It is not clear as to the precise placement of the fence as approved. You stated during the hearing that no fence higher than 3 feet could be situated more than 20 feet from any intersection- regardless of the style of fence. As you can see from the attached,the decision is silent on this point. The accompanying exhibit photo looks like the fence as approved(three split rail with wire) extends all the way to the corner of the intersection of Van Duzer and Tokamahamon and is flush against the road. Also I am unclear as to the placement of the fence along Harbor Point Road. The discussion appeared to suggest that the fence should be at least 5 feet off the road. However the decision dies not address this and again the photo appears as if the fence will be against the road. Any clarification you can give me would be appreciated. This letter is a follow-up to our conversation. As I explained to you, this house is in a residential zoning district, specifically an RF-1 district. According to section 3-1.3 of the Town of Barnstable zoning ordinances the principal permitted uses are single family residential dwellings (detached). As an accessory use one is allowed to have horses. Conditional uses that are listed are subject to section 5-3.3, special permit provisions, and are listed as public or private golf courses,horses in excess of provision of Section 3- 1.1(2)(B)(b) either on the same or an adjacent'lot, a family apartment or windmills. Special permit uses are open space residential developments. The zoning ordinance, as it is presently composed, does not have a provision to allow the activity that you are endeavoring to pursue, specifically, renting your home and allowing wedding functions to take place there on a regular basis. As we discussed, I agree that individuals do have weddings and wedding receptions at their homes but this would customarily not be a regular occurrence. What is taking place here is a commercial venture and it is not allowed in a residential zoning district. r We have agreed, verbally,that the two functions that are already booked for the weekends of August 7 & 8 and for August 27 & 28 will be allowed to take place. However, further bookings of weddings or other similar events must cease and the web site advertising this house must be eliminated. If other events of this nature occur in the future this department will assess fines to you as the homeowner. We look forward to your cooperation in this matter. The house is also situated on 1.34 acres and only a one minute walk from a private beach on Cape Cod Bay. THE TENANCY agreement will commence on August 1,2004 for a period of no more than one week therefore commencing exactly from Sunday,August 1,2004 at three o'clock p.m.until Sunday,August 8,2004 at 11:00 o'clock a.m.(late check out has been requested but it will be dependent upon whether or not the home is rented that Sunday as to whether late check out can be accomodated). The rate for this rental is$6000.00 total. A nonrefundable holder's fee in the amount of $2500.00 is required within 72 hours to reserve the home for Lessee. The holder's fee is nonrefundable because the Lessor will not make the home available to anyone else for rent during the reserved time. The following terms and conditions are part of this contractual agreement, 1. Occupants.All major events or parties that will contain more than this number of people must be preapproved by Lessor, Lessee is responsible for all damages to the said premises in relation to any pre-approved event or party or gathering of any kind. 2. Pets, No pets shall be brought on the premises without the prior written consent of Lessor. 3. Cleaning. A cleaning fee of$200.00 per week will be charged and home will be cleaned once per week,it is preferred to be done on Fridays at 10.00 a.m. but for a week long rental the home will be cleaned Saturdays at 11:01 a.m. 4. Ordinances and Statutes. Lessee shall comply with all statutes, ordinances and requirements of all municipal,state anc federal authorities now in force,or which may hereafter be in force, pertaining to the use of tt•e premises. S. Repairs or Alterations. Lessee shall be responsible for damages caused by his negligence and that of his family or invitees and guests and he/she will be charged to repay these damages in full. Lessee shall not paint, paper or otherwise redecorate or make alterations to the premises without the prior written consent of Lessor. All alterations, additions, or improvements made to the premises with the consent of Lessor shall become the property of Lessor and shall remain upon and be surrendered with the premises. 6. Assignment and Subletting. Lessee shall keep and maintain the premises in a clean and sanitary condition at all times,and upon the termination of the tenancy shall surrender the premises to Lessor in as good condition as when received,ordinary wear and damage by the elements excepted. 7. Utilities. Lessor shall oe responsible for the payment of all utilities and services except for those that exceed the normal and reasonable expenses for the month. 8. Default. If Lessee shall fail to pay rent when due, or perform any term hereof, after not less than three(3)days writte-notice of such default given in the matter required by law, Lessor,at his option, may terminate all rights of Lessee hereunder, unless Lessee,within said time, shall cure such default If Lessee abandons or vacates the property, while in default of the payment of rent, Lessor may consider any property left on the premises to be abandoned and may dispose of the same in any manner allowed by law. 9. Security. The security deposit in the amount of$600.00 shall secure the performance of Lessee's obligations hereunder. Lessor may, but shall not be obligated to, apply all or portions of 07/28/2004 WED 15:01 FAX &02/003 said deposit on account of Lessee's obligations hereunder. Any balance remaining upon termination shall be returned to Lessee. Lessee shall not have the right to apply the security deposit to any damages to the said premises. A cashier check payable to Laura Blair will be paid upon entry of the said premises and retained for damages. The certified check will be returned to Lessee upon proper inspection and approval of the condition of this home. 10. Right of Entry. Lessor reserves the right to enter the demised premises at all reasonable hours of the day. Maintenance men will be allowed to enter the home when needed as long as Lessee is notified in advance. 11. Deposit Refunds. The balance of all deposits will not be refunded. 12. Termination. A holder's fee of$2500.00 payable to Laura Blair is non-refundable for any ca-ser�txat�tio—nd witl•be.a. . The prevailing party in an action brought for the recovery of rent or other moneys due or to become due under this lease or by the reason of a breach of any covenant herein contained or for the recovery of the possession of said premises,or to compel the performance of anything agreed to be done herein, or to recover for damages to said property,or to enjoin any act contrary to the provision hereof,shall be awarded all of the costs in connection therewith,including, but not by way of limitation, reasonable attorney's fees. 14, Radon Gas Disclosure. As required by law,(Landlord)(Seller)makes the following disclosure: "Radon Gas" is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have not been found at the above said premises. 15. Lead Paint Disclosure. Not applicable in above said premises since home was built in the year 2002. 16. Safety of Children_ It is the responsibility of the parents and guardians of all children to assure their safety while visiting the above mentioned premises that is at 25 Vanduzer Road. Lessor is in no way responsibile for child safety issues- 17. Safety of Adults. Lessor has no responsibility for injury of any kind to any children or adults visiting the home_ Tenants are expected to conduct themselves reasonably as to avoid injury or harm. 18. Linens. Linens and towels will be provided. 19. Any weddings or events on the premises of the 35 Vanduzer Road in Cummaquid are the sole responsibility of the tenant All permits,ordinances and curfews should be obtained, if needed for such events by the tenant renting the home. The home improvements needed were substantially greater than had been anticipated by her when she purchased the home. Mr. O'Malley gave a description o=the expansion and alteration of the structure and presented pictures to illustrate the present site and what the addition would look like when completed. He stated that there is dense growth that will screen the deck. It was noted that the plans presented with the application showed the structure to be within 20 feet of Harbor Point Road. If that were the case, additional relief is required for the entire structure as it fronts on to that street. Ms. Blair stated that the structure was setback slightly to account for that required 20 feet along Harbor Road at the request of the interim Building Commissioner. She noted that was to allow the Building Permit to issue as-of-right. The Board requested an updated plan showing the exact setbacks and proposed deck area to be drawn. Public comment was requested. Dr. Edward Gramse spoke in favor of the petition. Chairman Jansson noted that four letters were submitted to the file. Judith Markland, Frank&Josephine Cassell, wrote in opposition to the request and John Klim and Owen &Jane Carney wrote in support. The hearing was continued to November 7`h, 2001, at which time an updated survey plan of the newly constructed area on to Harbor Point Road was presented. That plan was entitled"Proposed Deck Plan" drawn by Yankee Survey Consultants, dated 11-6-01. The Board reviewed the plan and noted that the new wall of the structure as it fronts Harbor Point Road was setback 20 feet as required under Section 4- 4.3 (1). The Board determined that the applicant was entitled to request a Special Permit under that • Sections sub-paragraph (2) for expansion of a non-conforming residential structure. Findings of Fact: At the hearing of November 07, 2001, the Board unanimously found the following findings of fact: 1. Appeal 2001-99 is for a special permit in under Section 4-4.3 (2) Non-conforming Buildings Used as a Single Family Residence. The petitioner, Laura M. Blair, has applied for a special permit to allow for a 14 by 6 foot second story deck addition to the front of the dwelling on Harbor Point Road. The property is shown on Assessor's Map 352, Parcel 065, addressed as 35 Tokamahamon Road, Cummaquid, MA in a Residential F-1 Zoning District. 2. The property is a 1.29-acre parcel that is developed with a single-family dwelling. The structure is undergoing extensive rebuilding and expansion. The one-story home is being expanded with a second story and a new three-car garage. Originally the structure had four bedrooms located on the first floor. The rebuilt structure has moved the bedrooms to the second level. Staff has estimated the new dwelling to be approximately 3,700 sq.ft. of living area. 3. The Old King's Highway.Historic District Committee approved plans for the addition and rebuilding on January 31, 2001. 4. The existing on-site cesspool has been removed and a new Title V system installed. 5. The applicant is seeking to install a second floor deck 14 feet long and 6 feet wide on the side of the dwelling facing Harbor Point Road. The existing structure is non-conforming in terms of structure. It is located 20 feet from Harbor Point Road at its closest point. According to plans submitted, the proposed deck would infringe into the established non-conforming 20-foot setback by 5 feet. • 2 l ' f • 6. According to the Assessor's records, the dwelling dates to 1945 and would predate the original zoning of the area on March 6, 1950. The applicant has sought both a special permit for an intensification of the non-conforming structure and a variance to the required front yard setback. Only one form of relief is necessary.. 8. Harbor Point Road is a narrow graveled roadway as it borders on this side of the lot. The lot is unique in that roadways surround it on all sides. 9. The application falls within a category specifically allowed in the ordinance for a grant of a Special Permit. 10. After evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. Decision: Based on the findings of fact, a motion was duly made and seconded to grant a special permit for a second floor deck area of approximately 6 feet by 14 feet finished area to infringe into the required front yard setback of the dwelling on the Harbor Point Road side with the following conditions. 1. Development of the site shall be in conformance with plans entitled"Proposed Deck Plan" drawn by Yankee Survey Consultants, dated 11-6-01. 2.
