of his involvement and findings to date in the matter.
