Sprint Spectrum sought to replace an existing 65 foot lattice telecommunications tower with an 85 foot lattice telecommunications tower. The subject property, a vacant parcel owned and used in conjunction with 217 Thornton Drive, is nonconforming in terms of area, frontage, and width and the proposed tower was nonconforming in terms of height and side and rear yard setbacks. Specifically relief was requested as follows: Required Existing/Proposed Lot Size: 90,000 sq.ft 28,590 sq.ft Frontage: 20' 0' Width: 81' 200' Height: 30' 85' Side Setback: 30' 7.4' Rear Setback: 30' 21' r- F.. The motion to grant the Appeal did not carry and the request was not granted by the Board. The decision of the Board was appealed and the District Court entered judgment in favor of Sprint Spectrum, LP. The judgment states that the Town was to issue all "approvals and permits necessary and appropriate to allow for the installation, construction and siting of the proposed telecommunications facility". It appears a written decision granting the requested variance was never issued. In anticipation of future action by Sprint Spectrum, LP, a decision and notice of the variance relief issued pursuant to order of law has been drafted for the record. Decision Based on the Agreement and Order of Judgment dated May 15, 2002, variance relief from the bulk regulations of the Industrial District, including area, frontage, width, side and rear yard setbacks, and height, is issued to Sprint Spectrum, LP for an 85 foot lattice telecommunications tower at 217 Thornton Drive (Map 297 Parcel 028) by order of law. CA #01-11826MLW Dear Ms. Groppi: Please be advised that the above-referenced proposal was found to be administratively approvable subject to the following: • Approval is based upon plans entitled "Sprint Vision, Oceanside Antenna BS23XC756 271 Thornton Drive, Hyannis, MA" prepared for Sprint by EBI Consulting, Burlington, MA, 11 Sheets, dated November 17, 2011. • • Applicant must obtain and comply with all other applicable permits, licenses and approvals required including, but not limited to, the granting of a variance from the .Zoning Board of Appeals for the increase in the number of units on the existing pole. • Upon completion of all work, a registered engineer or land surveyor shall submit a letter of certification, made upon knowledge and belief in accordance with professional standards that all work has been done in substantial compliance with the approved site plan (Zoning Section 240-105 (G).
