RE: • Thornton Drive operation .
On September 20, 1999 and September 21, 1999 our office conducted site inspections on Thornton Drive.
We documented 20 locations with violations of zoning,building code and plumbing codes. Some of the
most serious violations involved Groundwater Protection District violations which,as you know,could
affect the quality of our drinking water. All were cited for their violations and given a definitive amount of
time;usually seven days,to rectify the problems. A summary of the violations are as follows:
1T1)-12-Thornton.Drive(Murph's Recession)-illegal storage of trailer being used for business purposes,
excessive storage of tires and debris,mechanical parts of motors on the ground. Given a$50 ticket.
2) 30 Thornton Drive(South Shore Canvas Yacht)-excessive storage of unregistered vehicles,boats and
debris. Given a$50 ticket.
3) 31 Thornton Drive(Brazilian Auto Repair)-illegal use without Site Plan Review approval. Must file
within seven days. Given a$50 ticket.
4) 31 Thornton Drive(Magic Touch)-washing autos in violation of groundwater ordinance. Given a$50
ticket.
5) 31 Thornton Drive(Mike Becal)-Groundwater Protection ordinance violation. Open oil and gas
containers,engine parts,junk. Given a$100 ticket due to failure to act after a citation a week ago.
6) 72 Thornton Drive(Magnum Auto Repairs)-illegal use without Site Plan Review approval,excessive
debris and tires stored on site. Given a$50 ticket.
7) 72 Thornton Drive(Fred's Auto)-illegal use without Site Plan Review approval,excessive debris and
tires. Given a$50 ticket.

junk cars,no Site Plan approval,onto neighbor's lot. Given a$100 ticket.
14) 146B Thornton Drive(New England Auto)-no bathroom,violation of plumbing code. Given a$50
ticket.
15) 146C Thornton Drive(Jack Mattos)-no Site Plan approval,illegal use auto repair. Given a$50
ticket.
16) 146D Thornton Drive(L&M Calipher)-no Site Plan Review,illegal construction,addition without
permits,excessive junk and debris. Given a$50 ticket.
17) 157 Thornton Drive(All Cape Automotive)-excessive debris,oil drums,stock piled outside. Given
a$50 ticket.
18) 157 Thornton Drive(Northeast Tool)-illegal trailer,outside debris without Site Plan. Given a
warning.
19) 178 Thornton Drive(Brice Autoworks)-no Site Plan Review,excessive debris,trailer,expansion
onto neighbor's land. Given a$50 ticket.
20) 177 Thornton Drive(Eric Herbst)-illegal trailers,excessive debris and auto parts. Given a warning.

Dear Ralph:
I conducted several inspections on Thornton Drive yesterday morning
and afternoon. These inspections encompassed the usual concerns regarding fire
extinguishing devices, housekeeping and waste oil storage. I would however, like to
bring two items to your attention. The first involves the property located at 12
Thornton Drive. This property is directly above the establishment know as Murph's
Recession. I noted that the property in question has evidence of persons living in
"office" type areas above the restaurant. In looking from the street, I noted house
plants and air conditioners. This area had been prohibited for use as an apartment
by Mr. Joseph DaLuz on May 21, 1992. On that date, Mr. DaLuz forwarded the
enclosed letter to Mr. James M. Burke of Barnstable Road Nominee Trust, the
apparent owner of the building. This "office" area was also issued an unfitness for
habitation order by Mr. Thomas McKean on November 12, 1992. I respectfully
request that you initiate an investigation into the acceptability of"residential"
occupancy above the restaurant at 12 Thornton Drive.
In addition to the above, there is an apartment located at 178 Thornton
Drive, above the occupancy known as Bri-Co Auto works. Please note the street
address as there are two(2) businesses known ad Bri-Co Auto works located on
Thornton Drive.

In both of the above noted situations, I am most concerned about the threat to life
safety based upon a mixed use, that being a restaurant and an auto body shop located
under residential apartments. Please advise me regarding your findings.

HUMAN HABITATION
The property owned by you located at Apartment A, 12
Thornton Drive, Barnstable, Ma. was inspected on November
11, 1992 by Thomas McKean, Director of Public Health for the
Town of Barnstable, because of a call from the Fire
Department. The following violations of 105 CMR 410.00,
State Sanitary Code II, Minimum Standards of Fitness for
Human Habitation were observed:
410.201: No heat provided.
410. 180 and 410.190: No hot water provided.
410.250B, 410.251A, and 410.253: No electricity or light
provided.
410.602: Moldy and spoiled foods stored on kitchen counter
and on bedroom table.
410.550: Many cockroaches and other insects observed on the
kitchen floor and kitchen wall adjacent to
refrigerator and on the bedroom wall.
The dwelling unit is unfit for Human Habitation and the
Director of Public Health also determined the dwelling is an
immediate danger to the occupant(s) . Therefore, the
dwelling shall be vacated within twenty-four (24) hours of
receipt of this notice or as soon thereafter as practicable.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order is received. However, these
violations must be corrected regardless of any request for
a hearing.
Please be advised that failure to comply with an order could
result in a fine of not more than $500. Each separate day's
failure to comply with an order shall constitute a separate
violation.

His apartment has been cleaned out and is currently locked up.
Mr. Toby has not paid any rent for three months and is not
being very co-operative about vacating the apartment.
The court eviction papers are in process and I am doing my best
to have Mr. Toby vacate the premises.

The process to have the apartments located at 12 Thornton
Drive, Barnstable, vacated continues.
The tenants were notified by the owner via Certified Mail to
vacate the apartments (copies attached) . For additional
information please refer to memo with attachments dated
April 14, 1992, from this office to Mr. Rutherford.
The property owner was informed, by this office, that if the
tenants failed to vacate the property it was his
responsibility to apply to the Court for an EVICTION ORDER.
I have been informed that one of the tenants has signed a
lease and will be moving from the apartment no later than

I have received your letter ordering that the apartments at the
above address be vacated. Although I do not agree with your
conclusion that there is no building permit for the apartments ,
I will this day send both of the tenants certified letters
requesting that they vacate the apartments.
One of the tenants , Mr. Ellery Toby is a black diasabled war
Veteran and I would ask that the Town assist him in finding an
apartment. The other tenant Mr. James Rollins is not working full
time and could also use some help. It must be remembered that this
is the summer season on the Cape and inexpensive dwellings are
difficult to find.
Unfortunately two apartments that have always been rented to
minorities and poor are no longer available because of someone 's
hidden agenda in requesting that the apartments be vacated.

comply with a secondary means of egress at 12 Thornton
Drive , Barnstable( Hyannis ) , I find that continuing the

exterior door and a staircase to ground level will meet
code requirements .Howev(r, Murph"s Recession has a truck
which is used for storage parked in the way of the my
proposed staircase . I would be able to complete this work
approximately three weeks after the truck has been
removed .
Also, I have contacted my electrician to investigate the
most feasible way of installing a fire alarm system tying
in all the units in the building to meet the requirements
of Chapter 148 Section 26E .
I will be out of town until January 15, 1992, I will be in
touch with when I get back.

In reponse to our telephone conversation on April 13, 1992;
please find enclosed copies of my letters to Mr . Daluz
Building Commissioner, Town of Barnstable;dated
January 4, 1992 and February 10, 1992 regarding this matter .
You will notice we were ready to start this project back
in early January. However, the storage truck referred to in
my letters is apparently being used for meat storage for
Murph"s Recession .The truck is parked within the 15 foot
setback from the back lot line and within 14 feet of a
rubbish container . The location of this truck prohibits
construction on the proposed staircase .The electricity for
the storage truck appears to be supplied from extension
cords that run from the truck to inside the restaurant .
I wish to reiterate my desire to comply with your request
for a secondary egress at 12 Thornton Drive, Hyannis .
As we have stated before (see letter of January 4, 1992)
this work would be completed within three weeks after the
meat storage truck has been moved .
As a matter of record : I believe there is a secondary means
of egress, however Ms . Hickey has elected to lock the door
at the top of the stairs,preventing tenants from using the
existing secondary egress .

Dear Mr. Daluz :
On behalf of Nancy Hickey, I am requesting you to
examine the proposal of James Burke with reference to his
providing a required second access to one of his apartments
over Murph' s Recession.
My examination shows that even when such a staircase is
built, it will only be accessed directly by the back
apartment because it will be located on the exterior wall of
that back apartment . This will not provide direct access to
the front apartment/ and therefore I believe that the front
apartment is illegally in violation of the building code .
Under General Laws Ch. 143 section 100, I am hereby
requesting that you act upon this violation by preventing the
use and occupancy of the front apartment . My client has
standing to challenge this deviation under the Shriners
Hospital case at 4 Mass . App. Ct . 551, 353 N .E . 2d 778
(1976) .

Please find enclosed a copy of a letter from Richard Rougeau,who
represents Ms . Nancy Hickey of Murph's Recession . I am somewhat
confused by Mr . Rougeau 's observations after visiting the planned
construction for the upstairs exit .
Concerning my tenant Mr . Ellery Tobey, he as informed me that now
he intends to stay in the apartment . Mr . Tobey has paid his rent
up to date and as assured me that he will behave himself . We are
both aware of the difficulty of evicting a tenant, this process
can take months .Mr . Tobey is a disable veteran living on a
disability income .
We have started work on the fire alarm system, it is somewhat
diffcult because we have to work around Ms . Hickey's schedule .

I am in receipt of a letter to you , dated January 4, 1992
from Mr. James M. Burke, Trustee of Barnstable Realty Trust.
He indicated that he has a solution to the egress problem at
12A Thornton Drive. However, he also indicates that he can
complete this three weeks after the truck is removed. My
question to you at this point is two-fold:
1 . Is the stairway proposed acceptable to you relative
to the State Building Code?
2 . Who is to discuss removal/moving of the truck
behind Murph's Recession with Ms. Hickey?
I am concerned that Mr. Burke is out of town until 01 /15/92
and that work toward completing this project will be further
delayed by Mr. Burke's mention of the storage truck. I am
confident that you share my concern for the life safety of
the occupants of the apartment above Murph's Recession. It
causes me even greater concern that they will be without
adequate egress and smoke detector protection in the
meantime. Please advise me in writing of your opinion of the
acceptability of Mr. Burke's proposal and your plan

most feasible way of installing a fire alarm system tying
in all the units in the building to meet the requirements
of Chapter 148 Section 26E .

Dear Joe,
During a recent inspection to the Thornton Drive
area, I encountered a situation' that I would like to me to N
you . Located over the restaurant known as Murph 's Recession ,
I noted three (3 ) apartments. Although these apartments
were closed and I did not request entry into them, I was
informed by empl oyeeof- Murph 's Recession that there are
people living

called to those apartments. 1 seriously question the
legality of these apartments based upon several points:
A. The life safety of the occupants due to the
fact that there is only one -means of egress from
, this area above Murph's Recession.
B. The lack of a complete smoke detector system that
.„ is hard wired and includes the first and second
floors of the occupancy .
C. Zoning and By-Laws of the Town of Barnstable
concerning apartments. ,
D. The mixed occupancy relative to a restaurant and
apartments together in that complex.

which is labeled as #12 Thornton Drive. Additionally, this

The following electrical defects were noted:

Electric baseboard heat in living room is damaged and needs to

410.00, STATE SANITARY
CODE II, MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
The property owned by you located at 12B Thornton Dr. ,
Hyannis, was inspected on August 9, 1991, by Jerome
Dunning, Health Inspector for the Town of Barnstable because
of a complaint. The following violations of the 105 CMR
410.00, State Sanitary Code II , Minimum Standards for Human
Habitation were observed:
410 550: Several cockroaches observed beneath the kitchen
sink.
410.351: Raw sewage "backed up" in the drain of the kitchen
sink and showers.
410.482: Smoke detector is not operable.
410.500: Door is not attached to the door frame.
410.551: Kitchen window screen cannot be lowered or raised.
410.481: Owner's name, address, and telephone number not
posted.
You are directed to correct the violations of 410.550,
410.351, and 410.482 within twenty-four (24) hours of
receipt of this notice.
You are also directed to correct the remaining violations of
410.500, 410.551 and 410.481 within seven (7) days of
receipt of this notice.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order is received. However, these
violations must be corrected regardless of any request for a
hearing.
Please be advised that failure to comply with an order could
result in a fine of not more than $500. Each separate day's
failure to comply with an order shall constitute a separate
violation.
