DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be,considered a homeowner. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. She asked the Committee to view at large, her house will be no larger that others from the street view. .Stahley commented that the breathable space is being used by the mass of the house. Miller asked if the Committee had any suggestions, they need the space. The gambrel roof is deceptive and interior space is limited. They have lived there 14 years and need a two car garage to protect their vehicles. Stahley commented again that the uninterrupted line of the house is a problem. She said that if the application is rejected, they could file an appeal. Stahley can't re-design the house. Tolley commented that most houses have 125' frontage, Stahley replied that setting is the issue, not streetscape. Wilson said that wetlands are a hardship of the real estate. Stahley urged an appeal if the project is rejected. Miller stated they wanted to stay in the house. Tolley stated that he found this case to be an. excellent one for appeal. Nilsson asked if they wished a continuance. Answer, no. Nilsson stated she would second a positive motion in order get a motion on the floor for a vote however she was opposed to the project. Marie Souza was present and represented by Eric Tolley of Northside Design. Tolley said that the issues raised by the Committee in the previous hearing had been addressed by eliminating the widow's walk, a 5'-6' reduction in the eave, for a total reduction of about 9' in height, some windows had been changed and a gable added to the front elevation. Stahley noted that the Committee no longer can comment on the view from the water, due to court cases regarding the definition of a way. Stahley likes the right elevation and lowered eave line,triangular windows have been replaced with nautical rounds. Tolley said the distance from the street is changed- now 5' closer, 27.6' from stone parking area, all setbacks are met. Wilson likes house,Nilsson said it is better than the design represented two weeks ago. Tolley said they are keeping the existing plate and first floor walls, and is in compliance with the Building Code. They plan to retain existing cedar trees, maybe the fence. The Applicant is unsure of the roof color and may change it. The trim to be white, Cape Cod Gray for siding.
