[exhibit A] 105 Sunset Lane,Barnstable was purchased by MSSI 105 SUNSET LANE PROPERTY GROUP LLC,pursuant to Quitclaim Deed filed November 13,2017 with the Barnstable Land Court Registry, Doc 1334188. [exhibit B] A search of Secretary of the Commonwealth of Massachusetts corporate records finds that the company name listed on the filed Quitclaim D eed,MSSI 105 SUNSET LANE PROPERTY GROUP LLC does not exist in Massachusetts as of December 1, 2017. [exhibit C] MSSI 105 SUNSET LN PROPERTY GROUP LLC (105 SUNSET LN),a domestic limited liabilityestablished in Massachusetts on October com an was p Y be 24, 2017. [exhibit D] It is my belief that the Quitclaim Deed Doc 1334188 "grantto"name is incorrectas filed as MSSI 105 SUNSET LANE PROPERTY GROUP LLC. Should the purchaser deem the name listed on the Quitclaim Deed to be correct,the MSSI 105 SUNSET LANE PROPERTY GROUP LLC is not registered as a limited liability company with the Commonwealth of Massachusetts as stated within Quitclaim Deed,Doc 1334188 and constitutes a violation. Neither company name, MSSI 105 SUNSET LANE PROPERTY GROUP LLC or MSSI 105 SUNSET LN PROPERTY GROUP LLC, has applied for or received a Certificate of Appropriateness to erect any signs at the 105 Sunset Lane location from the Old King's Highway Regional Historic District Commission, Barnstable (OKH) as required: Old King's Highway Regional Historic District Act,SECTION 6 _ Limitations, "No occupational, commercial or other sign...shall be erected or displayed...unless and until a ...certificate of appropriateness has been filed with the town clerk..." I L3 Further: The Old King's Highway Regional Historic District Act (ACT)Section 12 -Enforcement, "The building inspector in the affected town shall have the power and duty to enforce the provisions of this act." As of December 1,2017 MSSI 105.SUNSET LANE PROPERTY GROUP LLC can not file for a Certificate of Appropriateness from OKH as it is not registered in or authorized by the Commonwealth of Massachusetts to do business,including own property,in Massachusetts. Please note that the Secretary of the Commonwealth of Massachusetts within their Business Entity Summary lists Mark S. Scott as a Manager for both: MSSI 105 SUNSET LN PROPERTY GROUP LLC [exhibit E] -and- MSSI 133 SUNSET LN PROPERTY GROUP LLC [exhibit F]. Mark Scott has also represented himself as the owner of 133 Sunset Lane, Barnstable on various applications to Town of Barnstable Departments. [exhibit G] 133 Sunset Lane,Barnstable is owned by 133 SUNSET LN ACQUISITION LIMITED a foreign company existing under the laws of the British Virgin Islands. To my knowledge no Town of Barnstable Department has ever verified that Mark Scott is the owner of or has authority to act on behalf of 133 SUNSET LN ACQUISITION LIMITED by receiving a verified copy of the company's filing directly from the governing authorities of the British Virgin Islands. What is unusual is that both Foreign company 133 SUNSET LN ACQUITITION LIMITED and MSSI 105 SUNSET LANE PROPERTY GROUP LLC, a supposed Massachusetts limited liability company are both not registered with the Secretary of the Commonwealth of Massachusetts as of December 1,2017. The Town of Barnstable Building Department,which enforces Old King's Highway Regional Historic District Committee rules has issued on November 22,2017 a Notice of Violation and Order to Cease,Desist and Abate Order against 133 Sunset LN ACQUISITION LIMITED. [exhibit H]. Properties located at 105 Sunset Lane and 133 Sunset Lane seem to have several items illustrating common control including both listing Mark Scott as Manager. [exhibit I] The above referenced November 22,2017 Notice of Violation and Order to Cease, Desist and Abate Order was issued well before the signs were erected on the harbor side of 105 Sunset Lane this past week. So,in spite of this Order's clarification of the violation, the erection of a sign(s) without benefit of a Certification of Appropriateness from the Old King's Highway Historic District Committee" , f additional, indeed identical, signs were erected at the commonly managed 105 Sunset Lane location. The many concerned residents of Plan of Land in Barnstable,Land Registration 17933-A,Whitney&Bassett,August 1939 now request the following of your office: That the Building Inspector have the owner of 105 Sunset Lane,Barnstable,MSSI 105 SUNSET LANE PROPERTY GROUP LLC remove the approximately 4 non-OKH approved signs until such time as the owner submits an application for and receives a Certificate of Appropriateness from OKH for any signs the owner proposes to install on its own property,subject to normal public meeting procedures and common sense oversight that is OKH's charge. According to the complainant one event occurred on 5/24/08—a bridal party. Complainant also states that neighbors informed him that a wedding was held there in April prior to his return.
