In Appeal 2014-047,James and Deborah Mangan sought to construct a family apartment of no more than 1,200 square foot in a new addition to a single-family dwelling in Barnstable Village. The subject property is a.8 acre lot with 160 feet of frontage on Sturgis Lane,a cul-de-sac and._private way. The property was currently improved with a 4,260 gross sq.ft(2,184 sq.ft living area),four-bedroom dwelling constructed in 1984. The lot is served by public water and an on-site septic system. The family apartment was proposed on first floor of an addition on the eastern side of the existing dwelling. Procedural&Hearing.Summary Special Permit No.2014-047,a request by James and Deborah Mangan to construct a family apartment not to exceed 1,200 sq.ft at 28 Sturgis Lane, Barnstable was filed at the Town Clerk's Office and the Zoning Board of Appeals office on September 17,2014. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened October 22,2014,at which time the Board found to grant the request subject to conditions. Board members deciding this appeal were Craig G.Larson, Brian Florence,Alex M. Rodolakis,George T.Zevitas and David A.Hirsch. Steve Cook of Cotuit Bay Design represented the Petitioners before the Board. He presented the plans for the proposed apartment,discussing the design and site constraints. Mr.Cook confirmed the apartment would be located on the first floor of the dwelling. He clarified that access to the basement would be provided through the existing house, not the family apartment. Mr.Cook confirmed that the septic system:would be updated. The Board Chair requested public comment and no one spoke in favor or in opposition to the proposal. Findings of Fact At the October 22,2014 hearing,the Board unanimously made the following findings of fact for Appeal 2014-047,a request by James and Deborah Mangan to create family apartment not to exceed 1,200 square feet at 28 Sturgis Lane, Barnstable: 1. Section 240-47.1(A)(1)of the Zoning Ordinance allows for a family apartment greater than 800 square feet,not to exceed 1,200 square feet,with a Special Permit from the Zoning Board of Appeals. 2. The subject property is located at 28 Sturgis Lane, Barnstable as shown on Assessor's Map 278 as Parcel 037. It is in the Residence G Zoning District. 3. Site Plan Review is not required for single-family residential structures or family apartments. 4. After an evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The addition of the family apartment will maintain the single-family residential character of the property and neighborhood. The vote to accept the findings was: AYE: Craig G.
