The functions of the car dealer will simply be selling and buying cars. The functions that the mechanic shop will provide are fixes, repairs and oil change to cars that belong to the dealership and need repairs before they are placed for selling. The license sought for 53 Thornton Drive is independent of the license held for 3OD which is a d/b/a Mid Cape. 31 Thornton Drive is a d/b/a Ferreira's which holds a business certificate'that unequivocally states that the operation is for Auto Repair, Recycling, and Debris removal. The Certificate also states that there are no requirements with the Licensing Department. 10. Ferreira's application for a new Junk dealers License for 53 Thornton Drive has been advertised 2 i to be held on October 29,2007. 11. At the Show Cause Hearing, each party was offered the opportunity to examine the testifying witnesses. After examination of all witnesses, the Licensing Authority rendered a verbal decision pertaining to the eight(8) separate violation allegations. A copy of the Written Decision is attached hereto as Exh. "B." 12. Ferreira as a person aggrieved by the decision of the Licensing Authority's action, hereby appeal this decision("Decision")as being in excess of the Licensing Authority's authority, and hereby requests the Decision be annulled. COUNT 13. Ferreira repeats and re-alleges the allegations of¶¶ 1-12 of this Complaint as if each were set forth fully herein. 14. The Licensing Authority alleged that Ferreira violated the terms of his Junk Dealers License by buying motor vehicles and imposed a one day suspension. Yet there was no testimony regarding ownership of this vehicle through the running of vehicle registration and vehicle identification numbers. 15. The Junk Dealers License the subject of this action is held on 30D Thornton Drive("30D"). This vehicle allegedly was stored on 31 Thornton Drive ("31"), a property not covered by the Junk Dealers License. 31 holds a business certificate for the use on this property. The Licensing Authority voted to impose a one (1) day suspension based on this alleged violation. The- Licensing Authority found that Ferreira operated its operations at a place other than 30D, including 31 and 53 Thornton Drive("53")which allegedly constitutes a violation. The Licensing Authority voted to impose a one(1) day suspension based on this alleged violation. 16. Testimony was offered regarding the nature of a Junk Dealers business, which under G.L. c. 140 § 56, is interpreted to mean that a person can go from place to place in the operation of the 3 business. 31 holds a business certificate and 53 is often used with Ferreira's haulers permit 17. The Licensing Authority alleged that an unregistered vehicle was located on 53 in violation of Barnstable Ordinance 228-1,yet no unregistered vehicle was on this property. 18. It is the Licensing Authority's burden to prove that a vehicle is unregistered, yet this burden was. not met. The Licensing Authority also failed to demonstrate that this vehicle was not part of Ferreira's hauling business as it was on the top of a metal structure used for purposes of towing. The allegation of the unregistered vehicle was on 53 not 30D where the Junk Dealers License is situated. The Licensing Authority issued a warning for this alleged violation. 19. The household rubbish allegedly uncovered was ready.for transport when the inspection occurred. The type of dumpster used in the businesses operated by Ferreira do not contain covers. The Licensing Authority failed to identify in their Decision which property this household trash was stored at. See, Exh. `B." 20. The Licensing Authority failed to consider contrary evidence regarding the allegation of storing household rubbish in an open dumpster as a violation of Barnstable Ordinance 353-2. The Licensing Authority issued a warning for this alleged violation. 21. The Licensing Authority failed to act upon credible evidence regarding the area where Ferreira's businesses are located. This location has been blighted by illegal dumping. See, Exh. A-3 Letter ofAlishia Parker. 22. . The Licensing Authority found that Ferreira violated Barnstable Ordinance 108-9 by allowing a five gallon bucket of oil to be stored out of doors. This bucket was dumped on site illegally and Ferreira at his own expense, cleaned up this illegally dumped oil container. Further, the Licensing Authority failed to identify in their Decision which property this five gallon bucket of oil was stored. See., Exh. `B." The Licensing Authority voted to impose a one(1) day suspension based on this alleged violation. 4 i r 23. The Licensing Authority found that Ferreira violated Barnstable Ordinance 353-1 by allowing a large pile of air conditioners to be stored out of doors. The Licensing Authority voted to recommend a warningbased on illegal-dumping et the failed to make this determination with g p gY Y the illegally dumped oil container, which was contrary to their own evidentiary determination pertaining to the air conditioners., and constitutes an abuse of discretion. 24. The Licensing Authority alleged that Ferreira held an illegal apartment. The Licensing Authority, however, held that Ferreira was not guilty of this violation as there was.no accessory apartment on this property. 25. The Licensing Authority alleged that Ferreira maintained more than twelve(12) dumpster's at 53 without the benefit of a Junk Dealers License. The property subject to the Hearing was 30D,not 53. The Licensing Authority acted contrary to credible evidence in its Decision to suspend Ferreira's Junk Dealers License held at 30D based on alleged violations at 53. 26. The Decision of the Licensing Authority in suspending Ferreira's Junk Dealer's License is arbitrary and capricious, an error of law, and unsupported by substantial evidence. COUNT II 27. Ferreira repeats and re-alleges the allegations of¶¶ 1-26 of this Complaint as if each were set . forth fully herein. 28. The record reflects that each party cross examined each witness called. During cross examination of Mr.Ferreira,it became evident that the basis for this action, was potentially the product of racial animus. 29. Geiler's examination of Mr.Ferreira included the statement "Brownie"that appears to be a racial slur directed at Mr. Ferreira, who is of Cape Verdean and Portugese descent. Mr.Ferreira took this as a statement regarding his color. The Decision of the Licensing Authority where racial bias has been infused into the proceeding, is an arbitrary and capricious exercise of 5 governmental power and administrative procedure which constitutes an abuse of discretion, and an error of law. WHEREFORE,the plaintiff,Timothy J.Ferreira respectfully requests that this Honorable Court: 1. Annul the decision of the Licensing Authority regarding the four(4) day suspension of the Junk Dealers License; 2. Rule that the Licensing Authority exceeded its authority in rendering its decision; 3. Rule that the Show Cause Hearing was based in part, on racial animus and the decision must be annulled; 4. Rule that the Licensing Authority has failed to meet its threshold burden to imposie a four (4) day suspension of the Junk Dealers License; and 5. Grant such other relief as this Court deems meet and just. Respectfully submitted, Timothy J.Ferreira, By his Attorney, es P. Connors,Esq. BBO# 653135 3291 Main Street P.O.Box 730 . Ferreira Show Cause Hearing Dear Members, Please let this letter serve as a memorandum of understanding that may aid in the interpretation of the operations of various businesses owned by Timothy J.Ferreira and located at 3OD Thorton Drive d/b/a Mid Cape, 53 Thorton Drive, and.31 Thorton Drive d/b/a Ferreira's.. Mr. Ferreira holds a Junk Dealers License ay 30D Thorton Drive, a Auto Repair, Recycling and Debris Removal Business Certificate at 31 Thorton Drive, and is currently applying for a Class III Junk Dealers License for 53 Thorton Drive.' .Copies.of this . documentation are attached hereto as Exhibit "1. " To facilitate addressing the concerns outlined in the Show Cause order letter of August 28, 2007 and annexed, hereto, each.concern will be addressed individually, subject to objection as to the properties located at 31 and 53 Thorton Drive. (1) The Buick automobile was stored inside at 31 Thorton Drive, inside the building and is no longer on site Under the benefit of the Business Certificate. See, Exh. "I Auto Repair, Recycling, and Debris Removal" This vehicle was never stored at 30 D Thorton Drive. See, ' The application for the new Junk Dealers License has been continued until after the Show Cause Hearing at the request of the Town. 1 I ' Licensing Authority Minutes, March 19, 2007,pg. 3 attached hereto as Exhibit "2. " (2) All operations of the business are pursuant to the designated license. From time to time an item may be on a vehicle that is temporarily parked on an adj oining property operated by one of the businesses owned by Mr. Ferreira, but the nature of a Junk Dealer is to go from place to place as defined by G.L. c. 140 § 56. (3) It is not known what unregistered vehicles are located at 31 Thorton Drive as there are none on site. Sometimes vehicles associated with the towing are temporarily in site. (4) The dumpster claimed to be in violation of Barnstable Ordinance 353-2 was an open container type of dumpster that does not contain a cover. If household rubbish was contained in this container hat was ready for transport when it was inspected, it was through inadvertence. Mr. Ferreira does not store any household rubbish in the operation of his numerous . businesses inconsistent with Town Ordinances.. (5) The oil contained in a five (5) gallon container was the product of illegal dumping which plagued the cite prior to occupation by Mr. Ferreira. Prior to occupation by Mr. Ferreira, the area was a known illegal dumping site. Mr. Ferreira at his own expense has made tremendous improvements at abatement of illegal dumping as noted in numerous letters circulated regarding this issue. See, letters regarding illegal dumping attached hereto as Exhibit «3 , (6) The large pile of air conditioners allegedly stored on the property, unspecified, are gone. From time to time, people drop of air conditioners and other items during regular business hours. However, from time to time, people drop off items at the property after hours despite that claim the.property is video tape monitored. (7) The alleged dwelling located at 30D Thorton Drive is nonexistent. The facility contains a toilet and shower for use by Mr. Ferreira and other contractors associated with his business. Due to the nature of Mr. Ferreira's type of work, it is common to become quite dirty during the course of work. There has never been a person residing in this unit, as this facility does not contain the amenities necessary for habitation other than a toilet and shower. See, Exhibit "4. " (8)Mr.Ferreira is a hauler of scrap metal. The nature of this business is not storage of materials, but to move the scrap materials on a regular basis. Pursuant to the Show Cause order, Mr. Ferreira is required to show cause why his Junk Dealers License for 30D Thorton Drive should not be modified, suspended or revoked. It appears abundantly evident that due to Mr. Ferreira being in control of three (3) separate properties on the same street, that the licensing issues addressed in the Show Cause order, are vague and ambiguous. 2 i Each property is separately identified and has the benefit of separate recognition from the Town. The licensing for each property allows for specific uses. The Show Cause order seeks to address specific issues that are inaccurate or incorrect as they address three (3) separate properties in the Show Cau,-e order, but does not address areas of concern unique to 3OD Thorton Drive only, and independent of 31 Thorton Drive and 53 Thorton Drive. Although each business has independent identity and Town recognition, at times a company vehicle acting under color of one business operation, may be temporarily parked at a separate location. A Junk Dealers business is necessarily built on mobility, which G.L. c. 140 § 56 expressly recognizes. It is hoped that this memorandum of understanding will provide useful insight for the Town in its analyzation of concerns addressed in the Show Cause order. Irrespective of confusion regarding each separate property,Mr. Ferreira desires to be a good neighbor in this Town. His work in greatly improving the unsightliness of illegal dumping has not gone unnoticed. Very truly yours, af es P. onnors 3 Town of Barnstable pp THE1p . regulatory Services Thomas F. Conclusion: • Zoning—IND/WP • Uses identified in the B zone are allowed by special permit in the industrial zones. • Uses that involve the storage and use of hazardous materials exceeding more than household quantities are prohibited in the water overlay districts. • Recycling business is operating out of three bays. • License identifies only Unit 30D for Mid Cape Recycling. • Permit on file for only one sign. • Use appears to have evolved from recycling to salvage yard without approval. • Unit 30D is empty but has living quarters and amenities in the loft area. o It is not logical to pay rent for an empty commercial bay. o Living in employer's bay is convenient and likely less expensive than renting an apartment o Independent transportation is not necessary if one resides at work site. o Perhaps rent is withheld from employee's weekly pay? • Living quarters above Unit 31 are not to code. 2 r . tom• i.a. rx„, ,-> w- 'a$ arp a. 3" y ✓ 1E ly SSd 'F i+. y / m 3 r On August 14, 2007 I attended an inspection of the property located at 30, 31 and 53 Thornton Drive in Hyannis at approximately 9:15'AM.
