I have been told by the building department that the zoning in this area was changed to one acre zoning in March of 1973. Accordingly, I have reviewed the records at the Barnstable County Registry of Deeds going back to that date to determine if any of the lots were held in common ownership. The records indicate that Lot 63 was never held in common ownership with either of the other four lots since 1972. I am enclosing copies of the five chains of title from 1972 to the present. However, I should point out that Lot 19 was owned by William F. Smith and Irene M. Smith from 1968 to 1998. Lot 63 was owned by William F. Smith and Irene M. Smith as Trustees of W & R Trust from 1984 until the death of Mr. Smith in 1989. As both Mr. and Mrs. Smith are deceased! I do not know who the beneficiaries of W & R Trust were during that time frame. However, as the Lot was held in Trust and not by William and Irene individually, I do not believe that this creates a merger by operation of law. Subject lot area is within and a part of Parcel 'A' shown on the plan. Subject lot not defined on this subdivision plan. November 27, 1959 The subject lot area along with other lands is transferred from William A. Jones, Inc., to Allan F. Jones and Charles W. Jones - Book 1062 page 310. August 24, 1964 Allan F. Jones and Charles W. Jones transferred a Parcel 5 and 6 (being a portion of Parcel A of the 1956 subdivision) to Herbert S Higgins and Julia A. Higgins. The deed identifies Parcel 5 as being 33,390 sq.ft. and Parcel 6 as 36,100 sq.ft. The two parcels are described as one lot in the deed in terms of bounds. Book 1267 page 258.1 February 25, 1969 Herbert S. Higgins and Julia A. Higgins file an Approval Not Required(ANR)plan endorsed by the Planning Board in plan book 227 page 135 showing Parcel 5 and 6.2 This recording effectively created the subject lot under zoning. At this time of recording the subject lot conformed to zoning as the area was zoned RB-1 requiring a minimum of 10,000 sq.ft. for a buildable lot. March 6, 1969 This area of Town was rezoned from RB-1 to RE-1 by the adoption of Article 99. The RE-1 district required a minimum lot area of 35,000 sq.ft. for a buildable lot. At the time of the zoning change to 35,000 sq.ft. the subject Parcel 5 was undersized by 1,610 sq.ft. June 05, 1972 Herbert S. Higgins and Julia A. Higgins transfer Parcel 5 as show on the 1969 ANR plan to The Dolphin Restaurant. March 29, 1973 This area of the Town was rezoned form RE-1 to RF-1 requiring a minimum lot area of 1-acre. Review of protection as common lots (two lots) under one ownership—the period covering February 25, 1969, to June 05, 1972: I Note: No recorded plan of this lot was found. To be a buildable lot under zoning a recorded plan was required in Barnstable at this time. 2 Note: This is the first recoded plan of the lots. \-. . ) . Section 240-91.B - Common lot protection requires conformance to 4 provisions for the 5-year grandfathering to apply. They are: (a) [The sub=�ect] lot is held in common ownership with not more than two adjoining lots; and (b) Had a minimum of 7,500 square feet in area and 75 feet of frontage or the / minimum frontage requirement for the zoning district in which it is located; and (c) Was recorded or endorsed on a plan that conformed to zoning when legally created; and (d) Conformed to applicable zoning requirements as of January 1, 1976. With regards to 'a', `b', and `c' it would appear the subject lot conformed. However with regards to `d', the subject lot- Parcel 5 —is only 33,390 sq.ft. The subject lot did not conform to the January 1, 1976 minimum lot area of 1-acre. Therefore this lot (Parcel 5) could not have taken advantage of the 5-year grandfathering provision when created back in February 1969 and held in common ownership. Review of protection as this being a single buildable lot as it was transferred into separate ownership on June 05, 1972: Section 240-91.A- Separate lot exemption requires conformance to 4 provisions to be considered a separate independent buildable lot. Single lots require that"at the time of recording or endorsement"—that is February 25, 1969 - the lot: (1) Was not held in common ownership with any adjoining land; and (2) Had a minimum of 5,000 square feet of area and 50 feet of frontage or the minimum frontage requirement for the zoning district in which it is located; and (3) Conformed to the existing zoning if any when legally created; and (4) Was separately owned at the time of every zoning change which made it nonconforming.
