ZONING BOARD OF APPEALS '90 [IXf _Q1 1 a -17 VARIANCE DECISION AND NOTICE PETITION: 1990-20 PETITIONER: TIMOTHY AND PEYTON WILLMAN At a regularly scheduled hearing of the Barnstable Zoning Board of Appeals , held on April 26, 1990, notice of which. was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts , the petitioners , Timothy and Peyton Willman, through Attorney Susan Merritt-Glenney, petitioned the Board for a Variance from Section 3- 1 . 1 (5) of the Zoning Bylaw to allow them to construct a single-family dwelling on an undersized lot containing 39,460 sq. ft . The petitioner' s property is located on Sturgis Lane, Barnstable, MA and is shown on Assessors' Map 278 as lot 36. It is in the Residential F-2 Zoning District. The lot in question was originally part of a parcel acquired by Willman Electric in 1972 and was later subdivided into ten ( 10) lots in 1973 . The lot complied with the minimum lot size requirement of 20, 000 sq. ft. at the time of its creation. However, in 1977 the minimum lot size was changed to 43 ,560 sq. ft. Attorney Glenney discussed the topographical features of the lot and she stated that the lot is bounded on one side by raiiroad tracks . A plan by Down Cape Engineering, dated July 7 , 1989 was submitted to the file. The plan shows the proposed dwelling and the topography of the lot. The petitioners plan to build a two-story dwelling on the lot. The dwelling will contain 2,715 sq. ft. of gross floor area and a 720 sq. ft. attached garage. Five letters of support from neighbors and abuttors are in the Zoning Board of Appeals file. < " BOOK718i PAGE 043 V' FINDINGS OF FACT: Based on the information presented , the Zoning Board of Appeals made the following findings of fact : 1 . Variance conditions exist , pursuant to MGL Chapter 40A , Section 10 , due to substantial grade variations which are unique to the lot ; and 2 .
