The building was a former private "Gun Club" that apparently predates 1900. The building is shown on the 1939 subdivision plan of the area and was converted to a summer cottage residence apparently about that time. M. , The locus fronts 60 feet on Sunset Lane and backs up to the mean high water line of Barnsta ile S Harbor. The locus is a combination of two lots plus a half-interest in a third lot The.first lot is.the original 60 by 100 foot lot shown as'Lot#3 on a 1939 Land Court Plan No. 17933-A. The second lot (; is a 60 by approximately 63 foot 'Bathing Beach', Lot# 196 shown on a 1973 Land Court Plan NO. 17933-H. The third is a half-interest in a 10-foot wide access lot shown as Lot#195 on the 1973 plan. According to the engineered site plan the total upland area of the locus is 6,645 sq.ft The existing structure is situated 3,4 feet off the southwest property line not in conformance to today's required setback. The locus is bounded on that southwest side by a 10-foot wide "Way" designated on the original 1939 plan. The property is served by public water and connected to Town sewer. The applicant, Prudence Pigott purchased the property on October 17, 2008, and is seeking to demolish the existing dwelling and reconstruct a new 1,990 sq.ft., two-story, three-bedroom, single family dwelling with an attached garage. The upland area of the lot being only 6,645 sq.ft. requires a- special permit be issued for the demolition/reconstruction. In addition, the applicant sought to maintain the nonconformities in the structure location. • Town of Barnstable,Zoning Board of Appeals—Notice and Decision Special Permit No.'2008-068—Pigott,Section 240-91.H(2)Demo/Rebuild • Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 24, 2008. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. On December 4, 2008 the applicant's representative Attorney John W. Kenney submitted a Memorandum in support of the granting of the special permit. The hearing was opened December 10, 2008, at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this appeal were, James F. McGillen, William H. Newton, Michael P. Hersey; Craig G. Larson, and Board'Chair, Laura F. Sh ufelt. Attorney John W. Kenney represented the applicant and introduced Mr. Steve Cook from Cotuit Bay . Designs, the designer of the proposed new home. He summarized the history of the lot noting that it . is unknown if the existing structure was built on the lot or if it had been moved to the site from another location: Attorney Kenney cited that the existing structure is a combination of several additions and is not insulated. The Barnstable Old Kings Highway Historic District Committee issued a Certificate for Demolition of the existing "Gun Club" building and a Certificate of Appropriateness for the proposed new dwelling on August 27, 2008. • Mr. Cook gave a brief presentation of the proposed new dwelling to be built noting it is very modest three bedroom home of only1,990 sq.ft. and the orientation and location of the.building preserves a view from the roadway to the water. He summarized that the design, materials and architectural elements conform to the Old Kings Highway Historic District guidelines and the committee's • recommendations. • • . The Board asked several questions clarifying that the decks and porches were included in the lot coverage calculations. It was also noted by the Board that the gross floor area of the proposed building is 29.9% of the lot area and although conforming to the allowed floor area ratio of.3, it may still represent overbuilding on the lot given the neighborhood. Public comment was requested and no one spoke.in favor or in opposition to the request. Findings of Fact: • At the hearing of December 10, 2008, a motion was duly made and seconded for the following findings of fact: 1. Appeal No. 2008-068 is that of Prudence Pigott seeking a special permit pursuant to Section 240 . 91 H(2) of the Zoning Ordinance to allow for the demolition of the existing dwelling and the rebuilding of a new single-family dwelling on the undersizectlot of less than 10,000 sq.ft. of upland. The permit also sought to locate the proposed dwelling not in conformance to the required minimum yard setbacks. However, the proposed new setback is more conforming'than the established yard setbacks of the existing structure. The property is addressed 71 and 0 Sunset Lane, Barnstable, MA and is shown on Assessor's Map 301 as Parcels 024 and 023. The property is in a Residence B Zoning District. 2 Town of Barnstable,Zoning Board of Appeals—Notice and Decision Special Permit No. 2008-068— Pigott, Section 240-91.H(2) Demo/Rebuild 2'. The proposed setbacks of the new structure off the "Way" to the southwest side of the lot are to be 17-feet for the building and 11-feet for the basement bulkhead. The existing structure is now only 3,5-feet off the Way. Although the proposed setback does not conform to the required 20400t' setback, it is more conforming than that which now exists. The same situation exists with regards to the setback from wetlands. The existing structure is situated 19.1 feet off the top of the Dune • and the proposed new dwelling is to be situated 25.8 feet from the Dune. Although not conforming to the required 35-foot setback it is more conforming that that existing structure. 3. The proposed new dwelling is to be 1,990 sq.ft., and reflects a floor area ratio of 0.299 and . • conforms to the maximum allowed floor area ratio of.3. The building is to be two-story and, according to testimony given, the height of the proposed structure is to be 19:5 feet to plate and in conformance to the maximum.allowed height of 30-feet to plate. • 4. All of the nonconformities in the existing structure's location are legally created, pre-existing nonconformities. Although the proposal does not fully conform to today's requirements, the location of the proposed structure is more in conformance to the requirements than the existing building. • 5. An Order of Conditions from the Conservation Commission was issued on September 3, 2008. a • Certificate for Demolition of the existing "Gun Club" building and a Certificate of Appropriateness for the proposed new dwelling to be built was issued by the Barnstable Old Kings Highway Historic District Committee on August 27, 2008. • 6. The application falls within a category specifically excepted in the ordinance for a grant of a • special permit • . 7. After evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public good or the • neighborhood affected as the proposed new dwelling would not be substantially more detrimental • to the neighborhood than the existing dwelling. . Hersey Board Member Hersey cited that although the napplicant has met the floor area ratio requirement of the ordinance, the building is still excessive for the upland area of the lot at this location and in this neighborhood. During all stages in the demolition and reconstruction of the dwelling, all vehicles, equipment and` materials associated with the demolition/reconstruction shall be required to be located off Sunset Lane except as may be required to install utilities and to landscape and then only on a temporary basis: • 6.
