Every tank shall be placed onto a foundation capable of supporting the tank . You should inform any future tenants as to the status of the inoperable chimney of the upstairs apartment due to the broken flue and that you have boarded it up and is not intended for use . Chapter 40, Section 54 of the Massachusetts General Laws specifically provides that "no building permit shall be issued for the construction of a building which would necessitate the use of water therein, unless a supply of water is available therefor, either from a water system operated by a city, town, or district, or from a well located on land where the building is to be constructed, or from a water corporation or company" . Persons supplying potable water to at least 15 service connections or at least 25 people, more than 60 days of the year are public water supply systems. In order for a supply of water to be "available" for public water supply systems, the source of the supply must be approved by DEQE. The approval of the DEQE is also required prior to the construction of dams, wells, reservoirs, pumping and filtration plants, building standpipes, tanks, fixtures an other structures including purification and treatment works to be used for water supply purposes. In order for water to be "available" to a water supplier who. intends to supply potable water to less than 15 service connections or less than 25 people, for less than 60 days of the year, the source of the supply of water must first be approved by the local Board of Health. The wording of Section 54 , when applied to the issuance of a building permit for the construction of a building which will require a new or modified source of potable water, should be construed to prohibit the issuance of the building permit unless and until the required approval is obtained. 2 - Whenever the provisions of MGL Chapter 40, Section 54 are ignored, the city of town issuing the construction permit as well as the supplier of water may be subjecting the consumer to an unnecessary and impermissible risk of consumption of unfit water. Increasingly, DEQE is being made aware of the construction of new unapproved sources of potable water, and the delivery of unpermitted unmonitored supplies of water to consumers for drinking. In at least one of these instances recently, DEQE has found that the water supplied by a fully constructed but unapproved source was not acceptable. These situations cause considerable work for DEQE as well as the local health officials, result in costly delays for the developer, and may conceivably raise liability issues for the city or town. Today, because of increasing and the competing demands on the increased potential for contamination of potable water supplies, we may no longer be able to justify the assumption of an abundant supply of water in the Commonwealth. Thus, there needs to be a heightened awareness of the mechanisms available for the protection of the purity and quantity of drinking water supplies. In order to assure that a fit, pure and dependable quantity of potable water is supplied to citizens of the Commonwealth, it is imperative that all authorities attend to the mechanisms within their respective jurisdictions that promote this goal.
