On September 20, 1999 and September 21, 1999 our office conducted site inspections on Thornton Drive. We documented 20 locations with violations of zoning,building code and plumbing codes. Some of the most serious violations involved Groundwater Protection District violations which,as you know,could affect the quality of our drinking water. All were cited for their violations and given a definitive amount of time;usually seven days,to rectify the problems. A summary of the violations are as follows: 1T1)-12-Thornton.Drive(Murph's Recession)-illegal storage of trailer being used for business purposes, excessive storage of tires and debris,mechanical parts of motors on the ground. Given a$50 ticket. 2) 30 Thornton Drive(South Shore Canvas Yacht)-excessive storage of unregistered vehicles,boats and debris. Given a$50 ticket. 3) 31 Thornton Drive(Brazilian Auto Repair)-illegal use without Site Plan Review approval. Must file within seven days. Given a$50 ticket. 4) 31 Thornton Drive(Magic Touch)-washing autos in violation of groundwater ordinance. Given a$50 ticket. 5) 31 Thornton Drive(Mike Becal)-Groundwater Protection ordinance violation. Open oil and gas containers,engine parts,junk. Given a$100 ticket due to failure to act after a citation a week ago. 6) 72 Thornton Drive(Magnum Auto Repairs)-illegal use without Site Plan Review approval,excessive debris and tires stored on site. These inspections encompassed the usual concerns regarding fire extinguishing devices, housekeeping and waste oil storage. I would however, like to bring two items to your attention. The first involves the property located at 12 Thornton Drive. This property is directly above the establishment know as Murph's Recession. I noted that the property in question has evidence of persons living in "office" type areas above the restaurant. In looking from the street, I noted house plants and air conditioners. This area had been prohibited for use as an apartment by Mr. Joseph DaLuz on May 21, 1992. On that date, Mr. DaLuz forwarded the enclosed letter to Mr. James M. Burke of Barnstable Road Nominee Trust, the apparent owner of the building. This "office" area was also issued an unfitness for habitation order by Mr. Thomas McKean on November 12, 1992. I respectfully request that you initiate an investigation into the acceptability of"residential" occupancy above the restaurant at 12 Thornton Drive. In addition to the above, there is an apartment located at 178 Thornton Drive, above the occupancy known as Bri-Co Auto works. Please note the street address as there are two(2) businesses known ad Bri-Co Auto works located on Thornton Drive. II Page 2. In both of the above noted situations, I am most concerned about the threat to life safety based upon a mixed use, that being a restaurant and an auto body shop located under residential apartments. The tenants were notified by the owner via Certified Mail to vacate the apartments (copies attached) . For additional information please refer to memo with attachments dated April 14, 1992, from this office to Mr. Rutherford. The property owner was informed, by this office, that if the tenants failed to vacate the property it was his responsibility to apply to the Court for an EVICTION ORDER. I have been informed that one of the tenants has signed a lease and will be moving from the apartment no later than 1. August 23rd. This information has been verified with the 4 Realtor. Efforts continue to relocate the remaining tenant. The property owner is presently out of Town.
